This permit, issued on Aneust 3, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Bulkhead
1) The alignment of the authorized bulkhead shall not exceed a distance of two feet waterward of the
existing deteriorated bulkhead.
2) No backfill material shall be placed within 30 feet of the normal high water line, except that which will
be used to backfill the area behind the permitted bulkhead.
3) The temporary placement or double handling of fill materials within waters or vegetated wetlands is
not authorized.
4) The bulkhead shall be constructed prior to any backfilling activities.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure.
6) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or
other suitable materials approved by Division personnel.
7) All backfill material shall be clean and free of any pollutants except in trace quantities.
Sedimentation and Erosion Control
8) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed
immediately landward of the bulkhead cap immediately following completion of backfilling activities.
Expanded Dockine Facility
10) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this expanded docking facility without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
11) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a
violation of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
12) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
13) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
14) This permit does not authorize any additional formalized boat slips.
15) The expanded platform shall have a minimum setback distance of 15 feet betwee,"�p t pf jhhee®

General
16) No open water areas shall be filled, even temporarily, outside of the approved bulkhead alignment.
17) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources assigned the project D WR Project No. 2017-0738.
NOTE: The U.S. Army Corps of Engineers has assigned the project Action ID No. SAW-2017-02146.
NOTE: An application processing fee of $400 was received by DCM for this project.

Date: August 3, 2017
The applicant proposes to replace the existing bulkhead and install a new platform over
open water. The project is located at 7038 7 h Street in Surf City, Onslow County.
Areas of Environmental Concern (AEC's) impacted by the proposal are WE, PT, ES.
Waters at the project site are classified as SA and are not open to the harvest of shellfish.
The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Surf City Land Use Plan
Update and offer the following comments.
The general area of the project is classified as Conservation.
In general, Surf City allows development in Conservation classified areas and AECs,
which is consistent with the State's minimum use standards. The Surf City Land Use
Plan contains some policies and discussion, which exceed the State's minimum use
standards. However, none of these policies are applicable to this project.
This project appears to be consistent with the 2005 Surf City Land Use Plan Update.

Thanks for your quick call back- sorry I missed you. So I think the memo with the changes were just send over by hard
copy. Please see the attached scanned copy.
The bulkhead has been brought back to just 2' waterward of the existing wall. And then he has expanded the proposed
platform in light of the change in bulkhead location. We do consider the structure to have separate components due to
the finger pier and roofed area.

CAMA Permit Application Revision
The Field Investigation Report (FIR) for the subject project was circulated on June 12, 2017.
The scope of work proposed in the initial application package included the construction of 75 linear
feet of bulkhead (including wing walls), to be located approximately 10' waterward of the existing
bulkhead, resulting in the filling of approximately 1,100 sq. ft. of open water/public trust area.
Following submission of the initial CAMA major permit application package, and through the multi -
agency permit review process, concerns were raised by several agencies over the unnecessary taking
of public trust area for private development. Specifically, the filling of approximately 1,100 sq. ft. of
estuarine and public trust waters for installation of a bulkhead where there appeared to be no
significant erosion. As a result, the applicant was notified and informed of these concerns, and he/she
has since decided to reduce the amount of open water impacts by constructing a new bulkhead
approximately two feet waterward of the existing bulkhead alignment. Under the revised plan,
approximately 110 sq. ft. of open water fill will occur rather than 1,100 sq. ft.
Additionally, and through the same permit application revision, the applicant is requesting
authorization to enlarge the proposed platform from 6' x 13' (as originally proposed) to 13' x 131
.
Based on information presented in the revised package, the applicant has approximately 55 linear feet
of shoreline allowing 440 sq. ft. of dock/platform area. Under this revision, approximately 418 sq. ft.
of dock/platform would be associated with this docking facility.

In addition to this completed application form, (MP-1) the following items below, if applicable, must be submitted in order for the application
package to be complete. Items (a) - (1) are always applicable to any major development application. Please consult the application
instruction booklet on how to properly prepare the required items below.

proposed project. Is any portion already complete? If previously authorized work, dearly indicate on maps, plats, drawings to distinguish

d. A copy of the deed (with state application only) or other instrument under which the applicant claims title to the affected properties.

The total area of proposed platform area was calculated as follows:
Shoreline length = +/-55' x 8' = 440 sq. ft. maximum allowable
Proposed Fixed Platform = 6' wide by 13'long = 78 sq. ft.
Existing finger dock = 5' x 35' = 175 sq. ft.
Existing platform = 10' x 12' = 120 sq. ft.
Total= 373 sq. ft.
The construction of the fixed platform appears to be consistent with the use standards set forth in
NCAC 07H .0208(b) (6), including the '/. width rule, the eight -square foot rule and the pier width
rule. The proposed structures would be located entirely over open water. This office has no
objection to the proposed platform provided it is consistent with all other state and federal
permitting requirements. It is recommended that any permit issued should include standard
conditions for private docking facilities.
To remain CONSISTENT with the Rules established by the Coastal Resources
Commission, as cited below, it is staff's recommendation that the applicant limit the
location of the proposed bulkhead to no more than 6-feet waterward of the existing
bulkhead alignment in order to connect, or "tie into", the adjacent bulkhead to the west.
Staff's determination was based on the following factors:
Section 15A NCAC 07H .0208 (b)(7)(A) states: "Bulkhead alignment, for the purpose of
shoreline stabilization, shall approximate the normal high water or normal water level".
Section 15A NCAC 07H .0208 (b)(7)(B) states: `Bulkheads shall be permitted below normal
high water or normal water level only when the following standards are met:
(i) The property to be bulkheaded has an identifiable erosion problem, whether it results
from natural causes or adjacent bulkheads, or it has unusual geographic or geologic
feathers, e.g. steep grade bank, which will cause the applicant unreasonable hardship
under the other provision of this Rule;
(ii) The bulkhead alignment extends no further below normal high water or normal water
level than necessary to allow recovery of the area eroded in the year prior to the date
of application, to align with adjacent bulkheads, or to mitigate the unreasonable
hardship resulting from the unusual geographic or geologic features;
(iii) The bulkhead alignment will not adversely impact public trust rights or the property
of adjacent riparian owners;
(iv) The need for a bulkhead below normal high water or normal water level i4RECE1VED
documented by the Division of Coastal Management; and
(v) The property to be bulkheaded is in a non -oceanfront area." JUN 13 2017
Provided the applicant limits the proposed new bulkhead alignment to no more thaMM_ MHD CITY
waterward of the existing bulkhead alignment, this office has no objections to the proposed
project. Any permit issued should include the standard permit conditions for bulkheads.

On June 9, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a
copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
June 16, 2017 has determined that the development activities proposed at this time will not pose a threat to surface
water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 2H.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

SUBJECT: CAMA Dredge/Fill Permit Application for Rex Bost, Onslow County, North
Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit
application with regard to impacts on fish and wildlife resources. The project site is located at 7038 7t°
Street adjacent to Stump Sound in Surf City, NC. Our comments are provided in accordance with
provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended,
Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act
(48 Stat 401, as amended; 16 U.S.C. 661 et seq.).
The applicant proposes to replace an existing bulkhead by aligning the new structure 10' waterward the
existing alignment. This new alignment would extend the same distance as a nearby, but not adjacent
property. In addition to the bulkhead replacement, a 6' by 13' fixed platform is proposed to be
constructed immediately waterward the new bulkhead alignment Stump Sound is classified SA and SA-
ORW by the Environmental Management Commission.
The NCWRC has reviewed the project proposal and does not object to the installation of a replacement
bulkhead and new platform. However, we believe the bulkhead alignment should be placed closer to the
existing alignment than proposed. The proposal does not align directly with an adjacent property and
could be installed with tie -backs closer to the existing structure, reducing the amount of shallow water
habitat fill.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the
CAMA permit application for proposed actions that impact fish -and fish habitats. The applicant proposes to
install a replacement bulkhead approximately 10-feet waterward of an existing timber bulkhead and filling the
area. This fill would result in a loss of approximately 550 square feet of Estuarine Waters and Public Trust
Area. The applicant also proposes to construct a 6-foot by 13-foot fixed platform along the eastern side of the
existing platform which would shade an additional 78 square feet of shallow bottom habitat.
Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in
storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom
habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly
productive and, by providing refuge from predators, is an important nursery area. Species dependent on
shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, drum species, and ray.
The proposal to move the aew bulkhead approximately 10 feet waterward of the existing bulkhead is viewed as
unnecessary and would cause a loss of shallow bottom habitat as well as public trust water. For these reasons,
it is the position of DMF to obiect to the project as currently proposed. If the applicant proposed to move
the new bulkhead waterward only to the distance absolutely necessary for construction (generally.<2-foot
waterward), the objection would be withdrawn.
DMF has no comment on the proposed construction of a 6-foot by 13=foot fixed platform along the eastern
side of the existing platform.

We may be able to review this project as a NWP 3, but only if they redesign the proposal and reduce the fill by half. So,
they could go a maximum of 5 feet water ward of the existing bulkhead, and only of there is no other option to repair.
As proposed, the project would not fit any of our GPs or NWPs other than through the GP 291 review process.

Hi Gary,
Thanks for taking my call. To summarize what we discussed, there are some permitting concerns regarding the proposed
alignment of the bulkhead for the Bost property. The general use standards [15A 07H .0208(b)(7)] require that
bulkheads are only permitted below normal high water when there is an identifiable erosion problem and it extends no
further below NHW than necessary to recover the area eroded in the past 12 months, if there are unusual geographic
features like a steep grade bank that causes unreasonable hardship, orto align with adjacent bulkheads, and in all cases,
that the need to extend below high water is documented. In this case, we only have one adjacent bulkhead, and a boat
ramp on the other side of the property line. We do consider existing bulkheads to fall within the unreasonable hardship
category in terms of extending and replacing them below high water instead of having to tear out the existing wall- but
we generally limit alignments to 2' waterward of the existing bulkhead, except in unusual circumstances, or as
previously stated, to align with adjacent bulkheads. So due to the adjacent bulkhead on the one side, we could allow the
bulkhead to extend approximately 6' out to connect to that adjacent wall, but the boat ramp side would need to be
pulled back to 2' waterward of the existing bulkhead alignment. If Mr. Bost wants a straight bulkhead alignment instead
of being diagonal across his property, I'm afraid we could just permit it if the entire wall was brought back 2' waterward
of the existing alignment. In addition to considering our use standards, we have also received an objection to the
proposed alignment from our Fisheries Resource Specialist and concerns from Wildlife Resources Commission citing an
unnecessary loss of shallow bottom habitat and public trust area. The U.S. Army Corps of Engineers has also informed us
that the proposed alignment does not qualify for their streamlined Nationwide Permit, and would require federal
agency coordination and comment, but if the applicant were to pull the proposed bulkhead back to one of the two
alignments suggested above, they could then utilize the nationwide permit and authorize the project much more
quickly.
Please discuss these concerns with Mr. Bost and let me know if you have any questions and/or how you would like to
proceed.

Please see attached 2 marked up photos indicating a potential revision to our improvement
application. I also included a satellite shot for convenience. I believe Gary is scheduled to
meet with you on Wednesday.
The current sea wall along the NE side of 7th street is fairly consistent with the exception of
these 2 address ... 7038 (mine), and 7040. 1 understand you have varying departments that
have to sign off on special applications so thought the visuals may help. The colored arrows
are indicating bulkheads for:

7040 red
7038 orange
7036 green
Please look at the white lines on the photograph looking NW. I hope your group would
consider allowing 7040 to parallel with others. That would have them starting at the same
point it is currently meeting 7042 and swinging out about 2 ft. as indicated. Then my wall
could step back in 2 ft. and parallel down. This puts the extension of my wall at 5ft, 7 inches.
The brown lines indicate extending the dock to meet the wall. I guess the bottom line is that
we want the wall to remain perpendicular with the canal (not angled) and would like to
gain as much yard as possible. I know I bought the property this way but it seems a bit unfair
that our yard is minimized compared to our neighbors (and the whole street).

9. PROJECT DESCRIPTION:
The project site is located at 7038 71s Street, adjacent to canals of Surf City and Stump Sound, in Surf City,
Onslow County. To get to the site from the Wilmington Regional Office, take US Hwy 17 N to NC Hwy
210 (approximately 15 miles) and turn right. Continue approximately 2 miles along NC Hwy 210 and turn
right at the intersection of NC Hwy 210 and Rowland Ave. Travel approximately 1.9 miles along Rowland
Avenue and turn left onto New River Drive. Continue along New River Drive for approximately 2.3 miles
and turn left on Seventh Street. The subject property will be located along the right-hand side of 7`s Street,
at house number 7038.
The subject property is developed (residential) with approximately 55 linear feet of shoreline bordering the
7' Street canal. Elevations at the property range from 3' to 5' above the normal high water (NHW) line.
The size of the tract is approximately 7,840 sq. ft., or 0.18 acres. Lawn grasses and ornamental landscaping
make up the high ground vegetation and there are no wetlands on, or adjacent to the subject property. Just
waterward of the existing bulkhead, the applicant maintains a private docking facility which consist of a
short access pier and fixed platform (running parallel to the shoreline). Currently, the normal high water
line approximates the existing bulkhead.
The area surrounding the property is heavily developed. Immediately toward the east lies the adjacent
property owners boat ramp and private docking facility, and on the western property, rest a small fixed
platform. The two adjacent bulkheads extend approximately 6' waterward of the applicant's existing
bulkhead.
The Surf City Land Use Plan classifies the adjacent waters as Conservation. The waters of the canals and
Stump Sound are classified SA and SA-ORW (respectively) by the Division of Water Resources. The
waters immediately adjacent to the property ARE NOT designated as a Primary Nursery Area (PNA) by
the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to replace the existing bulkhead and install a new platform over open water.
The existing bulkhead is comprised of timber and was installed many years ago. The existing tie -backs that
support the wall have begun to deteriorate and have cause minor "wash out" behind the wall.
The applicant's current proposal includes construction of a new bulkhead approximately 10-feet waterward
of the existing wall. The applicant has indicated he, and the neighbor immediately west, would like to
extend their walls to align with the neighbor located two lots over toward the west (7042 7s' Street).
However, the neighbor immediately west of the applicant has not indicated to DCM of their intention of
doing the same.
As designed, the proposed wall would be located approximately 10' beyond the current alignment, and
would extend roughly 4 feet beyond the western neighbors existing wall. Along the eastern property
boundary, the applicant proposes a 20-foot return just inside the eastern neighbor's boat ramp. The proposed
project would result in the unnecessary filling of approximately 550 sq. ft. of estuarine and public trust
waters.
High ground disturbance associated with the applicant's proposal would include grading and filling
approximately 1,100 sq. ft. (dead -men and anchoring).

In additional to the proposed bulkhead, the applicant is requesting approval for the construction of a new
6' x 13' fixed platform along the eastern side of the existing platform. As designed, the new platform would
be uncovered and would be located just beyond (wateward) the alignment of the proposed bulkhead. Based
on the information provided, it does not appear the applicant would encroach within the 15' riparian corridor
associated with the adjoining property owner.
10. ANTICIPATED IMPACTS:
The proposed bulkhead would fill approximately 550 sq. ft. of Estuarine Waters and Pubic Trust Area and
approximately 1,100 sq. ft. of upland soils. The proposed bulkhead would extend approximately 10 feet
beyond the existing wall. The proposed platform would shade an additional 78 sq. ft. of shallow bottom
habitat.

completed application for your client, Rex Bost, requesting State approval for the development of property
located at 7038 7' Street, adjacent to Stump Sound, in Surf City, Onslow County. The projected deadline
for making a decision on your permit application is August 20, 2017. An additional 75-day review period
is provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 6, 2017, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
