This letter confirms that on May 13, 2014, 1 visited the utility line relocation work within the N.C. Department of
Transportation Right -of -Way adjacent to Bridges 4 and 92 near Nixonton, in Pasquotank County, North Carolina. The
purpose of the visit was to monitor the utility line relocation work within the Estuarine Waters, Coastal Shoreline, Coastal
Wetlands, and Public Trust Areas that are designated as Areas of Environmental Concern (AEC).
I have information that you undertook, or are legally responsible for, major development by constructing/boring utility lines
within the designated Areas of Environmental Concern on the afore mentioned property. No person may undertake major
development in a designated Area of Environmental Concern without first obtaining a permit from the North Carolina
Department of Environment and Natural Resources pursuant to the North Carolina General Statutes (N.C.G.S.)113-118.
You are hereby requested to CEASE and DESIST any further unauthorized activities within designated Areas of
Environmental Concern immediately. Any other work in an Area of Environmental Concern requires that an application be
filed with this office for a CAMA Major Development Permit. No work may proceed until a CAMA permit or authorization is
issued.
Continuation of this method of work after receipt of this letter may constitute a violation of the Act and you may be subject to
civil and/or criminal penalties as provided by North Carolina General Statute (NCGS) 113A-126. Each day that the
development described in this Notice is continued or repeated may constitute a separate violation that is subject to do
additional assessment of $10,000. An injunction or criminal penalty may also be sought to enforce any violation in
accordance with NCGS 113A-126. 1
