The most helpful thing is the recorded map that sub -divided the parcel, a copy of which is attached. The 8' access easement is also part of a larger 20' utility easement. I checked the deeds referenced by the surveyor shown on the face of this, but didn't see anything with more specific language on the easement. The survey note says that nothing can be developed within the 20' wide utility easement and that the 8' wide easement is for ingress/egress. It is a riparian easement which ends at the New River. Based on this survey map only, I think we could view the easement as being riparian, though also on this map, nothing can be built on the upland 20' wide utility easement which encompasses the 8' wide easement. But a pier could be built starting at MHW and out into New River under this easement (as long as the rest of our rules are met). Whether they have shown enough to get a CAMA permit is still not the same as whether the access easement (and 20' utility easement) would allow for a pier....that would be a private matter between the holders of Lots 1-4 who hold the easement. Obviously both adjacent riparian owners would have to waive 15' riparian setbacks as well since it's just 8' wide. For notice, they need notice to all the owners of the lots which have rights to the easement (owners of Lots 1-4 on the attached map), as well as the two adjacent riparian lots (looks like map number/parcel numbers 777-85 and 777-91). 1 see on the notice they list ownership of 613, but I don't see that address listed on the Pender Tax GIS. I see 611, 615, and 617. We would need confirmation of which lot (1-4 if they are claiming ownership of the easement) the potential applicant has since the 613 designation isn't helping.
