SUBJECT: Basin only addendum to the Moratorium Relief Request for Permit No. 19-20
Asbury Beach HOA, Carteret County, North Carolina
Dear Ma'am:
This letter is in response to the above referenced CAMA permit relief request received by the
DCM Morehead City office by email on April 15, 2020. To review this request, we coordinated
with the Division of Marine Fisheries and NC Wildlife Resources Commission.
This addendum to the original request is to dredge the basin starting no later than June 1" and
requested a total of 10 days. In consultation with the resource agencies authorization was given
with the following conditions:
1. The relief request is granted for the basin only, no dredging of the open water channel
is authorized.
2. Excavation shall not exceed -3.6 feet below the mean low water level within the basin. In
no case shall the depth of excavation exceed the depth of connecting waters.
3. The basin portion of the dredge template can occur with a turbidity curtain placed at the
mouth of the basin. The turbidity curtain shall remain in place for at least a 24-hour
period after completion of excavation or until the project areas has returned to ambient
conditions, whichever is greater, to prevent unnecessary siltation into the adjacent water
body.
4. The applicant has expressed that the dredging may occur earlier than June 1, 2020, in any
case the relief request if granted for a maximum of 10 days from the start of the
project. The 10-day work window must conclude by no later than June 10, 2020. The
sediment curtain removal is not part of the 10-day work window.
5. Every effort should be made to start and finish the project as early as possible. The
resource agencies have expressed that any request for additional time will not be granted.

6. The applicant shall notify the Division by email and on the day of occurrence, the start
date, end date and removal date of the turbidity curtain.

WRC concurs with DMF that a one-time 10-day allowance to dredge within the basin may occur as long as a turbidity
curtain is installed.
The email from Trish Moss states the contractor estimates the work to last for 10 days, so if the project starts on June 1,
it must conclude by June 10. The email also states the contractor may get to the site earlier than June 1. Perhaps the
allowance should be stated that a 10-day working window is allowed within the basin as long as a turbidity curtain is
installed. The 10-day working window must conclude by June 10.
Something tells me if we don't say that they can work earlier than June 1 that we will get an email in about 3 weeks
asking if they can start.

It means I'm contemplating or forgot about it.
In this case, DMF will not object to this one time request to dredge the basin for a maximum of 10 days, starting no later
than June 1, and using a turbidity curtain.
To clarify, they will not dredge the canal now but the town may request a minor cleanout permit later? What is a
cleanout permit?

Yes you are correct according to the engineered survey the canal leading into the basin in the center is from 4 feet deep
to 4.8 feet deep.

ending our contract with our contractor -Sawbucket dredging - Doug Niceley. Several reasons- bottom line not able to
fulfill their contractual obligations, equipment broke ,then after he got it fixed , they did not show back up for several
days. They both lost their phones and did not communicate for 5 days, even though we tried emailing to computer,
text to employee asking for return call etc.The list goes on without getting into his legal or personal matters.

was to get this done by Memorial Day since it was in last years budget.

Afternoon Trish,
Please see above for the one time authorization to dredge the basin with a turbidity curtain with additional conditions.
In summary you have 10 days to complete the job and the job must finish by June 10th at the latest. If you start early,
which is preferred, you have 10 days from that start date to finish. Please email Heather and I the day of the start, finish
and when the curtain is removed. The removal of the curtain is not part of the 10 day limit, only the activity of dredging,
so keep the curtain up as long as needed to allow for the sediment to settle.

basin to be completed at any time as long as the turbidity curtain was used. At this point the open water channel's
deadline is April 10th. I will send the request to dredge the basin with the turbidity curtain by Bentley, but I'll need to
know a start date and overall number of days proposed. With it being 3pm on Thursday, with Friday being a holiday, I'm
not hopeful I would.get a quick response anyway. When you have that info please let me know and I will coordinate.

ending our contract with our contractor -Sawbucket dredging - Doug Niceley. Several reasons- bottom line not able to
fulfill their contractual obligations, equipment broke ,then after he got it fixed , they did not show back up for several
days. They both lost their phones and did not communicate for 5 days, even though we tried emailing to computer,
text to employee asking for return call etc.The list goes on without getting into his legal or personal matters.

was to get this done by Memorial Day since it was in last years budget.
