Dear Mr. Myers:
This letter is in reference to the Notice of Violation dated January 12, 2005 that Mr. Mark Hardeman, Field
Representative for the Division of Coastal Management, issued to you for grading in excess of an acre for
the purpose of parking lot expansion at the NCWRC public boat ramp adjacent to the Straits and North .
River, Carteret County. The violation involved disturbance and site preparation for a sto mwater control
system that would allow for the expansion of the facility parking lot. This development took place within the
Estuarine Shoreline Area of Environmental Concern as designated by the Coastal Resources Commission.
No restoration of the site was required, although it should be noted that activity s all not continue
on this site until State Permit #47-01 is renewed, after which any activity outside. o the bounds of
that permit will require a Major Modification of the permit.
The Coastal Area Management Act provides that a civil assessment of up to $2,500 may be assessed for
any violation. It is the policy of the Coastal Resources Commission.to, assess a_civil penalty for all
violations in order to recover some of the costs of investigating violations and/or to Cori ensate the public
for any damage to its natural resources.
Under the rules of the Coastal Resource Commission, a proposed civil penalty in the amount of $1000.00 is
appropriate for this violation. You may expeditiously resolve this matter prior to the aSSE ssment of a formal
civil penalty by accepting responsibility for the violation and paying the amount proposec above. In order to
do this, you must: (1) sign one of the attached copies of an "Agreement to Pay Civil Ass ssmeri (2)
attach a check or money order for $1000.00 made payable to the North Carolina Department of
Environment and Natural Resources (NCDENR); and, (3) return the signed agreement and payment to this
office in the enclosed, self-addressed envelope within ten (10) days of your receipt of th s letter. Upon
deposit of your check in the Department's account, you will receive a Notice of Complia ce officially closing
this enforcement action.

For the following reasons, you are in violation of the above terms and conditions of your permit:
Recent development is in excess of that authorized under State Permit # 47-01. This
development involves the disturbance of an area greater than one acre in size for the
purpose of parking lot expansion.
2. Condition # 15 states that the Division of Water Quality approved this project under Permit
# SW8 001243, dated 4/6/01. Any violation of the permit approved by the DWQ will be
considered a violation of this CAMA permit.
3. State Permit # 47-01 expired on 12/31/04.
If the terms and conditions of a permit are not complied with, the permit becomes null and void
from the date of its issuance. While expired State Permit # 47-01 authorized previous
development, —no CAMA permit was issued to the NCWRC for the expansion in process.
A civil penalty of up to Twenty -Five Hundred Dollars ($2500.00) may be assessed, or an injunction
or criminal penalty may be sought against any person who violates a CAMA Major Development
permit. It is the policy of the Coastal Resources Commission to assess a minimum civil penalty of
$ 500.00 against all violations of this type. This is done to recoup some of the costs of investigating
violations and/or to compensate the public for any damage to its natural resources. Whether a
higher amount will be assessed will depend on several factors, including the nature and area of the
resources that were affected and the extent of the damage to them.
Documents dated 3/22/01 and 3/28/01 indicate that the NCWRC voluntarily reduced the size of the
parking area proposed and authorized under State Permit #47-01 in order to expedite permit
issuance by reducing stormwater impacts to those allowable under the "low density" rules. Further,
these documents indicate the intention of requesting future permit modifications to allow for the
originally desired dimensions when time allowed. No such proposal was forthcoming; therefore no
permit was issued to authorize the current activity.
Based upon review of the Coastal Area Management Act, Coastal Resource Commission's rules,
and the local jurisdiction's Land Use Plan, the activity you have undertaken appears consistent with
the guidelines for Areas of Environmental Concern. Therefore, restoration of the impacted area is
not requested at this time. However, please be advised that upon request, you must be able to
provide us proof that you have given your adjacent riparian property owners notice of this
unauthorized development and provided them the opportunity to comment to the Division of
Coastal Management. Note also that a Major Modification to State Permit #47.01 will be
required in order to proceed with any work outside of the boundaries of that permit, if such
should receive a renewal.

This letter is in response to the Coastal Area Management Act (CAA) application
request to construct a boat ramp facility at the Straits Landing locat on in Carteret
County. Processing of the permit application, which was accepted as complete by
the Division of Coastal Management's Morehead City office on Jan jary 4, 2001, is
ongoing. However, it has been determined that additional information will be
required prior to the Division taking final action on your applicatio . This item is
summarized below:
1) It is the policy of this Division that, prior to taking final action do a project of .
this nature, a stormwater management plan for the proposed development must
be approved by the Division of Water Quality. It is our understanding that this
approval has not yet been received for this project. Therefore, il is necessary that
processing of your permit application be placed in abeyance unY 1 such time as a
stormwater management plan for the proposed project is issued y the Division
of Water Quality, and a copy of the approval. supplied to this of ice.
In addition to the item listed above, the Division of Coastal Manageent has
received a set of workplan drawings depicting a revision in the desi and scale of
the proposed project. DCM will distribute the revised drawings to selected review
agencies for their information and comment. I will keep you infonr ed of any
comments received as a result of the new plans.
As required by T15A:07J.0204(d), during the pendency of any term nation of
processing, the permit processing period will not run. Upon receipt of by this office
of the requested information, the Division of Coastal Management will resume

Carteret County on North River
Dear Mr. Huggett:

Due to the extensive design required to accomplish a high density development that meet's current Stormwater
regulations for the proposed boating access area on North River in Carteret County, a less optimum low density
design is being submitted as a revision for our CAMA Major Permit. Please find enclosed five copies of the revised
plats. There are several modifications that have been made to the design plats and are noted below.
• The description of the planned development: Construction of a free boat launching fat
single lane concrete launch ramps, one floating courtesy dock, two fixed docks, a crust
parking area.
The two single lane concrete launch ramps will be 15 feet wide each.
The floatine and fixed docks extend 57 feet from MHW which is not a modificati
submitted design.
• Since the double launch lane has been modified to two single lanes with a floating
excavation below MHW has been increased to 1,276 cubic yards.
• Due to the design modification, the retaining wall within the parking area has been on
