REGAN NC. .Secretor, Coastal Management BRAXTON DAVIS ENVIRONMENTAL QUALITY Director BUFFER AUTHORIZATION CERTIFICATE FOR PIER AND DOCKING FACILITIES ACCESS WAY A riparian buffer authorization is required for pier and docking facilities access ways through the Tar-Pamlico & Neuse River Riparian buffer per Division of Water Resources (DWR) regulations 15A NCAC 02B.0233 84 .0259. The Division of Coastal Management (DCM), through a Memorandum of Understanding with the Division of Water Resources (DWR) has reviewed your project proposal and has determined that the project as proposed complies with the aforementioned regulations. Those activities covered by your Coastal Area Management Act(CAMA) permit have received Buffer Authorization provided the project is constructed in a manner that continues to meet all of the conditions listed below. Failure to comply with this Buffer Authorization may subject the property owner and the party (contractor) performing the construction and/or land clearing to a civil penalty by DWR of up to $25,000 per day per violation. i. Crossing is Perpendicular: Pier and docking facility access way must cross the 50 ft. riparian buffer perpendicularly(which is defined as between 75 and 105 degrees) unless otherwise approved by DCM. The alignment shall minimize the removal of woody vegetation to the greatest extent practicable. 2. Pervious Materials: All reasonable measures shall be taken to ensure the access way is made of pervious materials like open-slatted wood or composite, mulch, or grass to meet the intent of the rules to the maximum extent practicable. 3. Access Width: The width of the pier or docking facility access way shall be limited to six (6) feet. A. Project Drawing: The drawing on the CAMA General Permit is considered the project drawing of your property indicating the relative location of the pier or docking facility and any requested access way. My wife and I just returned from Mexico,and while I was down there, I could not check my voice messages. When Mr. McGahey removed the existing house from his property last year and began construction of this new house,he raised the elevation slightly on his property,and that has had serious effects on our drainage(and the health of our septic tank which sits near the lake he has created on our property line). Now,as you know,he has come in and added several more truckloads of dirt to the buffer zone to further elevate his property. When I expressed my concerns,he told me it was his property and he could do whatever he pleases on his side of the property line. Now he wants to build a retaining wall for his elevated property. This will further the negative effects on our property not necessarily due to the water draining from his roof/yard but more towards flood control Our properties(and the one on the other side of my house)are the lowest elevation in the neighborhood. This meant that,prior to his new construction,we all shared the return drainage of river flooding from the fields and ponds behind our houses. By elevating property again,he is reducing the area where the water can drain back out to the river to just the other two properties. This will intensify the flood levels and drainage time for properties. By adding all that dirt,he is increasing the burden on our properties,especially mine. I cannot just agree to this knowing our flood exposure will be worsened. He should not have brought that dirt into the buffer zone,and I am pretty sure he knows that his actions will negative affect our property. I think he should have to reduce the dirt level in the buffer zone and instead of a retaining wall,he should reconfigure the drainage ditch so that it drains back to the river like it used to. My neighbor on the other side had her landscapers repair the ditch on our property line and now it drains much better. That would be preferred over his retaining wall idea.
