This letter is in reference to the Notice of Violation dated 06/27/2017 that Ryan Davenport, representative for
the Division of Coastal Management, issued to EZ Dock Solutions, Inc. as contractor for Sunset Harbor
Building 4 Homeowners Association, for unauthorized installation of a floating PWC platform at Sunset Harbor
Building 4, Emerald Isle, Carteret County. The violation involved the Estuarine Waters and Public Trust Area
of Bogue Sound, which are Areas of Environmental Concern designated by the Coastal Resources
Commission.
The Coastal Area Management Act provides that a civil assessment of up to $10,000 plus investigative costs
may be assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil
penalty for all violations, including those against contractors, in order to recover some of the costs of
investigating violations and/or to compensate the public for any damage to its natural resources.
Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount of $400 is
appropriate for this violation. EZ Dock Solutions, Inc. may expeditiously resolve this matter prior to the
assessment of a formal civil penalty by accepting responsibility for the violation and paying the amount
proposed above. In order to do this, you or a representative of EZ Dock Solutions, Inc. must: (1) sign one of
the attached copies of an "Agreement to Pay Civil Assessment;" (2) attach a check or money order for $400
made payable to the North Carolina Department of Environmental Quality (NCDEQ); and, (3) return the
signed agreement and payment to this office in the enclosed, self-addressed envelope within ten (10) days
of receipt of this letter. Upon deposit of the check in the Department's account, EZ Dock Solutions, Inc. will
receive a Notice of Compliance officially closing this enforcement action.

If EZ Dock Solutions, Inc. does not send a signed agreement and payment to this office within ten (10)
days, the Director of the Division of Coastal Management may formally assess a civil penalty against EZ
Dock Solutions, Inc., which will then have the opportunity to request a hearing on the penalty or request
settlement of the penalty.

On behalf of EZ Dock Solutions, Inc., I understand that the staff of the Department of Environmental Quality
will propose the assessment of a civil penalty in the amount of $400 against EZ Dock Solutions, Inc. for
violation of the Coastal Area Management Act, NCGS 113A-100 et seq, committed on or near property
located at Sunset Harbor Building 4, Emerald Isle in Carteret County, North Carolina. In order to resolve this
matter with no further action or expense to EZ Dock Solutions, Inc., I accept responsibility on behalf of EZ
Dock Solutions for the violation as described in the Notice of Violation letter dated June 27, 2017, and agree
to pay the proposed civil assessment of $400.

RE. NOTICE OF VIOLATION AND ORDER TO CEASE UNAUTHORIZED DEVELOPMENT
CAMA VIOLATION #17-05C
Dear Mr. Anderson:
This letter is in reference to my 6/21/17 visit onsite Sunset Harbor Bldg. 4 property at 8628 Sound Dr., which
is contiguous with Bogue Sound, in Emerald Isle, Carteret County, North Carolina. The purpose of the onsite
visit was to investigate unauthorized development at this location.. j
Information gathered by me for the Division of Coastal Management indicates that EZ Dock Solutions, Inc.
actions as contractor for Sunset Harbor Bldg.4 HOA are in violation of the Coastal Area Management Act
(CAMA). No person may undertake major CAMA development in a designated Area of Environmental
Concern (AEC) without first obtaining a permit from the North Carolina Department of Environmental Quality
pursuant to, the North Carolina General Statutes (N.C.G.S.) 1 13A-1 18.
I have information that indicates you, as representative for EZ Dock Solutions, Inc. have undertaken or are
legally responsible for placement of a 10'X14' floating PWC platform on this property. This activity took place
in Estuarine Waters and Public Trust Area that are contiguous with Bogue Sound. Estuarine Waters and
Public Trust Area are designated as Areas of Environmental Concern (AEC). No permit was issued to you
for work in these areas. Based on these findings, the Division is initiating an enforcement action by issuing
this Notice of Violation for violation of the Coastal Area Management Act.
EZ Dock Solutions, Inc. must immediately CEASE AND DESIST any further unauthorised development
within the AECs on this property. A civil assessment of up to $10,000 plus investigative costs may be
assessed against any violator. Each day that the unauthorized development described in this Notice is
continued or repeated may constitute a separate violation that is subject to an additional assessment of
$10,000. An injunction or criminal penalty may also be sought to enforce any violation in' accordance with
N.C.G.S.113A-126.
It is the policy of the Coastal Resources Commission to assess a civil penalty plus investigative costs against
all violations. This is done to recoup some of the costs of investigating the violation and/ I r to compensate

This letter is in reference to my 6121/17 visit onsite Sunset Harbor Bldg. 4 property at 8628 Sound Dr., which
is contiguous with Bogue Sound, in Emerald Isle, Carteret County, North Carolina. The purpose of the onsite
visit was to investigate unauthorized development at this location.. `
Information gathered by me for the Division of Coastal Management indicates that your -actions as contractor
for Sunset Harbor Bldg.4 HOA are in violation of the Coastal Area Management Act (CAMA). No person may
undertake major CAMA development in a designated Area of Environmental Concern (AEC) without first
obtaining a permit from the North Carolina Department of Environmental Quality pursuant to the North
Carolina General Statutes (N.C.G.S.) 11 3A-1 18.

P14 floating on this property. This activity took place in Estuarine Waters and Public Trust Area that W'tc
contiguous with Bogue Sound. Estuarine Waters and Public Trust Area are designated as Areas of
Environmental Concern (AEC). No permit was issued to you for work in these areas. Based on these findings,
the Division is initiating an enforcement action by issuing this Notice of Violation for violation of the Coastal
Area Management Act.

property. A civil assessment of up to $10,000 plus investigative costs may be assessed against any violator.
Each day that the unauthorized development described in this Notice is continued or repeated may constitute
a separate violation that is subject to an additional assessment of $10,000. An injunction or criminal penalty
may also be sought to enforce any violation in accordance with N.C.G.S. 11 3A-1 26.
It is the policy of the Coastal Resources Commission to assess a civil penalty plus investigative costs against

all violations. This is done to recoup some of the costs of investigating the violation and/or to compensate
the- ublic for any damage to its natural resources. The amount assessed depends on several factors,
include but not limited to the nature of the violation, the area of the resources that are affected, and the

46 Based upon the North Carolina Administrative Code, Title 15A, Subchapter 7J.0409(g)(4)(E), the policy of
4)C the Coastal Resources Commission is to levy a civil assessment against contractors as well as the
landowner.
