Issued to VCC, Inc. authorizing development in the Estuarine Shoreline at 126 Seagull Drive in Holden Beach NC 28462,
as requested in the permittee's application, dated August 5, 2019 This permit issued on August 20, 2019, is subject to
compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special
conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil
action, or may cause the permit to be null and void.
This permit authorizes: SINGLE FAMILY RESIDENT, IN GROUND POOL WITH GROUND LEVEL WOOD DECK, UNDERGROUND
STORMWATER RETENTION CONTAINMENT AND GRAVEL DRIVEWAY.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings
(survey) dated RECEIVED August 9, 2019, SIGNED BY Everett Graham and stamped on 8-9-2019.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-842-6080 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. From the date of an appeal, any
work conducted under this permit must cease until the appeal is resolved. This
permit must be on the project site and accessible to the permit officer when the
project is inspected for compliance. Any maintenance work or project
modification not covered under this permit, require further written permit
approval. All work must cease when this permit expires on:
DECEMBER 31, 2022
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management

The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of
(Estuarine Shoreline Area of Environmental Concern), in this case the total impervious area within the AEC
is 1,045 square feet with a engineered stormwater plan.
(6) Unless specifically allowed in 15 NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of normal high water level.
This permit is being issued based on 15 NCAC 07H. 0209(d)(10)(F),190 square feet of pool decking.
(7) All unconsolidated material resulting from associated grading anti landscaping shall be retained on site by
effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier

construction completion.
(11)Areas below the structure which are below the lowest floor shall not be designed or used for human
habitation, but shall only be used for parking of vehicles, building access or limited storage of maintaince
equipment. Flood Vents shall be installed in accordance with FEMA regulations and Holden Beach Town
Ordinance. Access to the enclosed area shall be limited to a (standard exterior door), or entry to the living
area (stairway or elevator). The interior portion of such enclosed area shall not be finished or partitioned
into separate rooms, except to enclose storage areas.
Flood vents and break a way walls are required in all areas below the Flood Zone.
(12)Concrete slab shall be an elevation of 7.0
(13)No fill material is being permitted on this lot, area in right of way shall remain the same elevation as
existing.
(14)No pool equipment shall be located above the ground within the front yard setback.
(15)The pool shall be in ground pool and all decking shall be on ground wood decking that will allow water to
run onto the ground below.
