This development took place within the Estuarine Shoreline Area of Environmental Concern as designated by the Coastal Resources Commission. No restoration of the site was required, although it should be noted that activity s all not continue on this site until State Permit #47-01 is renewed, after which any activity outside. o the bounds of that permit will require a Major Modification of the permit. The Coastal Area Management Act provides that a civil assessment of up to $2,500 may be assessed for any violation. It is the policy of the Coastal Resources Commission.to, assess a_civil penalty for all violations in order to recover some of the costs of investigating violations and/or to Cori ensate the public for any damage to its natural resources. Under the rules of the Coastal Resource Commission, a proposed civil penalty in the amount of $1000.00 is appropriate for this violation. VIOLATION OF CAMA MAJOR DEVELOPMENT PERMIT NO.47-01 CAMA VIOLATION #05-01 Dear Mr. Myers: This letter confirms that on January 6, 2005, Tere Barrett, District Manager, and I Field Representative for DCM were onsite with Mr. Tom Covington at NCWRC pin SR 1335 adjacent to the North River at the Straits, located near Harkers Island in North Carolina. The purpose of the visit was to investigate activity taking place st expiration of State Permit # 47-01. Information gathered by me for the NC Division of Coastal Management show, violated the terms or conditions of State Permit No. 47-01 which was issued to Coastal Resources Commission and the North Carolina Department of Environm Resources. I hereby request that you immediately CEASE AND DESIST suc comply with the terms and conditions of the above permit. On April 18, 2001, State Permit # 47-01 was issued to the North Carolina Commission for a boat ramp facility within the Estuarine Shoreline, Estuarine Trust Waters at the Straits on property located in Carteret County, North Ca This permit was issued for a CAMA Major Development in an Area of Envirol accordance with North Carolina General Statutes (N.C.G.S.) 113A-118: This following terms and conditions: Hardeman, y located at :ret County, auent to the that you have ,ou by the NC nt and Natural violation and e Resources s, and Public off SR 1335. 1 Concern, in included the 1. The permit is subject to compliance with the application dated 12/05/ 000, including attached work plan drawings (7), dated 1,2,3,4,5,and 7 of 7 dated March 001 and 6 of 7 dated October 2000. 151-B Hwy. 24, Hestron Plaza II, Morehead City, North Carolina Phone: 252-808-28081 FAX: 252-247-33301 Internet: www.nccoastaln An Equal Opportunity 1 Affirmative Action Employer —50% Recycled 110% Post Consumer NCWRC Page 02 January 12, 2005 For the following reasons, you are in violation of the above terms and conditions of your permit: Recent development is in excess of that authorized under State Permit # 47-01. This development involves the disturbance of an area greater than one acre in size for the purpose of parking lot expansion. 2. Condition # 15 states that the Division of Water Quality approved this project under Permit # SW8 001243, dated 4/6/01. Any violation of the permit approved by the DWQ will be considered a violation of this CAMA permit. 3. State Permit # 47-01 expired on 12/31/04. If the terms and conditions of a permit are not complied with, the permit becomes null and void from the date of its issuance. While expired State Permit # 47-01 authorized previous development, —no CAMA permit was issued to the NCWRC for the expansion in process. A civil penalty of up to Twenty -Five Hundred Dollars ($2500.00) may be assessed, or an injunction or criminal penalty may be sought against any person who violates a CAMA Major Development permit. It is the policy of the Coastal Resources Commission to assess a minimum civil penalty of $ 500.00 against all violations of this type. This is done to recoup some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed will depend on several factors, including the nature and area of the resources that were affected and the extent of the damage to them. Documents dated 3/22/01 and 3/28/01 indicate that the NCWRC voluntarily reduced the size of the parking area proposed and authorized under State Permit #47-01 in order to expedite permit issuance by reducing stormwater impacts to those allowable under the "low density" rules. Further, these documents indicate the intention of requesting future permit modifications to allow for the originally desired dimensions when time allowed. No such proposal was forthcoming; therefore no permit was issued to authorize the current activity. Based upon review of the Coastal Area Management Act, Coastal Resource Commission's rules, and the local jurisdiction's Land Use Plan, the activity you have undertaken appears consistent with the guidelines for Areas of Environmental Concern. Therefore, restoration of the impacted area is not requested at this time. However, please be advised that upon request, you must be able to provide us proof that you have given your adjacent riparian property owners notice of this unauthorized development and provided them the opportunity to comment to the Division of Coastal Management. Note also that a Major Modification to State Permit #47.01 will be required in order to proceed with any work outside of the boundaries of that permit, if such should receive a renewal. NCWRC Page 03 January 12, 2005 Thank you for your time and cooperation in resolving this important matter. If you have any questions about this or related matters, please call me at 252-808-2808. Upon m submission of an enforcement report to the District Manager, you will be notified as to the am unt of the civil assessment for failure to act in accordance with the terms, conditions, or requir ments of such permit. The relevant statutes and regulations are available from this office, and I am willing to assist you in complying with the requirements of these laws. A site inspection will be made in th near future to determine whether this REQUEST TO CEASE AND DESIST has been complied with: I request that you contact me immediately about these important matters. Please find enclosed five copies of the revised plats. There are several modifications that have been made to the design plats and are noted below. • The description of the planned development: Construction of a free boat launching fat single lane concrete launch ramps, one floating courtesy dock, two fixed docks, a crust parking area. The two single lane concrete launch ramps will be 15 feet wide each. The floatine and fixed docks extend 57 feet from MHW which is not a modificati submitted design. • Since the double launch lane has been modified to two single lanes with a floating excavation below MHW has been increased to 1,276 cubic yards. • Due to the design modification, the retaining wall within the parking area has been on wall was approximately 200 feet. • The length of the retaining wall averaging a distance of 30 feet landward of MHW is long. • The concrete walkway within the 75 foot AEC and 50 foot buffer has been omitted. • The total size of area to be graded has been slightly reduced to 1.54 acres. • The revised percentage of impervious tract within the AEC has been reduced to 18%. • A revised Stormwater Management Plan was submitted for review on February 23, 2001 the modifications listed above.
