This letter is in reference to the Notice of Violation dated June 3; 2015 that Heather Styron, representative for
the Division of Coastal. Management, issued to you for unauthorized development by installation of a drain pipe
and:grading;of land at 402 J Bell Lane, Carteret County. The. violation. involved the Estuarine Shoreline and the
Outstanding Resource Waters area which are Areas of Environmental. Concern designated by the Coastal
Resources Commission. The unauthorized development also involved an area designated as federally regulated
Section 404 Wetlands.
The Coastal Area Management Act provides that a civil assessment of up to $10,000 plus investigative costs
may be assessed for any violation. It, is the policy .of the Coastal Resources Commission. to assess a civil
penalty for all violations in order to recover some of the costs of investigating violations and/or to compensate
the public for any damage to its natural resources.
Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount of $500 plus $54
investigative cost fora total of $554 is appropriate for this violation. You may expeditiously resolve this matter
,prior to the assessment of a formal civil penalty by accepting responsibility for the .violation andpaying the
._amount proposed. above. Jn_order_to_do_this, you_must:_(1)_sign one otthe attached.copies ofan to
Pay Civil Assessment;" (2) attach a check or money order for $554 made payable to the North Carolina
Department of Environment and Natural Resources. (NCDENR); and, (3) return the signed. agreement and
payment to this office in the enclosed, self-addressed envelope within ten (10) days of your receipt of this letter.
Upon deposit of your check in the Department's account, you will receive a Notice of Compliance officially
closing this enforcement action.
If you do not send a signed agreement and payment to this office within ten (10) days, the Director of the
Division of Coastal Management will formally assess -a civil penalty against you. You will then have the
opportunity to request a hearing on the penalty or request settlement of. the penalty.

Dear Mr. Tuttle:
This letter confirms that on 05119/2015, Joanne Steinhuis of the Division of Water Resources, Liz Hair of
the US Army Corps of Engineers, and Roy Brownlow, Division of Coastal Management, and you met onsite
at your property located at 402 J Bell Lane adjacent to Bogue Sound located in or near Newport, Carteret
County, North Carolina. The purpose of the visit was to investigate unauthorized development of drain pipe
installation associated with an on -site wastewater septic system within the Coastal Shoreline Area of
Environmental Concern. This letter also confirms the 05/07/2015 site meeting with the person engaged in
doing the work, Mr. Glenn Tillman, Roy Brownlow of Coastal Management and myself.
Information gathered by me for the Division of Coastal Management indicates that you have undertaken
major development in violation of the Coastal Area Management Act (CAMA). No person may undertake
Major Development in a designated Area of Environmental Concern (AEC) without first obtaining a permit
from the North Carolina Department of Environment and Natural Resources. This requirement is imposed
by North Carolina General Statute (N.C.G.S.) 113A-118.
I have information that indicates you have undertaken or are legally responsible for excavation, filling and
grading for the installation of PVC drain piping associated with an on -site wastewater septic system on the
aforementioned property. This activity took place in the Estuarine Shoreline that is contiguous with Bogue
Sound. In addition, alteration of the coastal wetland substrate was noted. The waters of Bogue Sound in
this area are classified as Outstanding Resource Waters (ORW). The Estuarine Shoreline and Coastal
Wetland areas are designated as Areas of Environmental Concern (AEC) and in this case the unauthorized
development took place within 575' feet of the waters of Bogue Sound and within the 30' CAMA buffer.
There was a 10' x 20' area of disturbed area in the coastal wetlands adjacent to Bogue Sound.

The unauthorized activity also took place in non -coastal Section 404 wetlands, No CAMA permit was
issued to you for work in these areas. Based on these findings, I am initiating an enforcement action by
issuing this Notice of Violation for violation of the Coastal Area Management Act.
I request that you immediately CEASE AND DESIST any further unauthorized development. A civil
assessment of up to $10,000 plus investigative costs may be assessed against any violator. Each day that
the development described in this Notice is continued or repeated may constitute a separate violation that
is subject to an additional assessment of $10,000. An injunction or criminal penalty may also be sought to
enforce any violation in accordance with N.C.G.S. 113A-126.
It is the policy of the Coastal Resources Commission to assess a civil penalty plus investigative costs
against all violations. This is done to recoup some of the costs of investigating the violation and/or to
compensate the public for any damage to its natural resources. The amount assessed will depend upon
several factors, including the nature and area of the resources that were affected and the extent of the
damage to them.
Based upon the North Carolina Administrative Code, Title 15A, Subchapter 07H. State Guidelines for Areas
of Environmental Concern, the activity you have undertaken, the excavation, filling and grading associated
with the installation of PVC drain piping in the Estuarine Shoreline AEC and Section 404 Wetlands, and
disturbing the coastal wetland substrate is not consistent with Titles 15A NCAC 07H .0205 Coastal
Wetlands and 07H .0209 Coastal Shoreline, which prohibits alteration of the marsh substrate and the
placement of non -water dependent uses within the 30' of the normal high water of Bogue Sound.
Therefore, I am requesting that the coastal wetlands substrate be restored to its pre -development elevation,
the PVC piping be removed from the 30' CAMA buffer and installed in accordance with the Carteret County
Division of Environmental Health on -site wastewater permit specifications; and the area graded and
stabilized to prevent any additional stormwater runoff to the adjacent marsh and waters of Bogue Sound.
Please refer to the enclosed Restoration Agreement.
If you intend to cooperate with my request, please sign one of the attached Restoration Agreements and
return it to me in the enclosed, self-addressed envelope within ten (10) days of receipt of this letter. Failure
to comply with this request or respond back to this office prior to the requested deadline with an acceptable
schedule for compliance will be interpreted as a refusal to cooperate and will result in a Notice of
Continuing Violation, as well as a court injunction being sought ordering compliance.

I. Restore the 10' x 20' disturbed coastal wetlands substrate to its pre -development elevation;
2. The PVC piping is to be removed from the 30' CAMA buffer and installed in accordance with the
Carteret County Division of Environmental Health on -site wastewater permit specifications; and
3. The disturbed land area is to be graded and stabilized to prevent any additional stormwater runoff
to the adjacent marsh and waters of Bogue Sound.
4. Contact the Division of Coastal Management and U.S. Army Corps of Engineers to obtain the
proper permits or authorizations prior to engaging in any other development or land disturbing
activity within jurisdictional environmental areas.
