drawings (4) 1 of 4 dated revised 10/13/16 and 2-4 of 4 dated received at DCM Morehead City 10/14/16.
This permit, issued on January 30, 2017 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Upland Development
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the addition of
a cul-de-sac and seven (7) lots and removal of a wastewater treatment plant at Barbour's Landing
Subdivision, and other land disturbing activities associated with the development of the above
referenced property, all as expressly and specifically set forth in the attached permit application and
workplan drawings. Any additional land disturbing activities and/or construction may require a
modification of this permit. Contact a Division of Coastal Management representative at (252) 808-
2808.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2020
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

A-DDITIONAL CONDITIONS" -
The total built upon area of the property within 575 feet of the normal high water line shall not exceed
25 percent.
In accordance with commitments made by the permittee in the attached application, The West Bay
Treatment Plant system shall be removed.
Stormwater Management
4) ; The Division Energy, Mineral and Land Resources approval of this project under stormwater
management rules of the Environmental Management Commission is covered by way of Stormwater
Permit No. SW8 060726, which was issued on 11/9/2016. Any violation of the permit approved by the

DEMLR shall be considered a violation of this CAMA permit.
NO The construction and/or operation of the authorized subdivision addition shall not directly result
in any closure of any waters that are open to the taking of shellfish. Any such closure directly
{. attributable to the subdivision addition shall require that the permittee undertake remedial actions
to remedy the situation. Such actions may include, but are not limited to, mitigative measures to
reduce or eliminate the cause(s) of the closure.
Sedimentation and Erosion Control
NOTE: An Erosion and Sedimentation Control Plan will be required for this project. This plan must be
filed at least thirty (30) days prior to the beginning of any land disturbing activity. Submit this
plan to the Department of Energy, Mineral, and Land Resources, Land Quality Section, 127
Cardinal Drive Extension, Wilmington, NC 28405.
5) , In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
6) . A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes.
Public Water Supply
NOTE: Approval from Public Water Supply section will be required for this project. Submit this plan to
Division of Water Resources, Public Water Supply, 127 Cardinal Drive Extension, Wilmington,
NC 28405.

ADDITIONAL CONDITIONS ---
No new excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
)TE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required, including a driveway connection permit from
NCDOT if required.
)TE: The N.C. Division of Water Resources has assigned the project DWR Project No. 2016-1037.
The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. SAW
2003-00758.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water

Drive on the southeast side of the cut de sac will convey runoff to 404 wetlands.

Cape Point Village, originally permitted in 2006 as Barbour's Landing (SW8 060726, Major
CAMA #10-07), a low density subdivision, and then Cape Point RV Park in 2009. Upon the initial
permit approval, the roads and utilities were constructed per the plans. The property is located
off Island Road in Harkers Island, Carteret County. This site drains to the south into Back Sound,
which is classified as SA-ORW waters. The project is being resubmitted for permit modifications
to Stormwater, Erosion Control and Major CAMA, converting the RV Park development back to
the original low density residential subdivision. The modification proposes additional sever lots,
however maintaining the permitted built upon area of 144,000 square feet. A name/ownership
change was issued May 24, 2016 to Academy Field, LLC for the Stormwater permit.
An additional cul-de-sac and seven lots are proposed within this modification. The land
being occupied by the wastewater treatment plant and disposal is proposed to be removed
upon approval to tie in to the West Bay Treatment Plant system. The wastewater is to be
accepted by Harkers Island Sewer Company, which owns and operates an existing forcc{riai
within the right of way of Island Drive. A forcemain will be constructed within the sub RiLE IV E D
from the existing lift station, conveying the sewer to this forcemain. OCT 0 7 2016
IV. Erosion and Sedimentation Control Measures ��(D CITY
The original single family subdivision was permitted in 2007 to Barbour's
(Carte-2007-017). Following issuance of the permit the developer installed utilities,
constructed and paved the road, The majority of the land disturbance will occur once the
existing drip irrigation and waste treatment facility is removed. This area encompasses
approximately 2.5 acres; however, this will not be a mass grading operation. The drip lines are
approximately three feet on center and are less than six inches below the surface creating very
little disturbance during removal. Of this 2.5 acres, approximately three -tenths will be cut and
graded to construct the proposed cul-de-sac with roadside ditches. The remaining disturbed
acreage included encompasses the total high ground of the proposed single family lots. There
is expected to be no more than three to four houses being constructed at any given time. This
potential number of lots disturbed would equate to less than an acre disturbed at once and
most likely the entire lot would not be disturbed. Only those portions to construct the house
and driveway.
The following measures are proposed for the site. If it becomes evident that additional
erosion and sedimentation control measures are needed, they shall be installed immediately. It
is intended that all grading and excavation activities within a certain area will be protected as
soon as that activity is complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as
shown on plans or as deemed necessary by the engineer to insure off -site
sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following
construction in accordance with the seeding schedule shown on the plans.
3. Paved Construction Entrance — The existing paved road will serve as the only
construction entrance and will be used to reduce transport of sediment off site.
4. Stone Construction Entrance — Stone construction entrance will be used to
reduce transport of sediment off site. Proposed off Island Road at the entrance
to the new cul-de-sac.
V. Maintenance Plan
1. All erosion and sediment control measures shall be checked for stability and
effective operations following every runoff producing rainfall event or at least
once per week. Repairs required shall be completed immediately to the
dimension and functions indicated on the plans.
2. Sediment shall be removed from behind the sediment fencing when it becomes
0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary
to maintain a barrier.
3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days
of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as
necessary according to the Contract documents to establish and maintain a
dense vegetative cover.
VI. Construction Sequence for New Cul-de-sac
1. Install gravel construction entrance and silt fencing.
2. Install silt fencing as shown on plans, within areas of construction.
3. Rough grade street and road side ditches.
4. Install water and sewer mains.
5. Fine grade street and ditches.
6. Seed and mulch all areas of disturbance not to be paved within 7 days of land
disturbance.
7. Pave street.

113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
(919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.

Consistency Determination: The request is consistent with/not in conflict with the Carteret County Land
Use Plan certified by the CRC on December 20, 2010 provided that the project meets the "Limited
Transition" land use residential density requirements and satisfies all local, state, and federal standards.
Overview: The applicant is requesting the addition of a cul-de-sac and 7 lots to a previously permitted
25 lot subdivision adjacent to Back Sound at 1200 Island Rd., Harkers Island, Carteret County, North
Carolina. The project site is 13.47 acres or 586,753.2 ft2. The property is located in the following Special
Flood Hazard Areas (SFHA): VE EL8, AE EL7, and AE EL8. Existing site improvements include: roads, two
community piers, and a wastewater treatment plant. The applicant is proposing to remove the existing
wastewater treatment plant, and connect the entire 32 lot subdivision to the Harkers Island Sewer
Company.
Back Sound is classified as SA (Market Shellfishing, Salt Water) and ORW (Outstanding Resource Water),
is not a Primary Nursery Area (PNA), and is open to the harvesting of shellfish. The site presently contains
Submerged Aquatic Vegetation (SAV), and the bottom substrate consists of fine sane with some silt. A
review of wetlands (404 and coastal) and archaeological resources was not provided.
Anticipated impacts resulting from this project are expected to include: the disturbance of 9.6 acres of
high ground. The applicant has proposed silt fencing to protect Back Sound and associated wetlands from
run off during construction.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use Plan
Update. The Future Land Use Map (FLUM) designates the site as Limited Transition and Conservation
due to the sites location in Estuarine Shoreline AECs (Areas of Environmental Concern).

Land uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use
standards and state and federal regulations.
The Land Use Plan defines use and density requirements for "Limited Transition" areas, as follows:
`The limited transition classification is intended for predominantly residential use, with minimum lot size
based upon the availability of water and sewer services. However, some commercial, institutional, health
care, and industrial development occurs in these areas, with the majority located along the major
highways" (pg.90).
"Residential densities at an average of three units per acre or less are acceptable. For those areas with
water and sewer service, lot sizes may be as small as 10,000 square feet (4.4 units per acre) but must
average three dwelling units per acre or less. When only central water service is available, single-family
residential lots may not be smaller than 15,000 square feet or 2.9 units per acre. For PUD developments,
residential densities are no greater than 2.9 units per net acre" (pg. 90).
This classification accommodates increasing development in the following areas:
• north of the Town of Beaufort along the N.C. 101 and U.S. 70 corridors
• NC 24 corridor from Morehead City to Cape Carteret, including the Town of Bogue
• NC 58 corridor north of Cape Carteret, including the Town of Peletier
• Harkers Island
At this time, it is unknown if the project meets the "Limited Transition" land use requirements as the
allowable densities vary based on the developments utilization of water and sewer services.
The following LUP policies may be applicable to this request:
Policy 2.2, pg. 71:
Carteret County's policies for development in coastal shoreline areas are as follow:
1. Residential and commercial development meeting the state's minimum use standards shall be
allowed in coastal shorelines and ORW estuarine shoreline classified lands. Construction will be in
accordance with all Carteret County ordinances. Allowed densities are set forth in future land use
map category descriptions beginning on Page 94 of the land use plan.
2. Carteret County will allow all uses (such as residential, commercial, industrial, and institutional) in
estuarine shoreline and ORW estuarine shoreline areas, provided all local, state, and federal
standards are satisfied.
3. For all waterfront developments, parking lots that meet local, state, and federal requirements will
be allowed.

1. "Major development of an urban nature should be concentrated in the developed and limited
transition areas. Major development is considered to be development that utilizes urban services,
particularly water and sewer".
2. "In areas classified as developed and limited transition and not served by public or community
sewer and water service, a minimum lot size of 20,000 square feet (2.2 units per acre) shall be
required through existing zoning, subdivision, and other regulatory ordinances. In areas classified as
developed and limited transition and served by community water service, but having no public or
community sewer service, minimum lot size is 15,000 square feet (2.9 units per acre)".
"Note: Carteret County ordinances consider package treatment plants to be public or community
sewer service." .
Policy4.1, pg.78:
"All development within the flood hazard areas and ocean hazard area AECs will be coordinated with
the County Department of Planning and Development, North Carolina Division of Coastal
Management, Federal Emergency Management Agency (FEMA), and the U.S. Army Corps of
Engineers. The County will implement the following measures to mitigate risks":
... 3. "The County allows development and redevelopment within the 100 year floodploin subject to
the provisions and requirements of the National Flood Insurance Program, CAMA, the County's Flood

Dear Mr. Brady:
The Wilmington Regional Office received a complete, modified Stormwater Management Permit
Application for Cape Point Village on November 2, 2016. Staff review of the plans and specifications
has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in
Title 15A NCAC 2H.1000. We are forwarding modified Permit No. SW8 060726, dated November 9,
2016, for the construction of the built -upon area associated with the subject project.
This permit shall be effective from the date of issuance until rescinded and shall be subject to the
conditions and limitations as specified therein, and does not supersede any other agency permit that may
be required. Please pay special attention to the conditions listed in this permit regarding the Operation
and Maintenance of the BMP(s), recordation of deed restrictions, certification of the project, procedures
for changing ownership, and transferring the permit. Failure to establish an adequate system for operation
and maintenance of the stormwater management system, to record deed restrictions, to certify the project
or to transfer the permit in a timely manner, will result in future compliance problems.
The following modifications are included and covered by this permit:
1. Reverting the project to a residential subdivision.
2. The addition of a cul-de-sac and seven (7) lots where the wastewater treatment plant and disposal
area was originally proposed. The subdivision will instead tie into an existing wastewater system.
3. The reallocation of built -upon area to account for the additional cul-de-sac and seven (7) lots.
If any parts, requirements, or limitations contained in this permit are unacceptable, you have the right to
request an adjudicatory hearing by filing a written petition with the Office of Administrative Hearings
(OAH). The written petition must conform to Chapter 150B of the North Carolina General Statutes. Per
NCGS 143-215(e) the petition must be filed with the OAH within thirty (30) days of receipt of this
permit. You should contact the OAR with all questions regarding the filing fee (if a filing fee is required)

FOR THE
construction, operation and maintenance of a 25% low density subdivision project in compliance with
the provisions of Title 15A NCAC 2H .1000 (hereafter referred to as the "stormwater rules') and the
approved stormwater management plans and specifications, and other supporting data as attached
and on file with and approved by the Division of Energy, Mineral and Land Resources (hereafter
referred to as the Division or DEMLR) and considered a part of this permit.
The Permit shall be effective from the date of issuance until rescinded and shall be subject to the
following specific conditions and limitations:
I. DESIGN STANDARDS
1. The overall tract built -upon area percentage for the project must be maintained at 25% per the
requirements of the stormwater rules. This permit covers the construction of a total of 144,000
square feet of proposed built -upon area (BUA).
2. Each of the 32 lots is limited to a maximum amount of built -upon area as indicated in Section
11.11 (f) and Attachment A of this permit. CAMA regulations may reduce the allowable built -
upon area for those lots within the AEC.
3. The only runoff conveyance systems allowed will be vegetated conveyances such as swales
with minimum side slopes of 3:1 (H:V) as defined in the stormwater rules and approved by the
Division.
4. No piping shall be allowed except those minimum amounts necessary to direct runoff beneath
an impervious surface such as a road or under driveways to provide access.
5. The project shall provide and maintain a minimum 30-foot wide vegetative buffer adjacent all
surface waters, measured horizontally from and perpendicular to the normal pool of
impounded structures, the top of bank of each side of streams and rivers and the mean high
water line of tidal waters. All runoff directed into and through the vegetative buffer must flow
through the buffer in a diffuse manner. Roof drains must terminate at the outer edge of the
buffer.

II. SCHEDULE OF COMPLIANCE
1. No person shall alter the approved stormwater management system or fill in, alter, or pipe any
drainage feature (such as swales) shown on the approved plans as part of the stormwater
management system, except for minimum driveway crossings, unless and until the permittee
submits a modification to the permit and receives approval from the Division.
2. The maximum built -upon area assigned to each lot via this permit and the recorded deed
restrictions may not be increased or decreased by either the individual lot owner or the
permittee unless and until the permittee notifies the Division and obtains written approval from
the Division.
3. The permittee shall review each lot for new construction and all subsequent modifications and
additions, for compliance with the requirements of the permit. The plans reviewed must include
all proposed built -upon area, grading, and driveway pipe placement. The permittee may
establish an Architectural Review Board (ARB) or Committee (ARC) to review new and
modified lot development plans for compliance with the Covenants and Restrictions, including
the BUA limit. However, any approval given by the ARB or ARC on behalf of the permittee
does not relieve the permittee of the responsibility to maintain compliance with the overall
permitted built -upon area for the project.
4. The permittee is responsible for verifying that the proposed built -upon area on each individual
lot, and for the entire project, does not exceed the maximum allowed by this permit. The
permittee shall routinely monitor the lots and where a lot is determined to have exceeded the
permitted maximum BUA, the permittee shall notify the lot owner of such in writing and shall
require remediation within a reasonable time frame to bring the lot into compliance.
5. Swales, vegetated areas and other vegetated conveyances shall be constructed in their
entirety, vegetated, and operational for their intended use prior to the construction of any built -
upon surface, per the approved plans.
6. During construction, erosion shall be kept to a minimum and any eroded areas of the swales
or other vegetated conveyances will be repaired immediately.
7. The permittee shall at all times provide and perform the operation and maintenance necessary
as listed in the signed Operation and Maintenance Agreement, such that the permitted
stormwater management system functions at its optimum efficiency.
8. Deed restrictions are incorporated into this permit by reference and must be recorded with the
Office of the Register of Deeds prior to the sale of any lot. Recorded deed restrictions must
include, at a minimum, the following statements related to stormwater management:
a. The following covenants are intended to ensure ongoing compliance with State
Stormwater Management Permit Number 060726, as issued by the Division of Energy,
Mineral and Land Resources under NCAC 2H.1000.
b. The State of North Carolina is made a beneficiary of these covenants to the extent
necessary to maintain compliance with the Stormwater Management Permit.
c. These covenants are to run with the land and be binding on all persons and parties
claiming under them.
d. The covenants pertaining to stormwater may not be altered or rescinded without the
express written consent of the Division.
e. Alteration of the drainage as shown on the approved plans may not take place without the
concurrence of the Division.
f. The maximum built -upon area per lot is as outlined in Attachment A. This allotted amount
includes any built -upon area constructed within the lot property boundaries, and that
portion of the right-of-way between the front lot line and the edge of the pavement. Built
upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone,
slate, coquina, driveways, and parking areas, but does not include raised, open wood
decking, or the water surface of swimming pools.
g. Filling in, piping or altering any 3:1 vegetated conveyances (ditches, swales, etc.)
associated with the development except for average driveway crossings, is prohibited by
any persons.
h. For those lots within the CAMA Area of Environmental Concern, DCM may require the
roof overhangs to be counted as built -upon area, or where DCM calculates a different

maximum lot built -upon area, the governing maximum lot BUA shall be the more
restrictive of the two amounts.
i. A 30-foot wide buffer must be provided adjacent to surface waters, measured horizontally
from and perpendicular to the normal pool of impounded structures, the top of bank of
both sides of streams and rivers, and the mean high waterline of tidal waters.
j. All roof drains shall terminate at least 30 ft from the normal pool of impounded structures,
the banks of rivers and streams and the Mean High Waterline of tidal waters.
k. Any individual or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
procedures as set forth in N.C.G.S. 143, Article 21.
9. The permittee must submit a copy of the recorded deed restrictions within 30 days of the date
of recording.

10. The permittee shall submit to the Director and shall have received approval for revise ns,
specifications, and calculations prior to construction, for any modification to the appfqued6 2016

a. Any revision to the approved plans, regardless of size. DCM- MHD CITY
b. Redesign or addition to the approved amount of built -upon area.
c. Further subdivision, acquisition or sale of the project area in whole or in part. The project
area is defined as all property owned by the permittee, for which Sedimentation and
Erosion Control Plan approval or a CAMA Major permit was sought.
d. Filling in, piping, altering, modifying, removing, relocating, or redirecting any runoff
conveyance shown on the approved plan, except for a minimum driveway crossing.
e. The construction of any future BUA noted on the application.
f. The construction of permeable pavement for BUA credit.
11. All stormwater conveyances will be located in either public rights -of -way, dedicated common
areas or drainage easements. The final plats for the project will be recorded showing all such
required rights -of -way, common areas and easements, in accordance with the approved plans.
12. The permittee must certify in writing that the project's stormwater controls, and impervious
surfaces have been constructed within substantial intent of the approved plans and
specifications. Any deviation from the approved plans must be noted on the Certification. The
permittee shall submit the Certification to the Division within 30 days of completion of the
project.
13. The permittee shall submit all information requested by the Director or his representative
within the time frame specified in the written information request.
14. The Director may notify the permittee when the permitted site does not meet one or more of
the minimum requirements of the permit. Within the time frame specified in the notice, the
permittee shall submit a written time schedule to the Director for modifying the site to meet
minimum requirements. The permittee shall provide copies of revised plans and certification in
writing to the Director that the changes have been made.
III. GENERAL CONDITIONS
This permit is not transferable to any person or entity except after notice to and approval by
the Director. The permittee shall submit a completed and signed Name/Ownership Change
Form, accompanied by the supporting documentation as listed on the form, to the Division of
Energy, Mineral and Land Resources at least 60 days prior to any one or more of the following
events:
a. Any ownership change including
i. The assignment of declarant rights to another individual or entity,
ii. The sale or conveyance of the project area in whole or in part, except in the
case of an individual lot sale that is made subject to the recorded deed
restrictions;
iii. The sale or conveyance of the common areas to a Homeowner's or Property
Owner's Association, subject to the requirements of Session Law 2011-256;
iv. Dissolution of the partnership or corporate entity, subject to NCGS 57D-2-01(e)
and NCGS 57D-6-07;

b. Bankruptcy;
c. Foreclosure, subject to the requirements of Session Law 2013-121;
d. A name change of the current permittee;
e. A name change of the project;
f. A mailing address change of the permittee;
2. The Permittee is responsible for compliance with all the terms and conditions of this permit
until such time as the Division approves the permit transfer in writing. Neither the sale of the
project area, in whole or in part, nor the conveyance of common area to a third party
constitutes an approved transfer of the stormwater permit.
3. The permit issued shall continue in force and effect until revoked or terminated.
4. The permit may be modified, revoked and reissued or terminated for cause. The filing of a
request for a permit modification, revocation and re -issuance, or termination does not stay any
permit condition.
5. The issuance of this permit does not prohibit the Director from reopening and modifying the
permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the
laws, rules, and regulations contained in Title 15A of the North Carolina Administrative Code,
Subchapter 2H.1000; and North Carolina General Statute 143-215.1 et. al.
6. The issuance of this permit does not preclude the Permittee from complying with and obtaining
any and all other permits or approvals that are required in order for this development to take
place, as required by any statutes, rules, regulations, or ordinances, which may be imposed by
any other Local, State or Federal government agency having jurisdiction. Any activities
undertaken at this site that cause a water quality violation or undertaken prior to receipt of the
necessary permits or approvals to do so are considered violations of NCGS 143-215.1, and
subject to enforcement procedures pursuant to NCGS 143-215.6.
Any person or entity found to be in noncompliance with the provisions of a stormwater
management permit or the requirements of the stormwater rules is subject to enforcement
procedures as set forth in N.C.G.S. 143, Article 21.
Approved plans, application, supplements, operation & maintenance agreements and
specifications for projects covered by this permit are incorporated by reference and are
enforceable parts of the permit. A copy of this permit, application, supplements, the operation
and maintenance agreements, and the approved plans and specifications shall be maintained
on file by the Permittee at all times.
9. The Permittee grants permission to DEMLR Staff to enter the property during normal business
hours for the purposes of inspecting the stormwater control system and its components.
10. Unless specified elsewhere, permanent seeding requirements for the swales must follow the
guidelines established in the North Carolina Erosion and Sediment Control Planning and
Design Manual.

9. NARRATIVE DESCRIPTION: The Academy Field LLC project is located at 1200
Island Rd. on Harkers Island. The property is situated adjacent to Back Sound which is
SA-ORW. Existing on the property is a 25 lot residential subdivision previously permitted
under CAMA Major Permit 10-07. The permit was refined to allow for the operation of a
camp ground on the property but was never implemented. The original roads and
wastewater treatment plant are still onsite. There are also two community piers onsite that
were authorized under a modification to 10-07. Back sound is not a PNA. There are
SAVs in this area and the bottom substrate consists of fine sand with some silt. This area
is classified as SA-ORW and is open to the harvesting of shellfish. It is not a Primary
Nursery Area.
10. PROJECT DESCRIPTION: The applicant is proposing to remove the existing WWTP
and create 7 additional lots in this area. Access to these lots would be provided by a new
cul-de-sac extending off of Island Rd. (SR 1335). Proposed BUA is listed for each lot on
sheet 2 of the plats. The entire 32 lot subdivision would be connected to Harkers Island
Sewer Company for sewage disposal. No other modifications to the previously permitted
subdivision is proposed at this time.
11. ANTICIPATED IMPACTS: This new section of Cape Point Village would disturb a total
of 9.6 ac. The applicant has proposed appropriate silt fence to protect Back Sound and
associated wetlands from run off during construction.

I. General Information
RECEIVED
Cape Point Village, originally permitted in 2006 as Barbour's Landing (SW8 060726, Major
CAMA #10-07), a low density subdivision, and then Cape Point RV Park in 2009. Upon the initial
permit approval, the roads and utilities were constructed per the plans. The property is located
off Island Road in Harkers Island, Carteret County. This site drains to the south into Back Sound,
which is classified as SA-ORW waters. The project is being resubmitted for permit modifications
to Stormwater, Erosion Control and Major CAMA, converting the RV Park development back to
the original low density residential subdivision. The modification proposes additional sever lots,
however maintaining the permitted built upon area of 144,000 square feet. A name/ownership
change was issued May 24, 2016 to Academy Field, LLC for the Stormwater permit.
An additional cul-de-sac and seven lots are proposed within this modification. The land
being occupied by the wastewater treatment plant and disposal is proposed to be removed
upon approval to tie in to the West Bay Treatment Plant system. The wastewater Is to be
accepted by Harkers Island Sewer Company, which owns and operates an existing for L E IVE D
within the right of way of island Drive. A forcemain will be constructed within the sub ��pp
from the existing lift station, conveying the sewer to this forcemain. OCT 0 7 2016
IV. Erosion and Sedimentation Control Measures ®� CITY
The original single family subdivision was permitted in 2007 to Barbour's Q rQ ;
(Carte-2007-017). Following issuance of the permit the developer installed utilities,
constructed and paved the road. The majority of the land disturbance will occur once the
existing drip irrigation and waste treatment facility is removed. This area encompasses
approximately 2.5 acres; however, this will not be a mass grading operation. The drip lines are
approximately three feet on center and are less than six inches below the surface creating very
little disturbance during removal. Of this 2.5 acres, approximately three -tenths will be cut and
graded to construct the proposed cul-de-sac with roadside ditches. The remaining disturbed
acreage included encompasses the total high ground of the proposed single family lots. There
— is expected to be no more than three to four houses being constructed at any given time. This
potential number of lots disturbed would equate to less than an acre disturbed at once and
most likely the entire lot would not be disturbed. Only those portions to construct the house
and driveway.
The following measures are proposed for the site. If it becomes evident that additional
erosion and sedimentation control measures are needed, they shall be installed immediately. It
is intended that all grading and excavation activities within a certain area will be protected as
soon as that activity is complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as
shown on plans or as deemed necessary by the engineer to insure off -site
sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following
construction in accordance with the seeding schedule shown on the plans.
3. Paved Construction Entrance — The existing paved road will serve as the only
construction entrance and will be used to reduce transport of sediment off site.
4. Stone Construction Entrance — Stone construction entrance will be used to
reduce transport of sediment off site. Proposed off Island Road at the entrance
to the new cul-de-sac.
V. Maintenance Plan
1. All erosion and sediment control measures shall be checked for stability and
effective operations following every runoff producing rainfall event or at least
once per week. Repairs required shall be completed immediately to the
dimension and functions indicated on the plans.
2. Sediment shall be removed from behind the sediment fencing when it becomes
0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary
to maintain a barrier.
3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days
of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as
necessary according to the Contract documents to establish and maintain a
dense vegetative cover.
VI. Construction Sequence for New Cul-de-sac
1. Install gravel construction entrance and silt fencing.
2. Install silt fencing as shown on plans, within areas of construction.
3. Rough grade street and road side ditches.
4. Install water and sewer mains.
5. Fine grade street and ditches.
6. Seed and mulch all areas of disturbance not to be paved within 7 days of lap
disturbance.

I remember seeing this now. Yeah, so no wetland impacts associated with the roads. I can see the individual lots with
wetlands on them being a future potential issue for us. Not your problem though- We encourage developers to pull lot
lines up out of wetlands, usually in pre -application meetings where we have the chance to talk about avoidance and
minimization and any potential site constraints.

PROJECT SUMMARY: Academy Field LLC is proposing to add a cul-de-sac and 7 lots

9. NARRATIVE DESCRIPTION: The Academy Field LLC project is located at 1200
Island Rd. on Harkers Island. The property is situated adjacent to Back Sound which is
SA-ORW. Existing on the property is a 25 lot residential subdivision previously permitted
under CAMA Major Permit 10-07. The permit was refined to allow for the operation of a
camp ground on the property but was never implemented. The original roads and
wastewater treatment plant are still onsite. There are also two community piers onsite that
were authorized under a modification to 10-07. Back sound is not a PNA. There are
SAVs in this area and the bottom substrate consists of fine sand with some silt. This area
is classified as SA-ORW and is open to the harvesting of shellfish., It is not a Primary
Nursery Area.
10. PROJECT DESCRIPTION: The applicant is proposing to remove the existing WWTP
and create 7 additional lots in this area. Access to these lots would be provided by a new
cul-de-sac extending off of Island Rd. (SR 1335). Proposed BUA is listed for each lot on
sheet 2 of the plats. The entire 32 lot subdivision would be connected to Harkers Island
Sewer Company for sewage disposal. No other modifications to the previously permitted
subdivision is proposed at this time.
11. ANTICIPATED IMPACTS: This new section of Cape Point Village would disturb a total
of 9.6 ac. The applicant has proposed appropriate silt fence to protect Back Sound and
associated wetlands from run off during construction.

1. General Information
Cape Point Village, originally permitted in 2006 as Barbour's Landing (SW8 060726, Major
CAMA ##10-07), a low density subdivision, and then Cape Point RV Park in 2009. Upon the initial
permit approval, the roads and utilities were constructed per the plans, The property is located
off Island Road in Harkers Island, Carteret County. This site drains to the south into Back Sound,
which is classified as SA-ORW waters. The project is being resubmitted for permit modifications
to Stormwater, Erosion Control and Major LAMA, converting the RV Park development back to
the original low density residential subdivision, The modification proposes additional sever lots,
however maintaining the permitted built upon area of 144,000 square feet. A name/ownership
change was issued May 24, 2016 to Academy Field, LLC for the Stormwater permit.
An additional cul-de-sac and seven lots are proposed within this modification. The land
being occupied by the wastewater treatment plant and disposal is proposed to be removed
upon approval to tie in to the West Bay Treatment Plant system. The wastewater is to be
accepted by Harkers Island Sewer Company, which owns and,operates an existing for
within the right of way of Island Drive. A forcemain will be constructed within the sub iVisi rs
from the existing lift station, conveying the sewer to this forcemain. OCT 0 7 2016
IV. Erosion and Sedimentation Control Measures
The original single family subdivision was, permitted in 2007 to Barbour's ,dig; FL
D CITY
(Carte-2007-017). Following issuance of the permit the developer installed utilities,
constructed and paved the road, The majority of the land disturbance will occur once the
existing drip irrigation and waste treatment facility is removed. This area encompasses
approximately 2.5 acres; however, this will not be a mass grading operation. The drip lines are
approximately three feet on center and are less than six inches below the surface creating very
little disturbance during removal. Of this 2.5 acres, approximately three -tenths will be cut and
graded to construct the proposed cul-de-sac with roadside ditches. The remaining disturbed
acreage included encompasses the total high ground of the proposed single family lots. There
is expected to be no more than three to,four houses being constructed at any given time. This
potential number of lots disturbed would equate to less than an acre disturbed at once and
most likely the entire lot would not be disturbed. Only those portions to construct the house
and driveway.
The following measures are proposed for the site. If it becomes evident that additional
erosion and sedimentation control measures are needed, they shall be installed immediately. It
is intended that all grading and excavation activities within a certain area will be protected as
soon as that activity is complete.
1. Sediment Fence — Sediment fence will be utilized as necessary in locations as
shown on plans or as deemed necessary by the engineer to insure off -site
sedimentation is controlled.
2. Seeding — All disturbed areas will be seeded within 14 days following
construction in accordance with the seeding schedule shown on the plans.
3. Paved Construction Entrance — The existing paved road will serve as the only
construction entrance and will be used to reduce transport of sediment off site.
4. Stone Construction Entrance — Stone construction entrance will be used to
reduce transport of sediment off site. Proposed off Island Road at the entrance
to the new cul-de-sac.
V. Maintenance Plan
1. All erosion and sediment control measures shall be checked for stability and
effective operations following every runoff producing rainfall event or at least
once per week. Repairs required shall be completed immediately to the
dimension and functions indicated on the plans.
2. Sediment shall be removed from behind the sediment fencing when it becomes
0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary
to maintain a barrier.
3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days
of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as
necessary according to the Contract documents to establish and maintain a
dense vegetative cover.
VI. Construction Sequence for New Cul-de-sac
1. Install gravel construction entrance and silt fencing.
2. Install silt fencing as shown on plans, within areas of construction.
3. Rough grade street and road side ditches.
4. Install water and sewer mains.
5. Fine grade street and ditches.
6. Seed and mulch all areas of disturbance not to be paved within 7 days of land
disturbance.
7. Pave street.
8. Perform final grading, seed and mulch all— r a f t areas.
9. Remove silt fence once disturbed area is stabilized.

1. All erosion and sediment control measures shall be checked for stability and
effective operations following every runoff producing rainfall event or at least
once per week. Repairs required shall be completed immediately to the
dimension and functions indicated on the plans.
2. Sediment shall be. removed from behind the sediment fencing when it becomes .
0.5 feet deep at the fence. The fence shall be replaced or repaired as necessary
to maintain a barrier.
3. All seeded areas shall be fertilized, seeded and mulched within 14 calendar days
of disturbance. Disturbed areas shall be fertilized, reseeded and mulched as
necessary according to the Contract documents to establish and maintain'a
dense vegetative cover.
VI. Construction Sequence for New Cul-de-sac
1. Install gravel construction entrance and silt fencing.
2. Install silt fencing as shown on plans, within areas of construction.
3. Rough grade street.and road side ditches.
4. Install water and sewer mains.
5. Fine grade street and ditches.
6. Seed and mulch all areas of disturbance not to be paved within 7 days of land
disturbance.
7. Pave street.
8. Perform final grading, seed and mulch all Mahon HFVEodareas.
9. Remove silt fence once disturbed area is stabilized.

8. PROJECT SUMMARY: Academy Field LLC is proposing to add a cul-de-sac and 7 lots
to a previously permitted 25 lot subdivision. The existing wastewater treatment plant
would be abandoned and sewer lines tied into Harkers Island Sewer Company. No
additional work in Estuarine Waters is proposed.

9. NARRATIVE DESCRIPTION: The Academy Field LLC project is located at 1200
Island Rd. on Harkers Island. The property is situated adjacent to Back Sound which is
SA-ORW. Existing on the property is a 25 lot residential subdivision previously permitted
under CAMA Major Permit 10-07. The permit was refined to allow for the operation of a
camp ground on the property but was never implemented. The original roads and
wastewater treatment plant are still onsite. There are also two community piers onsite that
were authorized under a modification to 10-07. Back sound is not a PNA. There are
SAVs in this area and the bottom substrate consists of fine sand with some silt. This area
is classified as SA-ORW and is open to the harvesting of shellfish. It is not a Primary
Nursery Area.
10. PROJECT DESCRIPTION: The applicant is proposing to remove the existing WWTP
and create 7 additional lots in this area. Access to these lots would be provided by a new
cul-de-sac extending off of Island Rd. (SR 1335). Proposed BUA is listed for each lot on
sheet 2 of the plats. The entire 32 lot subdivision would be connected to Harkers Island
Sewer Company for sewage disposal. No other modifications to the previously permitted
subdivision is proposed at this time.
11. ANTICIPATED IMPACTS: This new section of Cape Point Village would disturb a total
of 9.6 ac. The applicant has proposed appropriate silt fence to protect Back Sound and
associated wetlands from run off during construction.

the above referenced project. The existing roads and a twenty-five lot development were permitted
and constructed under CAMA Major #10-07, issued in February 2007 to Barbours Landing LLC.
The development was modified to a recreational vehicle park, however maintained the existing
road and lot configurations. The property was purchased in 2015 by Academy Field, LLC and
propose to revert back to the original single family subdivision with the addition of seven lots and
cul-de-sac off Island Road. The area for the additional lots was reserved for the sewer disposal,
however plans are in process for the sewer collected to be pumped to an offsite waste treatment
facility owned by Harkers Island Sewer Company. As adjacent riparian landowners you have
thirty days upon receipt of this notice to submit comments of the proposed project to the NC
Division of Coastal Management.
