Excavation In order to reduce the potential for negative effects on the spawning migration of anadromous fish, no excavation or filling shall be permitted between February 15 and June 30 of any year without the prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. No excavation shall take place outside of the area indicated on the workplan drawings. Excavation shall not exceed -8 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. Signature of Permittee limn Black Jr. Permit No.113-17 Page 2 of 3 ADDITIONAL CONDITIONS The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. ,No excavated or fill material shall be placed at any time in any vegetated wetlands or surrounding waters. Spoil Disposal No spoil material shall be placed within 30 feet of the normal water line. All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of " solids into any marsh or surrounding waters. The permittee and/or his contractor shall take all necessary precautions to ensure that the spoil material is properly contained during transport to the disposal site, and that all the proper coordination has taken place with the local or state governments to ensure that any damage to public streets caused by transport of the spoil material has been addressed. The area adjacent to the spoil offloading site is a NCWRC boating access area. The offloading operations shall not encroach upon the NCWRC property or deter the use of the NCWRC boating access area by the public. Maintenance Clause The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Navigational Aides Unless specifically altered herein, this permit authorizes the installation of 6 day marker type navigational aids, all as expressly and specifically set forth in the attached permit application and workplan drawings. The navigational aids shall conform with any and all appropriate regulations governing such structures, including but not limited to marking and lighting requirements of the N.C. Wildlife Resources Commission and/or the U.S. Coast Guard. Black Jr. ADDITIONAL CONDITIONS - General Permit No.113-17 Page 3 of 3 This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to :project initiation. This Major Modification shall be attached to the original Permit No. 113-17, which was issued to the "permittee on 9/28/17, and copies of both documents must be readily available on site when Division personnel inspect the project for compliance. All conditions and stipulations of the active permit remain in force, under this Major Modification, unless specifically altered herein. The Division of Water Resources assigned the proposed project DWR Project No. 85-0177 V3. An application processing fee of $475 was received by DCM for this project. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 1'50B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. DATE: 6/3/18 A North Carolina Division of Coastal Management(DCM) Fisheries Resource Specialist has reviewed the subject permit application for proposed actions that impact fish and fish habitats. The applicant proposes to perform maintenance excavation within an existing armored basin on the Albemarle Sound and also proposes to dredge a new access channel into the Albemarle Sound for private use. The proposed channel will extend from the mouth of the basin 979' southward into the Sound and measure 50' in width. The proposed finally depth of the basin and channel is -8' at NWL. Submerged Aquatic Vegetation (SAV) surveyshave been conducted both when the basin wall was armored with rip -rap and prior to this proposal and SAV seems to be limited to water depths less than -4' at NWL with only single sprigs of found in deeper waters. The current depth of the areas proposed to be dredged for the access channel are - 5' to -6' at NWL for the majority of the dredge footprint before dropping off to connecting water depths of -8' near the southern end of the proposed dredge area. Due to the existing depths within the project area DCM fisheries does not anticipate the project will negatively impact SAV in the area. DCM fisheries does have concerns that the sediment composition along with the large fetch and down shore current at the location will lead to the channel shoaling often and require maintenance dredging regularly. The Albemarle Sound is a migration corridor for anadromous fishes such as striped bass, alewife, blueback herring, American Shad, and hickory to reach their upstream spawning areas in the Sounds many tributaries. Activities such as dredging can negatively impact the spawning migration causing avoidance of the area and fallback behavior due to increased noise and turbidity. To reduce the potential for these negative impacts to the spawning migration of anadromous fishes in the Albemarle Sound due to the initial dredging event and subsequent maintenance events a moratorium on dredging from Feb 15 to June 30 is recommended. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. In the absence of overriding public benefit, any use which jeopardizes the capability of the waters to be used by the public for navigation or other public trust rights which the public may be found to have in these areas shall not be allowed. The development of navigational channels or drainage ditches, the use of bulkheads to prevent erosion, and the building of piers, wharfs, or marinas are examples of uses that may be acceptable within public trust areas, provided that such uses shall not be detrimental to the public trust rights and the biological and physical functions of the estuary. Projects which would directly or indirectly block or impair existing navigation channels, increase shoreline erosion, deposit spoils below normal high water, cause adverse water circulation patterns, violate water quality standards, or cause degradation of shellfish waters are considered incompatible with the management policies of public trust areas. In every instance, the particular location, use, and design characteristics shall be in accord with the general use standards for coastal wetlands, estuarine waters, and public trust areas. Consistent: The development proposal is consistent with this rule. 15A NCAC 07H .0208 USE STANDARDS (a) General Use Standards (1) Uses which are not water dependent shall not be permitted in coastal wetlands, estuarine waters, and public trust areas... Uses that are water dependent include: utility crossings, wind energy facilities, docks, wharves, boat ramps, dredging, bridges and bridge approaches, revetments, bulkheads, culverts, groins, navigational aids, mooring pilings, navigational channels, access channels and drainage ditches; Consistent: The development proposal is consistent with this rule. Department of Cultural resources; (D) Development shall not increase siltation; (E) Development shall not create stagnant water bodies; (F) Development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources; and (G) Development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposal is consistent with this rule. (b) Specific Use Standards (1) Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this Subchapter. Navigation channels, canals and boat basins shall also comply with the following standards: (A) Navigation channels and canals may be allowed through fringes of regularly and irregularly flooded coastal wetlands if the loss of wetlands will have no significant adverse impacts on fishery resources, water quality or adjacent wetlands, and if there is no reasonable alternative that would avoid the wetland losses; No wetlands are in the proposed project area(s). (B) All dredged material shall be confined landward of regularly and irregularly flooded coastal wetlands and stabilized to prevent entry of sediments into the adjacent water bodies or coastal wetlands; (C) Dredged material from maintenance of channels and canals through irregularly flooded wetlands shall be placed on non -wetland areas, remnant spoil piles, or disposed of by a method having no significant, long-term wetland impacts. Under no circumstances shall dredged material be placed on regularly flooded wetlands. The designated spoil site is an upland parcel located approximately 0.2 miles away from offloading area. (D) Widths of excavated canals and channels shall be the minimum required to meet the applicant's needs but not impair water circulation; Consistent: The development proposal is consistent with the intent of this rule. (E) Boat basin design shall maximize water exchange by having the widest possible opening and the shortest practical entrance canal. Depths of boat basins shall decrease from the waterward end inland; Consistent: The development proposal is consistent with the intent of this rule. (F) Any canal or boat basin shall be excavated no deeper than the depth of the connecting waters; Consistent: The development proposal is consistent with this rule. (G) Construction of finger canal systems are not allowed. Canals shall be either straight or meandering with no right angle corners; Consistent: No finger canals are proposed; the access channel is proposed to go straight out from the existing boat basin, to connect to a naturally occurring depth of -8' NWL. (H) Canals shall be designed so as not to create an erosion hazard to adjoining property. Design may include shoreline stabilization, vegetative stabilization, or setbacks based on soil characteristics; and No canals are proposed in the application. (1) Maintenance excavation in canals, channels and boat basins within primary nursery areas and areas of submerged aquatic vegetation as defined by the MFC shall be avoided. However, when essential to maintain a traditional and established use, maintenance excavation may be approved if the applicant meets all of the following criteria: (i) The applicant demonstrates and documents that a water -dependent need exists for the excavation; Consistent: During the scoping meeting it was reported that the applicant's boat draws 5-1/2' of water, and the current depths coming out of the basin averaged 5' to 5-1/2', with a 2' wind tide fluctuation in the area. The final project depth is proposed at -8'. If a natural channel was in use, or if a human -made channel was constructed before permitting was necessary, there shall be evidence that the channel was continuously used for a specific purpose; Potentially inconsistent: the applicant proposes mechanical dredging of a new access channel. (iii) Excavated material can be removed and placed in a disposal area in accordance with Part (b)(1)(B) of this Rule without impacting adjacent nursery areas and submerged aquatic vegetation as defined by the MFC; and Consistent: An SAV survey was conducted on May 15, 2018. Only minor occurrences of SAV were found at the sampling stations. Out of 90 dives, only 8 dives encountered SAV. Only 1 location of SAV cover was recorded at approximately 5%. It was reported that brackish water SAV habits and growth patterns vary from year to year due to natural and anthropogenic factors, but it was uncommon to find a significant SAV resource in water greater than 5' deep in the region of the project area. Findings of the SAV survey were reviewed in the field by Shane Staples on May 22, 2018. (iv) The original depth and width of a human -made or natural channel shall not be increased to allow a new or expanded use of the channel. Consistent. The use of the proposed channel will not change. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application and plans, I recommend Major Permit #113-17 be modified and issued to William Black, Jr. as requested, with standard permit conditions. DATE: June 26, 2018 Consistency Determination: The request is consistent with/not in conflict with the Chowan County/Town of Edenton 2008 Core Land Use Plan certified by the CRC on July 24, 2008. Overview: The 2 acre subject property consists of two (2) waterfront lots under common ownership with a combined shoreline of 420 linear feet along the Albemarle Sound. Approximately 150 feet of shoreline consists of sandy beach. The site is elevated approximately 6 feet above Normal Water Level (NWL). The site is located primarily outside of a floodzone, with areas near the shoreline located in floodzone AE. Existing site improvements consist of a single-family house and associated infrastructure. Existing shoreline improvements consist of a pier with terminus platform, riprap, two (2) 12 foot wide by 50 foot long gabion basket rock jetties, and a boat basin with bulkhead and sheet piling walls that includes docks and boatlet ski lifts. Sheet piling walls extend from both sides of the shoreline bulkhead to form the boat basin. Two (2) jetties extend from the sheet piling walls to form the basin entrance. Riprap is located at the western boundary of the property near the shoreline; in the center of the property along the western side of the boat basin's sheet piling wall; around the basin wall and gabion rock jetties, and; at the eastern side of the property near the shoreline. Shoreline development for this site was approved under CAMA Major Permit #50-85 issued in April of 1985 and permit modifications through 1989. General Permit #67345A was issued in January of 2017 for maintenance excavation of the existing channel and boat basin area to a depth of -5 feet below NWL. Most recently, Major Permit 113-17 was issued in September of 2017 for installation of rock around the basin wall and gabion rock jetties. Mechanical dredging of a 50 foot wide by 979 foot long channel to a depth of -8 feet below NWL is proposed. The channel will extend from the basin into the Albemarle Sound and cover approximately 1.41 acres. The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish taking. Minor occurrences of Submerged Aquatic Vegetation (SAV) were identified in the project area based on SAV survey conducted on May 15, 2018. A review of historic sites, geologic formations or archaeological sites associated with the project area was not provided. Anticipated Impacts resulting from this project are expected to include: the dredging of approximately 1.41 acres of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC). Basis for Determination: The project area is located on the Albemarle Sound. The Edenton/Chowan County Future Land Use Map identifies the project area as "Conservation/Open Space". As indicated on Page 135, "...coastal wetlands, estuarine waters, estuarine shoreline, public trust areas, and 'Section 404' wetlands..." are part of the "Conservation/Open Space" designation. Edenton, Chowan County, NC Background Received May 2018 MAY 2 J 2018 DCM-EC The subject site is located along the Albemarle Sound on Country Club Road in Edenton, Chowan County, NC and owned by Mr. William Black, Jr. The property includes a residential home with a boat basin that extends into the Albemarle Sound. The boat basin includes existing docks and boatflet ski lifts. This was permitted by CAMA Major 50-85, issued on 4/27/1985. CAMA Major Permit #113-17 allowed Mr. Black to install rock protection around his existing basin wall and gabion rock jetties. This was completed in early 2018. Maintenance excavation of the existing basin to a depth of -5.0 ft (NWL) has been permitted under CAMA GP #67345, issued on 1/17/2017. The primary purpose of this Major Modification is to create a navigable channel from Mr. Black's existing basin to a naturally occurring depth of -8.0 ft (NWL). As discussed during our interagency scoping meeting on March 20, 2018, -8.0 ft will be needed due to the relatively normal wind tide swing of 2 ft and the fact that 6 ft of water is needed for the passage of the primary vessel to utilize this basin. In March 2018, we completed an updated water depth survey that is consistent with the survey that we performed approximately one year earlier in relation to CAMA Major #113-17. That data is depicted on the attached exhibit along with the proposed channel dimensions (50' x 979'). Proposed Work The current average depth along the channel is -5.25 ft, but there are some areas that are slightly deeper. An average of 2.75 ft of material will need to be excavated to reach the desired depth. Mechanical dredging is proposed by using a long reach excavator and barge. The barge will offload the dredged material directly from the barge to dump trucks at the barge landing beside the public boat ramp, located approximately 0.3 miles from the Project Site. This is the same process that has occurred in the past during basin maintenance dredge procedures. All material will be directly hauled to a property owned by Mr. Black approximately 0.5 miles from the Project Site and 0.2 miles from the offloading area. The dredged material will be placed and stockpiled with in a designated 200 ft x 200 ft stockpile area to be lined with silt fence. If there becomes a time when the applicant wishes to grade this dredged material into a larger area on his property (an area exceeding 1 acre), a State Soil Erosion and Sedimentation Control Permit will be obtained. Upon completion of the dredging, six (6) channel markers are proposed to be installed (3 red and 3 green) in the locations shown on the plan. These markers will consist of timber pilings with red and green signage. The pilings will have Avlite® (AV-70) solar lights fixed to the top. Installation of the channel markers will be coordinated with US Coast Guard as we done in the past for other nearby projects in Albemarle Sound. The SAV encountered in 2017 was limited to areas that were between 2 and 4 ft deep. In 2017, some SAV sample stations were done at the mouth of the basin where water was greater than 4 ft deep, and no SAV was CAMA Major Permit Narrative Bill Black Property 132 Country Club Rd. Edenton, Chowan County, NC encountered there. That SAV survey was done primarily for the permitted rock placement areas and did not extend through the currently proposed dredge area. Therefore, the 2017 survey was performed in water shallower than the proposed dredge area for the most part. As discussed during the March 20, 2018 interagency scoping meeting, the applicant was requested to have an updated SAV survey conducted in the proposed dredge area and that the CAMA Major Application be submitted after that was complete. As instructed by resource agencies, the survey should not be conducted until May, in order to enter the peak growing season for SAV. The survey work was conducted on May 15, 2018 by Brian Rubino and Troy Murphy from Quible. Prior to sampling, the proposed channel was marked using pvc poles for understanding the geometry and overall footprint of the proposed dredge area. Initially, the entire channel and immediately adjacent areas were reviewed in a cursory fashion by diving and visual observation with snorkel and mask. Then, quantitative sampling was conducted, using forty-five random sampling stations using a 1 m x 1 m pvc quadrat. At each sampling station, the area inside the quadrat was evaluated by diving and visual observation. At each station, water depths, substrate types, and SAV identification was performed. This included shallow digging by hand to attempt to feel for the presence of roots or rhizomes. Duplicate samples were taken at each station to better understand the overall mean cover of SAV. Where any live SAV was encountered, coverage estimates were made based on percent cover standards. In addition, species composition was recorded. Please refer to the accompanying Table 1 and associated SAV Sampling Exhibit. Only minor occurrences of SAV were encountered at the sampling stations. In only eight of the 90 dives was any SAV encountered. When rooted SAV was observed, it was only a single sprig of either Vallisneda Americana or Najas guadalupensis in 7 of the 8 occurrences of SAV. For these dives, the cover with in the meter x meter quadrat was approximately 1 %. In only one location was SAV cover greater than 1 %, and it was only approximately 5%. It is understood that brackish water SAV habits and growth patterns vary from year to year due to many natural and anthropogenic factors, but it has been uncommon to find a significant SAV resource in water greater than 5 ft deep in this region. These findings were reviewed in the field with Shane Staples on May 22, 2018. There is well documented SAV in Albemarle Sound in shallow water, including nearby locations. This particular area is naturally one of the deepest water areas along the northern Sound shoreline. The nearby barge landing (the proposed offloading location) is only 0.3 miles from the Site. This landing was originally chosen by the US Navy as a barge port and later used by timber, steel and other corporations for the same reason. Further to the east (towards the NC 37 bridge and all the way down towards Yeopim Point) from this area, the nearshore shelf is significantly shallower, which is better known SAV habitat. There are some other shallow SAV areas to the west and north into Edenton Bay, however bottom types tend to vary and sometimes allow invasive species to persist there. Received MAY 20 20iv DMEC 2 Field Investigation Report: William Black, Jr Page 2 Proiect Settin The site of the proposed development is located at 132 and 136 Country Club Drive (SR # 1129) within the Yeopim Township of Edenton, Chowan County. The property is a 2-acre residential site with a single-family residence and associated infrastructure, pier, bulkheading, boat basin with docks, lifts, sheet piling walls, riprap, and gabion basket jetties. Vegetation on the two lots is landscaped with indigenous yard grasses, shrubs and flowers. The elevation of the property is approximately 6 feet above normal water level (NWL). The property has approximately 420 linear feet (Ift) of shoreline adjacent the Albemarle Sound. Of that total, approximately 150 Ift of the shoreline in front of the residence consists of a sandy beach area. The remaining shoreline is stabilized by a combination of rock/gabion jetties, bulkheading, and sheet piling walls. Previous CAMA permits issued for this location are noted as follows: Major Permit #50-85 was issued on 04/27/1985 and expired on 12/31/1989. Projects authorized through #50-85 included bulkheading, excavation of the channel and basin, breakwaters, boat dock, boathouse, rock jetty, and gabion jetties. General Permit #67345A was issued on 01/17/2017 for maintenance excavation of the existing channel and basin area to a depth of -5' (NWL), and expired 05/17/2017. Major Permit #113-17 was issued to Mr. Black on 09/28/2017 for the installation of rock around the previously permitted basin wall and gabion rock jetties. The adjacent riparian property to the north is a private residence with a pier, boathouse, riprap and bulkheading. The adjacent riparian property to the south is a private residence with a sandy beach shoreline. Lyn Hardison, Environmental Assistance Coordinator, presided over an interagency scoping meeting at the Washington Regional Office on 03/20/2018. Representatives from the NC Division of Coastal Management (DCM), Wildlife Resources Commission (WRC), U.S. Army Corps of Engineers, NCDCM Fisheries, National Marine Fisheries, and US Fish and Wildlife Services (USF&WS) were in attendance, as well as Brian Rubino of Quible and Associates and the owner, William Black. Mr. Rubino reported that Mr. Black's boat draws 5-1/2' of water, and that the current depths coming out of the basin averaged -5' to-5-1/2', with a 2' wind tide fluctuation in that area. The preliminary proposal included dredging a channel up to 979 Ift in front of Mr. Black's boat basin to a depth of -8'. This was to be done by mechanical dredge - long reach from a barge, and the dredge spoils would be offloaded at an adjacent barge terminal and transported to a future spoil site. Mr. Black also proposed to maintenance dredge his boat basin. An SAV survey conducted in June 2017 confirmed the presence of submerged aquatic vegetation (SAV) in 3' to 3-1/2' of water. Representatives of the review agencies recommended that a new SAV survey be conducted in 2018 in the area of the proposed channel prior to the submittal of a major modification request. It was reported that only minor occurrences of SAV were found at the sampling stations during 8 of 90 dives, and the species that were noted were Najas guadalupensis (Southern naiads) and Vallisneria Americana (wild celery). For these dives, the cover in the quadrat was approximately 1%. Station #1035 was the only location where SAV coverage was noted at approximately 5%, and consisted of Najas guadalupensis. Shane Staples, NCDCM Fisheries, reviewed these findings in the field on May 22, 2018. A copy of the SAV Survey is included in the Narrative. The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish taking. The bottom consists of clay and sand. The current average depth of the boat basin is noted as -6', and -5.25' along the proposed channel area. Development Proposal Mechanic dredging is proposed by the applicant using a long reach excavator and barge. • The total square footage of excavation for the basin and access channel is approximately 61,248 sf. • An average of 2.75' of material will be excavated from the area of the access channel to reach a depth of -8'. • An average of 2' of material will excavated from the existing boat basin to reach a depth of -8'. • The total amount of material to be excavated from below NWL is 4,689 cubic yards. Dredge spoils will be offloaded from the barge onto dump trucks at the barge landing site, which is located beside the WRC public boat ramp. The dredge material will be transported to property owned by Mr. Black/TIMMCO Inc., approximately 0.2 miles from the offloading area. ■ The proposed spoil disposal area is approximately 42,596 sf. • Material will be stockpiled in a 200'x200' area, to be lined with silt fencing. ■ The disposal area is outside of the CAMA AECs. Once dredging is complete, 6 channel markers will be installed along the proposed channel. The markers will be made of timber pilings with red and green signage, and the pilings will have solar lights fixed to the top of each. Anticipated Impacts The proposed dredging will result in the disturbance of 61,248 sf of shallow water bottom in the Estuarine Waters, Public Trust Area AECs. The 6 channel markers will result in a minimal amount of shallow water bottom disturbance. The dredge spoil site at TIMMCO's will cover 40,000 sf; however, since the disposal area is within an upland area outside of the CAMA Estuarine Shoreline AEC, there will be no habitat impact(s). An initial screening of the submittal package has been conducted as per 15A,NCAC 07J.0203 and 07J.0204 (copies enclosed). This revealed certain deficiencies, which must be corrected before the application package can be accepted as complete. To assist you in expediting the permitting process as much as possible, I am notifying you of these deficiencies immediately so that they can be quickly corrected to facilitate my detailed review. Because the deficiencies are easily correctable, I am not returning the original application package. Please make the needed changes, and submit the appropriate documentation. With the retained copy of the application, I can commence the detailed review. Please understand that the subsequent detailed review may reveal additional areas where further information or documentation is required to demonstrate compliance with the rules directly applicable to the proposed development.
