Any violation )t these terms may be subject to rmes, rmprrsonmrenL ur civu UUL U r, yr May VQull u=l Shoreline Stabilization - Bulkhead and Rip Rap 1) The alignment of the authorized bulkhead and rip rap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of construction. 2) The rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 3) The bulkhead shall be constructed prior to any backfrlling activities. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee John Blount Permit No' 101-17 Page 2 of 2 ADDITIONAL CONDITIONS 4) The bulkhead shall be structurally tight so as to prevent, seepage of backfill materials through the structure. 5) The fill material shall be clean and free of any pollutants except in trace quantities. 6) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 7) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. 8) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached permit application and workplan drawings. Sedimentation and Erosion Control 9) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2017-01491). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 3900 and assigned the project DWR Project No. 17-0890. NOTE: The permittee is advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. NOTE: An application processing fee of $400 was received by DCM for this project. Staff has reviewed the proposed project about rules found in Subchapter 7H concerning development in an Estuarine Water, Public Trust Area and Coastal Shoreline. It is staffs recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 (b)(7)(D) as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(7)(D) which states in part that (i) "the property has an identifiable erosion problem", (iii)" the bulkhead will not adversely impact public trust rights or the property of adjacent riparian owners", (v) "the property to be bulkheaded is in a non -oceanfront area'. This particular 30' wide eroding shoreline is located between two existing bulkheads. Staff recommends the following conditions be included if the project is permitted. DAVIS Director Consistency Determination: The request is consistent with/not in conflict with the 2007 City of Washington CAMA Core Land Use Plan certified by the CRC on November 30, 2007. Overview: The .75-acre property has approximately 125 linear feet of shoreline, the eastern most 30' of the lot has not been stabilized with a bulkhead. 20' of the 30' feet has a breakwater. The applicant is proposing to convert the 20' breakwater into a bulkhead to bulkhead the remaining 10' of the property at 102 Northwest Ave, in the City of Washington ETJ, Beaufort County, North Carolina. Existing site improvements include a single-family dwelling, bulkhead, riprap and a pier with a boatlift. The project is in the Estuarine Water (EW) and Public Trust Area (PTA) Areas of Environmental Concern (AEC). The project is located along the Pamlico River; the water is classified as SB/NSW, are closed to the taking of shellfish. A review of PNA, SAV, and archaeological/cultural resources was not provided. Anticipated impacts resulting from this project are expected to include: the filling of 225 ft2 of river bottom. The project will result in localized turbidity due to construction of the bulkhead. Basis for Determination: The project site is in the ETJ of the City of Washington and is subject to the town's 2007 Land Use Plan. The Future Land Use Map (FLUM) designates the site as Medium Density Residential. Medium Density Residential is defined in the LUP as follows (pg. 227): The Medium Density Residential land use category is primarily intended for residential development of single-family homes on lots between 8,000 and 14,000 square feet in size. Residential densities shall be three (3) to five (5) dwelling units per acre, depending on lot size. This land use category also allows for Planned Unit Developments (PUD). The site is a .75-acre single-family residential lot. Existing man-made features on the lot consist of a single-family dwelling, bulkhead, riprap and a pier with boadift. Vegetation on the lot consist of St. Augustine grass, ornamental shrubs, numerous pine and hardwood trees. The lot has approximately 125 linear feet of shoreline. The eastern most 30 feet of the lot has not been stabilized with the bulkhead, although 20' of that 30' has a breakwater. The breakwater is located approximately 15' waterw rd of the Normal Water Level. Both the upstream (east)side and downstream (west) side are developed single family lots with shorelines stabilized with bulkheads. The project site is approximately 8 feet above normal water level. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is Coastal waters and is not open to shell fishing. Proiect description The applicant proposes to convert the 20' of breakwater into a bulkhead and bulkhead the remaining 10' of his property. The bulkhead will be a maximum of 15' waterward of the Normal Water level. Anticipated impacts The construction of the bulkhead will result in the filling of approximately t225 ftz of River bottom. The project will result in localized turbidity because of the construction of the bulkhead. Presently, most of the shoreline is armored with a freestanding bulkhead with riprap in front. However, there is a portion of my lot, totaling 10' that has not been protected. This proposal is to bulkhead and riprap the remaining portion of my lot to stop further erosion as well as reduce the amount of debris that ends up in my yard on a high wind tide due to this open area in the wall. There is a bulkhead of the same likeness on the adjacent property. I would like to connect to this bulkhead to completely protect the remaining of my property.
