Salisbury Street, adjacent to Sunset Lagoon, located in Wrightsville Beach, New Hanover County, North Carolina. The violation involved unauthorized development within Estuarine Waters and Public Trust Area, which are areas of environmental concerns (AECs). Based upon the site visit conducted on June 29, 2006 by Robb Mairs, Field Representative for the N.C. Division of Coastal Management, the restoration requested appears to be complete to the satisfaction of the Division of Coastal Management. The Coastal Area Management Act provides that a civil assessment of up to $2,500 may be assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil penalty for all violations in order to recover some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Under the rules of the Coastal Resource Commission, a proposed civil penalty, in the amount of $350.00 is appropriate for this violation. We have received payment in the form of check #1622, dated 6/26/06. By accepting responsibility for the violation, and in order to further resolve this matter, you must: (1) sign one of the attached copies of an "Agreement to Pay Civil Assessment;" and, (2) return the signed agreement to this office in the enclosed, self-addressed envelope within ten (10) days of your receipt of this letter. Salisbury Street adjacent to Sunset Lagoon located in Wrightsville Beach, New Hanover County, North Carolina. The purpose of the visit was to investigate unauthorized development involving the replacement of a private pier and docking facility due to the damage occurred during Hurricane Ophelia. Information gathered by me for the Division of Coastal Management indicates that you have undertaken major development in violation of the Coastal Area Management Act (CAMA). No person may undertake Major Development in a designated Area of Environmental Concern (AEC) without first obtaining a permit from the North Carolina Department of Environment and Natural Resources. This requirement is imposed by North Carolina General Statute (N.C.G.S.) 11 3A-1 18. 1 have information that indicates you have undertaken or are legally responsible for the replacement of a 4' x 72' fixed pier, two floating docks measuring approximately 32' in length by 6' wide, one floating dock measuring approximately 24' in length by 6' in width, and a E-Z Jet Dock approximately 5' by 5' on the aforementioned property. Also, through conversations and a site visit with Tony Wilson, Building Inspector for the Town of Wrightsville Beach, we have determined that the completed work exceeds 50% of the structure total value of the structures and does not qualify as repair and maintenance. Mr. Leonard Hooks at 14 W. Salisbury Street has forwarded the notification form to our office, dated received on December 1, 2005, and states in the waiver section of the form that he does not wish to waive the 15 foot setback requirement. This activity took place in the Estuarine Waters and Public Trust Areas. Estuarine Waters and Public Trust Areas are designated as Areas of Environmental Concern (AEC). No permit was issued to you for work in this area. Based on these findings, I am initiating an enforcement action by issuing this Notice of Violation for violation of the Coastal Area Management Act. I request that you immediately CEASE AND DESIST any further unauthorized activities within designated Areas of Environmental Concern. An injunction or criminal penalty may also be sought to enforce any violation (N.C.G.S.113A-126). It is the policy of the Coastal Resources Commission to levy a minimum civil assessment of $200 not to exceed $2,500 against all violations. This is done to recoup some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed depends on several factors, including the nature and area of the resources that were affected and the extent of the damage to them. Based upon the North Carolina Administrative Code, Title 15A, Subchapter 07H. State Guidelines for Areas of Environmental Concern, the activity you have undertaken, replacement of a 4' x 72' fixed pier, two floating docks measuring approximately 32' in length by 6' wide, one floating dock measuring approximately 24' in length by 6' in width, and a E-Z Jet Dock approximately 3' by 5' on the aforementioned property, this activity which took place in the Estuarine Waters and Public Trust Areas, is not consistent with Section 15A NCAC 07H .0208 Use Standards. Please refer to the enclosed Restoration Agreement. If you intend to cooperate with my request, please sign one of the attached Restoration Agreements and return it to me in the enclosed, self-addressed envelope within ten (10) days of receipt of this letter. Failure to comply with this request or respond back to this office prior to the requested deadline with an acceptable schedule for compliance will be interpreted as a refusal to cooperate and will result in a Notice of Continuing Violation, as well as a court injunction being sought ordering compliance.
