The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available

FOR PIER AND DOCKING FACILITIES ACCESS WAY
A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico &
Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 02B.0233 84 .0259. The
Division of Coastal Management (DCM), through a Memorandum of Understanding with the Division of Water
Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies
with the aforementioned regulations.
Those activities covered by your Coastal Area Management Act(CAMA) permit have received Buffer Authorization
provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to
comply with this Buffer Authorization may subject the property owner and the party (contractor) performing the
construction and/or land clearing to a civil penalty by DWR of up to $25,000 per day per violation.
i. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft. riparian buffer
perpendicularly(which is defined as between 75 and 105 degrees) unless otherwise approved by DCM. The
alignment shall minimize the removal of woody vegetation to the greatest extent practicable.
2. Pervious Materials: All reasonable measures shall be taken to ensure the access way is made of pervious
materials like open-slatted wood or composite, mulch, or grass to meet the intent of the rules to the
maximum extent practicable.
3. Access Width: The width of the pier or docking facility access way shall be limited to six (6) feet.
A. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your
property indicating the relative location of the pier or docking facility and any requested access way. This
drawing will be used to aid in compliance and monitoring efforts.

Hi Ashley,
Again I apologize for not getting back with you sooner. My wife and I just returned from Mexico,and while I was down there, I
could not check my voice messages.
When Mr. McGahey removed the existing house from his property last year and began construction of this new house,he raised the
elevation slightly on his property,and that has had serious effects on our drainage(and the health of our septic tank which sits near the
lake he has created on our property line).
Now,as you know,he has come in and added several more truckloads of dirt to the buffer zone to further elevate his property. When
I expressed my concerns,he told me it was his property and he could do whatever he pleases on his side of the property line. Now he
wants to build a retaining wall for his elevated property. This will further the negative effects on our property not necessarily due to
the water draining from his roof/yard but more towards flood control
Our properties(and the one on the other side of my house)are the lowest elevation in the neighborhood. This meant that,prior to his
new construction,we all shared the return drainage of river flooding from the fields and ponds behind our houses. By elevating
property again,he is reducing the area where the water can drain back out to the river to just the other two properties. This will
intensify the flood levels and drainage time for properties.
By adding all that dirt,he is increasing the burden on our properties,especially mine. I cannot just agree to this knowing our flood
exposure will be worsened.
He should not have brought that dirt into the buffer zone,and I am pretty sure he knows that his actions will negative affect our
property.
I think he should have to reduce the dirt level in the buffer zone and instead of a retaining wall,he should reconfigure the drainage
ditch so that it drains back to the river like it used to. My neighbor on the other side had her landscapers repair the ditch on our
property line and now it drains much better. That would be preferred over his retaining wall idea.

I have attached the ARPO form requested by the adjacent property owner to my property, John McGahey. We feel there
are significant reasons to deny this request and I would like to address them with CAMA at some point. I am out of town
until next Tuesday, but I wanted to make sure my objections are delivered prior to the 10 day comment period deadline.
Mr. McGahey has been dumping truck loads of dirt into the buffer zone, which has raised his elevation and adversely
affected drainage on our property. Adding a retaining wall will cause additional drainage issues on my property. If he had
not raised his elevation in the first place, said wall would be unnecessary. I believe a site visit by CAMA may be
appropriate so that I can show you why this is a bad idea for our property.
Further, Mr. McGahey did not send the ARPO to the other riparian homeowner, ELIZABETH MOYE. He needs to send
her a request in accordance with CAMA guidelines.

I'm pretty sure John McGahey has reached out to you guys concerning a retaining wall replacement and installation of
additional retaining wall inside the Tar/Pam river buffer. I spoke with Mr. Moye(right side neighbor to Mr. McGahey)
and heard his objections to Mr. McGahey's retaining wall project. His concerns are that Mr. McGahey has already
dumped dirt in the buffer(I asked Mr. McGahey to silt fence the fill until you guys have a chance to get there),when the
river rises it will push more water on him,and that a majority of the surrounding property drains between the two
properties. I know Mr. McGahey would like to catch most of the water from his property in a underground drain system
and spread outside the buffer. We can discuss this further as you begin reviewing the project I just wanted you to be
aware there are objections and what those were. If you need to speak with either property owner, I have contact info
for both.

The Division of Coastal Management has reviewed your correspondence dated 29
July 2021 to Ashley Grandy addressing concerns to the project as well as verbal objection
for the property adjacent to yours at 70 Glenhaven Rd near Washington in Beaufort Co.The
installation of pier platform, boatlift and P.W.0 lift is consistent with Division of Coastal
Management rule 07H.1200(please see attached copy of rules). On May 3, 2022,Ashley
Grandy,a member of my staff, issued CAMA General Permit 85189 in Beaufort County,
authorizing the aforementioned project, (see attached copy of permit).
If you wish to appeal this permit decision,you must file a request with Mr. Braxton
C. Davis, Director of the Division of Coastal Management,Department of Environment and
Natural Resources at 400 Commerce Avenue, Morehead City NC 28557,within 20 days of
the permit decision. (Appropriate forms are available at the Washington Regional Office or
hops://deq.nc.gov/about/divisi ons/coastal-management/coastal-management-
