This past Wednesday, Yvonne and I met with the applicant's consultant Doug Dorman of Atlantic Environmental Consultants, LLC to measure water depths at the site of the proposed development. Since this area receives less than 6" of lunar tide during periods of little or no wind, all water depths are measured at normal water level (NWL). That means low and high water measurements due to wind events are adjusted such that the wind is taken out of the equation. NWL is determined by the presence of such physical and biological indicators as erosion escarpments, trash lines, water lines, marsh grasses and barnacles. I've attached a Google Earth aerial image that shows our measured water depth contours at the corresponding distances waterward of the Midgett properties shoreline as well as the footprint of the proposed docking facility. We found that deeper water depths do not begin until —16' waterward of the Midgett shoreline with the deepest measurements of -3.3' being 23'-26' waterward of the shoreline and a 3' water depth 31' waterward of the shoreline. From there, water depths slowly decreased to -2.0' at a shelf 37' waterward of the shoreline and then slightly increased in depth again. We also measured water depths off the end of your pier and found corresponding water depth contours. Based on our measurements, it appears that the proposed docking facility will be installed landward of the deepest navigable area of the waterbody leaving —15' of deeper water bottom for navigation. Their objection is related to the facility blocking the navigable water depths (located 2' out from the shoreline) to and from their property. I'm attaching a picture they sent to us indicating the deeper water route they have to use to access to the main channel. If this is indeed the case, then we will need to elevate this request to a CAMA major permit for review. For further permit consideration, we will need to have water depths within the boxed in area of the attached aerial to determine where the deepest navigation route is located. We will also need to know what boat lengths are expected to be docked at the facility as longer boats will impact the navigation further. If you have any questions, let Yvonne or I know. My family have lived at 57123 C Deering Ridge rd Hatteras since 2005.We are the adjacent property owners to this proposed dock.This 2 slip boat dock or any size boat dock would completely block us from using the canal .We have a 30 foot Grady White 30 feet by 10 feet. For 17 years we have only one route in and out to the main canal. The 12 foot wide canal basically is within 2 feet from the bank. Please see the image I sent in separate email. During low tide and south wind the canal is 1 1/2 feet deep.The 2 slip boat dock and our path will be unnavigable. The image I sent represents the yellow line is the little pathway we use to go in and out. the blue is our small dock ,the orange is the property line. The boat in our yard is my sons 26 foot Grady, our boat is much bigger. The surrounding water depth there is inches deep. We have sunk a lot of $ in our place and having our boat there is part of our plan. I have found out today that this property at 57137 has not been sold yet and is still on the market and is being advertised online , as having a CAMA permit on file. This dock is just I way for For Midgetts to make the lot look more appealing for a sale ,no matter what type of anguish we will go through. Having lost vacationers in shallow waters , tearing their motors up is something I have witnessed from my porch. People come up near the the neighbors dock and hit bottom a lot. This is the turmoil that the new dock would cause. I just can't imagine having 2 boats sitting crossways in our pathway ,in the middle of the canal. I never thought this could be lawful.
