DAVIS Director Mr. William Black, Jr. 132 Country Club Drive Edenton, NC 27932 Dear Mr. Black: NORTH Q� MRatitd ty LETTER OF REFINEMENT Permit #113-17 September 4, 2018 This letter is in response to correspondence dated August 24, 2018, received from Brian Rubino of Quible & Associates, in which it was requested that Major Permit #113-17 be modified to change the location of the spoil offloading and stockpile area for your dredging project. • Major Permit #113-17 was issued to you on September 28, 2017 for modification(s) to the jetties and sheetpile wall. • A Letter of Refinement was issued for this permit on December 5, 2017, to modify the footprint of the rock revetment for the basin entrance. • On August 6, 2018, a Major Modification to #113-17 was issued for the dredging of the existing boat basin and new access channel, a maintenance dredging clause, navigational aids/channel markers, and a spoil disposal site off of Midway Drive. • The project is located along the Albemarle Sound, adjacent 132 and 136 Country Club Drive in Edenton, Chowan County. Your modification request as described and/or depicted in your submittal dated August 24, 2018 included a new spoil disposal site located at the Waff Contracting barge landing adjacent to Wharf Landing Drive. Yvonne Carver, Field Representative for the Division, conducted a site visit on August 27, 2018 to inspect the new disposal site. While onsite, Ms. Carver met with Al Waff and Barry White, who clarified that the stockpile area initially selected needed to be changed. Two altemative sites were noted for consideration, and Quible & Associates submitted a new plat dated 08/29/18 depicting the final location for the Dredge Transfer Area and Stockpile/Disposal Area. The new location of the Transfer and Stockpile Area, as noted on the plat dated 08/29/18 and received on 08/31/18, is hereby authorized as a refinement to CAMA Major permit #113-17, with the following noted: • A silt fence will be installed between the disposal area and the adjacent woodlands. • No excavated or fill material will be placed at anytime in any vegetated wetlands or surrounding waters. • All existing conditions remain in effect, including the expiration date of December 31, 2021. Griffin Street, Suite 300 Elizabeth City, NC 27909 RE: CAMA Major Permit # 113-17 Bill Black Dredge Project Edenton, Chowan County, NC Mrs. Carver: The purpose of this letter is to request a Modification to CAMA Major 113-17 to change the location of the spoil offloading and stockpile area. Mr. Black has engaged Waff Contracting, Inc. to perform the mechanical dredging work in the same manner as permitted (using a long reach excavator and barge). However, instead off offloading the material at the barge landing near the WRC boat ramp, this material is now proposed to be off loaded and stockpiled at the Waff Contracting barge landing and industrial site adjacent to the US 17 bridge over the Chowan River. Once the material is dried out, this will serve as surplus fill for Waff Contracting industrial facilities and will not be taken to any third parry, nor will it be sold. No material will be placed in jurisdictional waters or wetland areas. Please review this material at your earliest convenience. If a Minor Modification is required, Mr. Black will send you the $100 processing fee check right away. Property As authorized representative of Chowan County PIN# 688400558172 owned by Waff Contracting, Inc., I authorize placement of the dredge material on our property. This is an industrial waterfront site that is used for our construction operations, including loading and offloading of barges and materials. As the contracted dredger for this project, this is the ideal location for offloading and stockpiling of the material.
