REGAN Secremry BRAXTON DAVIS Dlrecmr RE: NOTICE OF VIOLATION AND REQUEST TO CEASE UNAUTHORIZED DEVELOPMENT CAMA VIOLATION #17-02C Dear Mr. Eatmon: This letter confirms that on 03127/2017, Morehead City Country Club representatives Ron Perry, Club President; Nick Eatmon, Club Manager; Harry Bowers, consultant; Atlantic Installations (Contractor) representatives Mark Pribble, Vice -President and Randy Wilson; and Division of Coastal Management District,Manager and Compliance Coordinator Roy Brownlow and I were onsite at Morehead City Country Club, Inc. (MCCC) property located at 2900 Country Club Road, in or near Morehead City, Carteret County, North Carolina. The purpose of the visit was to investigate unauthorized development of mechanized land clearing and alteration and the placement (dumping or filling) and grading of earthen fill material on MCCC property contiguous with the Newport River. This letter also confirms Mr. Brownlow's site visit with project engineer Bill Foreman and land surveyor Linwood Byrd on 03/23/2017. This site visit was following, information provided to the Division of Coastal Management (DCM) by Division of Water Resources representative Robb Mairs and U.S. Army Corps of Engineers representative Tyler Crumbley on 03/23/2017. Information gathered by me for the Division of Coastal Management indicates that you have undertaken major CAMA development in violation of the Coastal Area Management Act (CAMA). No person may undertake major CAMA development in a designated Area of Environmental Concern (AEC) without,first obtaining a permit from the North Carolina Department of Environmental Quality. This requirement is imposed by North Carolina General Statute (N.C.G.S.)113A-118. I have information that indicates MCCC has undertaken or is legally responsible for activity involving mechanized land clearing, filling, dumping and grading of earthen material, and alteration of coastal marshlands on the MCCC property. This activity took place within the Coastal Shoreline area (Estuarine Shoreline), Coastal Wetlands, and federal jurisdictional wetlands that are contiguous with the Newport River. The Estuarine Shoreline and Coastal Wetland areas are designated as Areas of Environmental Concern (AEC). No CAMA permit was issued to MCCC for work in these areas. Based on these findings, I am initiating an enforcement action by issuing this Notice of Violation for violation of the Coastal Area Management Act and the State's Dredge and Fill Law. March 28, 2017 Page 2 of 4 I request that MCCC immediately CEASE AND DESIST any further development. A civil assessment of up to $10,000 plus investigative costs may be assessed against any violator. Each day that the development described in this Notice is continued or repeated may constitute a separate violation that is subject to an additional assessment of $10,000. An injunction or criminal penalty may also be sought to enforce any violation in accordance with N.C.G.S.113A-126. It is the policy of the Coastal Resources Commission to assess a civil penalty plus investigative costs against all violations. This is done to recoup some of the costs of investigating the violation and/or to compensate the public for any damage to its natural resources. The amount assessed will depend upon several factors, including the nature and area of the resources that were affected and the extent of the damage to them. MCCC is also in violation of the State's Dredge and Fill Law which requires a permit from the North Carolina Department of Environmental Quality before undertaking any excavating or filling in any estuarine waters, , tidelands, marshlands, or state=owned lakes pursuant to N.C.G.S.113-229. Therefore, I also request that MCCC immediately CEASE AND DESIST such unauthorized activity. Violations of the State's Dredge and Fill Act may be enforced by a criminal penalty or a civil action for damages or an injunction in accordance with N.C.G.S. 113- 229. ,. Based upon the North Carolina Administrative Code, Title 15A, Subchapter 07H. State Guidelines for Areas of Environmental Concern, the activity described herein that MCCC has undertaken in the Coastal Shoreline and Coastal Wetland AECs, is not consistent with Section 7H .0208, which states "Uses which are not water dependent shall not be permitted in coastal wetlands." Golf Courses are not considered a water dependent use; therefore, I am requesting that all the'coastal wetland's substrate that was altered as an adjunct to the construction of the golf course improvements be restored to its original pre -development elevation and contour. In addition, all areas of unconsolidated earthen fill and, mechanically cleared areas within the Coastal Shoreline AEC be effectively stabilized and maintained to prevent sedimentation and erosion. The enclosed Restoration Plan describes the action necessary to bring this project into compliance with the Act. If you intend to cooperate with my request, please sign one of the attached Restoration Agreements and return it to me within ten (10) days of receipt of this letter. Failure to comply with this request or respond back to this office prior to the requested deadline with an acceptable schedule for compliance will be interpreted as a refusal to cooperate and will result in a Notice of Continuing Violation, as well as a court injunction being sought ordering compliance. The violation took place on Morehead City Country Club property located at 2900 Country Club Road in or near the community of Morehead City in Carteret County, North Carolina. This unauthorized activity constituted development and Morehead City Country Club was requested to effectively stabilize filled, graded and cleared areas and restore altered and impacted coastal wetland areas as well as stabilize bank slope. In accordance with the North Carolina Administrative Code, Title 15A, Subchapter 7J.0410, any violation involving development which is inconsistent with guidelines for development within Areas of Environmental Concern (AEC) must be corrected by restoring the project site to pre -development conditions to recover lost resources or to prevent further resource damage. I conducted a site visit at the aforementioned property on 3131117 to inspect the restoration of the unauthorized activity addressed in the Notice of Violation' 17-02C. Based on this inspection, it appears the restoration is accomplished to the satisfaction of this Division. Upon my submission of an enforcement report, Morehead City Country Club will be notified as to the amount of the civil penalty for undertaking this unauthorized activity within an Area of Environmental concern. (MCCC) for unauthorized mechanized land clearing, grading, and filling; and alteration of coastal wetlands at the MCCC property, Carteret County, The violation involved Coastal Wetlands and the Coastal Shoreline, which are Areas of Environmental Concern designated by the Coastal Resources Commission. The unauthorized activity also involved federal jurisdictional wetlands contiguous with the coastal wetlands. The Coastal Area Management Act provides that a civil assessment of up to $10,000 plus investigative costs may be assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil penalty for all violations in order to recover some -of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount of $1,900 plus $96 investigative costs, for a total of $1,996 is appropriate for this violation. MCCC may expeditiously resolve this matter prior to the assessment of a formal civil penalty by accepting responsibility for the violation and paying the amount proposed above. In order to do this, a representative for the'MCCC must: (1) sign one of the attached copies of an "Agreement to Pay Civil Assessment;" (2) attach a check or money order for $1,996 made payable to the North Carolina Department of Environmental Quality (NCDEQ); and, (3) return the signed agreement and payment to this office within ten (10) days of your receipt of this letter. Upon deposit of your check in the Departments account, you will receive correspondence officially closing this enforcement action. (MCCC) for unauthorized mechanized land clearing, grading, and filling; and alteration of coastal wetlands at the MCCC property, Carteret County. The violation involved Coastal Wetlands and the Coastal Shoreline, which are Areas of Environmental Concern designated by the Coastal Resources Commission. The unauthorized activity also involved federal jurisdictional wetlands contiguous with the coastal wetlands. The Coastal Area Management Act provides that a civil assessment of up to $10,000 plus investigative costs may be assessed for any violation. It is the policy of the Coastal Resources Commission to assess a civil penalty for all violations in order to recover some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount of $1,900 plus $96 investigative costs, for a total of $1,996 is appropriate for this violation. MCCC may expeditiously resolve this matter prior to the assessment of a formal civil penalty by accepting responsibility for the violation and paying the amount proposed above. In order to do this, a representative for the MCCC must: (1) sign one of the attached copies of an "Agreement to Pay Civil Assessment;" (2) attach a check or money order for $1,996 made payable to the North Carolina Department of Environmental Quality (NCDEQ); and, (3) return the signed agreement and payment to this office within ten (10) days of your receipt of this letter. Waters along the shoreline are classified SA;HQW. The club was originally developed in the 1950's on property along the Newport River in Carteret County with an 18-hole golf course and clubhouse facilities. The Club property includes 156.38 acres of which approximately 28 acres is coastal or 404 wetlands in the Newport River estuary. A major CAMA permit is requested for improvements to the golf course and construction of new club facilities and associated site improvements. Golf course modifications include the construction of new holes including tee boxes, fairways, & greens, clearing & grubbing of trees, relocation of the driving range, resurfacing of all greens and tee boxes, reconstruction of all sand traps, and demolition, construction or reconfiguration of 8' wide concrete cart paths. There is currently a pool, pool house with bath facilities located along the shoreline of the Newport River. A small portion of the pool deck is located in the 75 ft. AEC. Club facility improvements include demolition of the existing pool facility and construction of a new pool, deck and bath facilities at a location east of the existing location. A new golf hole will be constructed in the uplands along the shoreline in the area of the existing pool. The project also includes demolition of the picnic pavilion, and pavement areas and reconfiguration of parking facilities. Following completion of golf course and pool improvements in 2017, the club will embark upon construction of a new 15,000 s.f. club house with new parking areas and site improvements including connection of water and sewer systems to the Town of Morehead City systems. PROJECT LOCATION The project location is shown on the attached Project Location Map (sheet 1). The site can be reached by turning onto Bridges Street Extension (S.R. 1738) at the intersection of Highways 70 & 24, turning left on Country Club Road (S.R. 1177) and proceeding approximately 3 miles to the club entrance on the left (north side) of Country Club Road. SITE DESCRIPTION The site includes approximately 128 acres of upland area and some 18 acres of coastal and 404 wetlands along the shoreline of the Newport River. The site drains to the Newport River (SA;HQW) via sheet flow and existing drainage ditches on the site. A small creek is located near the center portion of the site that drains through 404 and coastal wetlands to the Newport River. Elevations on the site range from approximately +18 feet along Country Club Road to +4 and to the normal high water line along the Newport River. SOILS Soils on the site are shown on sheet 2, Soil Map, and consists of Autryville well -drained, Arapahoe, very poorly drained, and Seabrook, moderately well drained sandy loam. Most of the site is well drained and moderately well drained soils with the poorly drained soils around the creek and wetlands pockets that run through the middle of the site. Most of the site work will take place in the areas of Autryville and Seabrook soils. WETLANDS The site contains 404 and coastal wetlands. The wetlands have been mapped by the Soil Scientist (Thomas Hinson, LSS) and surveyed. Representatives from the U. S. Army Corps of Engineers, Wilmington District, Regulatory Branch (Tom Charles) have visited the site and verified the 404 Wetlands line shown on the attached Preliminary Wetlands Map. Coastal wetlands and the normal high water lines were delineated by a DCM representative (Heather Styron), surveyed, and are shown on the site plan. A project objective is to minimize and avoid impacts to both coastal and 404 wetlands. With the exception of some impacts to ditches and ponds claimed as jurisdictional, that objective has been achieved. A pre -construction notification will be submitted to USACE as soon as the final Wetlands Map is approved. That process is ongoing concurrent with this application. PROJECT DESCRIPTION Improvements are to be implemented in two phases. The fast phase includes golf course improvements and pool relocation. Phase 2 will be implemented upon completion of golf course improvements and will include construction of a new club house with a footprint not to exceed 15,000 s.f, and utility and site improvements including parking areas adjacent to the new pool and clubhouse for over 200 vehicles. A detailed list of improvements is provided as follows: Phase 1— Golf Course and Pool Improvements 1. Relocation of hole #L Construction of new fairway for hole # I including timbering along but setback 15 feet from the property line, conversion of ditches to wide shallow swales flowing to the ditch along the property line, and expansion of the pond adjacent to the new #1 green from 6,800 s.f. to 22.500 s.f, of surface area. 2. Expansion ofpond near existing #5 (new #2) green. The pond adjacent to the new #2 green (existing #5) will be expanded from 76,000 s.f. to 83,300 s.f. 3. Lengthening of existing hole #3 (new #5). The fairway at new #5 will be lengthened and a new green constructed. 4. Expansion of existing #4 (new #6) fairway. The fairway at the new #6 will be expanded, trees along the east side of the existing fairway cleared and grubbed, the pond expanded from 11,500 s.f. to 18,700 s.f, and the 8 ft. wide cart path relocated to the east along the edge of the new tree line. 5. New driving range fairway. A new driving range will be graded and turfed between the new # 1 and new #7 fairways, including practice tee boxes at both ends and construction of a new practice green. 7. Pool Relocation. A new pool will be constructed adjacent to the existing clubhouse. The new pool and concrete deck will have an area of approximately 24,100 s.f. When the new pool is completed and operational, the old pool along the Newport River will be demolished to make room for a new #9 hole. Demolition will include removal of the existing pavements in the area of the new pool. 8. New hole #8. Existing hole #9 will be moved to the northeast, the tee boxes relocated to the west side of the entrance road, a new 19,500 s.f. pond constructed, the 8 ft. wide cart paths relocated, and a new green constructed. 9. New hole #9. Construction of new hole along the Newport River waterfront over existing the pool site with fill extending into the AEC. No impervious surfaces will be constructed in the AEC. 10. Improvements to hole #12 (new 911). Improvements will include expansion of existing fairway, partial relocation of 8' wide concrete cart path and expansion of the pond from 54,700 s.f. to 63,500 s.f. 11. Reorientation ofpond at 914 (new #13). Existing pond to be re -orientated from the existing alignment with the size of the new pond approximating the size of the existing pond. 12. Construction of new hole #16. A new hole, will be constructed on the east side of the wetlands that run through the center of the site and the 8 ft. wide cart path extended to near the new green location. New construction will include grading of the fairway and construction of a new green and tee boxes. The slope of the new green will avoid impacts to adjacent 404 wetlands. 13. Improvements to hole #16 (new #15). Portions of the low poorly drained fairway will be filled, graded and turfed, and the existing 6,100 s.f. non jurisdictional pond will be filled and incorporated into the fairway. Impacts to adjacent 404 wetlands will be avoided. The pond is non jurisdictional according the USACE because there is no connection to the adjacent wetlands. 14. Excavation of Uplands. An area of approximately 0.67 acres will be excavated between the existing #17 hole tee complex and the existing #18 hole fairway. Currently, there is a ditch with 404 wetlands between these two holes. The intention is to use this area as a borrow pit for fill and then restore the area with 404 wetland plants. The fill will be used to fill the non - jurisdictional pond on existing hole #16 as well as raise the elevation of the fairways on existing hole #16 and hole #18. There will be no excavation of the 404 wetlands. 15. Improvements to hole #18. Improvements to #18 will include tree removal along the western property line with a 15 ft. wide vegetated buffer remaining, portions of the low poorly drained fairway west of the creek will be filled, graded and turfed with the fill extending into the AEC and avoiding adjacent 404 wetlands, a new fairway and green will be constructed on the point of the creek and Newport River estuary including filling, grading and turf in a low poorly drained area, and construction of a new green. Cart paths will be relocated adjacent to the new fairway. The existing bridge crossing the wetlands will remain in use and in its existing location. Phase 2 — Clubhouse, Parking and Utility Improvements 16. New Clubhouse. A new clubhouse will be constructed in the area between the new #9 and #18 greens with a small portion of the building (approximately 2,186 s.f.) extending into the 75 ft. AEC. The building has not be designed. Parking Improvements. Club house improvements will include a new parking lot with some 160 spaces (approximately 1.54 acres of pavement) and rehabilitation of existing parking adjacent to the existing clubhouse and new pool (1.05 acres) for a total number of spaces exceeding 200. 18. Water and Sewer Connections. The existing facilities are served by an onsite well for potable water and an onsite septic system for sewage treatment and disposal. Clubhouse improvements will require connection to the Town of Morehead City potable water system for both fire protection and drinking water. It is proposed to pump wastewater into the Town sewer system in the Country Club Run subdivision just west of the hole #15 green with an onsite lift station and a force main. The specifics of the sewer system have not been resolved with the exception of making the decision not to build and maintain onsite wastewater treatment and disposal systems. Permits for construction of the water and sewer systems will be required from the Department of Environmental Quality, Division of Water Resources and the Public Water Supply Section. EROSION AND SEDIMENTATION CONTROL An Erosion and Sedimentation Control Plan (E&SC Plan) has been submitted for approval to the Land Quality Section of N.C. Department of Energy, Mineral and Land Resources, in Wilmington, NC. The express submittal is for work in an area of 19.62 acres, an area designated as phase 1 for purposes of erosion and sediment control. The phase 1 area includes the work area of the new pool, the area of new holes #1, #7, and the new driving range. Following approval of the phase 1 plan, a submittal will be made for phase 2 which includes the remainder of the project area, an additional disturbed area of approximately 42 acres. Grading and turf work will begin in the phase 1 area upon approval of the phase 1 E&SC Plan. STORMWATER MANAGEMENT A preliminary determination has been made that the project will meet the requirements for low density development. Surface water conveyances will be limited to vegetated swales and sheet flow. Total impervious area for proposed improvements is summarized in the following table and includes 376,995 s.f. (8.65 acres) which is 6.74% of the total upland land area of approximately 128 acres. Total acreage is calculated as the total property area (156.38 acres) less the coastal and 404 wetland areas (approximately 28 acres). No construction of impervious areas will commence until the Stormwater Water Management Plan is approved by DEMLR. Submittal of the plan will follow submittal of this CAMA permit application. LOCAL GOVERNMENT APPROVAL The site plan has been coordinated with the Planning Department of the Town of Morehead City (TMHC). Golf course improvements do not require TMHC approval except that a 15 ft. wide buffer from property pines is required where there are logging operations. A special use permit will be required for construction of the club house. Application for that approval will be made when the clubhouse design is completed and ready for permitting and construction. Cart paths will be graded and formed and concrete poured and finished. Graded area will be stabilized within 14 days with either temporary seeding and mulching or permanent sodding with Bermuda grass sod. The pool will be a cast -in -place concrete structure graded, formed and the concrete poured and finished. Buildings will be by conventional framed construction. PROJECT SCHEDULE Following receipt of the Major CAMA permit, Stormwater and Erosion & Sediment Control permits; grading and turf placement will proceed over the entire golf course. The turf must be in place during the month of June in order that a playable stand of grass is ready for reopening of the course in October. Club house and associated site and utility improvements will proceed upon completion of the golf course improvements. A completion date for club house construction is not available.
