In an area of environment concern pursuant to Section 113A-118 of the
General Statutes, "Coastal Area Management"
Issued to Gary McDaniel, authorizing development in the Estuarine Shoreline (AEC) at 11 White Lane, in Oak Island, as
requested in the permittee's application, received 3/07/2019. This permit, issued on 4/19/2019, is subject to compliance
with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions
and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or
may cause the permit to be null and void.
This permit authorizes: Install fill at back slope of house and along west side of home to secure the foundation. Fill low area in 30'
buffer and up to the 75'aec to fill in low areas not to exceed the elevations of the adjoining neighbor.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 3l7/19 & 4/01/19.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and
modification of this permit.
(4). A copy of this permit shall be posted or available on site. Contact this office at (910)278-5024 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on:

(5) The amount of impervious surface shall not exceed 30% of the lot area within 75 feet of normal high water
(Estuarine Shoreline Area of Environmental Concern), in this case, 0 square feet is authorized.
(6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all .
development/construction shall be located a distance of 30 feet landward of the normal high water. No portion of the
roof overhang shall encroach into the 30 ft. buffer.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed for grading within the 30' buffer from the normal high water must be contoured to prevent additional
stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in
a vegetated state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

may be susceptible to erosion and/or flooding. I acknowledge that the Local Permit Officer has explained to me the particu-
lar, hazard problems associated with this lot. This explanation was accompanied by recommendations concerning stabiliza-

Hello,
The purpose of this letter is to provide a revised summary of the work planned for 11 White Lane, per
feedback from Donna Coleman, in order to clarify any questions arising from the permit requests enclosed,
and to request approval for 2 specific issues to facilitate the work planned.
Background:
This work will be.performed on a lot with an existing residence. No changes to the structure or it's roofline are
planned, and no additional structures or impervious surfaces will be added. When the structure was built, it
was constructed exactly on the southwest corner of a bank created when 1st St SW was originally cut down to
Davis Canal.
Work Summary:
Install fill dirt along the west side of the house to create more margin for the house foundation and create a
safer platform for long term maintenance of the west side.
Install fill dirt on the south side of the same bank to create a gradual walking ramp for safer access to the lower
elevation of the lot.
The feedback was
regarding the drainage crown routing runoff toward the adjacent property on 9 White Lane. The scope
of this fill has been substantially reduced and is shown on a revised fill plan drawing included with this
letter. Install fill dirt in the lower elevation of the lot to fill in 4 shallow depressions and restore back fill
to the bulkhead. The current runoff pattern will remain unchanged. A CAMA permit application has been
sent to Donna Coleman, and the USACOE has determined no permit is required. (attached).
Install a gravel driveway. No drainage impediments will be installed under the gravel.
Special Requests:
1. Please allow a 75 day window to perform the work from date of approval, rather than 30. We intend to
perform the work — May 9 — 30, which with exceed the 30 day requirement if the permit is approved in
March.
2. Please allow us to stage the some of the fill dirt on 1 st St SW for delivery by tractor onto the lot. Due to
the number of trees on the lot, a dump truck cannot enter the lower part of the lot. The dirt will be
staged on the grass / dirt public easement portion of the road between White Lane and Davis Canal,
not the paved travel lanes north of White Lane.

resources.

jurisdictional determination was not completed with this request. This letter does not address.nor include any
consideration for jurisdiction on aquatic resources and shall not be interpreted as such. This is not an appealable
action. However, you may request an approved JD, which is an appealable action, by contacting the Corps for further
instruction.
_ The proposed activity is exempt from Department of the Army regulations. A jurisdictional determination was not
completed with this request. This letter does not address nor include any consideration for jurisdiction on aquatic
resources and shall not be interpreted as such. This is not an appealable action. However, you may request an
approved JD, which is an appealable action, by contacting the Corps for further instruction.
Remarks: The ponded areas are not Jurisdictional Wetlands or Waters of the US. Any work that takes place near
the canal or water front may require a permit from CAMA.
This Department of the Army determination does not relieve the permittee of the responsibility to obtain any other
required Federal, State, or local approvals/permits. The permittee may need to contact appropriate State and local
agencies before beginning work.
For any activity within the twenty coastal counties, before beginning work, you must contact the N.C. Division of Coastal
Management in Wilmington, NC.to discuss any required State authorization.

We originally accepted your CAMA Minor applications under the impression that it was complete. On subsequent review,
I have discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit
the following additional information to this office:
1. I need a copy of the a cross sectional fill plan to determine if the fill will create runoff on the adjacent neighbor.
2. A side view of the proposed project.
In accordance with the Department of Environment and Natural Resources regulations, we note that a certain time has passed while
