RE: MODIFIED RESTORATION AGREEMENT FOR CAMA VIOLATIO #05-38D `.
Dear Mr. Stencil
This letter confines that as of June 27, 2005, review comments from local, state and federal resource agencies have been
received for the project located at 502 Trade Winds Drive adjacent to the North Galleon Bay Canal located off North New
River Inlet Road, in North Topsail Beach, Onslow County, North Carolina. Therefore, I am requesting the following modified
restoration requirements, the dredge spoil material be moved from 502 Trade Winds Dr. to lots 24 & 25 Galleon Bay as
proposed on the plans dated 03-07-2005, sheet 3 of 3 (attached). In addition, the site at 502 Trade Winds shall be graded
and stabilized. A properly installed silt fence shall be installed, and remain in place around the lot and be maintained until it
has been stabilized with vegetation.
The enclosed Restoration Plan describes the action necessary to bring this project into compliance with the Act. If you
intend to cooperate with my request, please sign one of the attached Restoration Agreements and return it to me in the
enclosed, self-addressed envelope within ten (10) days of receipt of this letter. Failure to comply with this request or respond
back to this office prior to the requested deadline with an acceptable schedule for compliance will be interpreted as a refusal
to cooperate and will result in a Notice of Continuing Violation, as well as a court injunction being sought ordering
compliance.
Thank you for your time and cooperation in resolving this important matter. If you have any questions about this or related
matters, please call me at (910) 796-7215. Upon completion of the restoration as requested in the Restoration Plan
Agreement to the satisfaction of the Division of Coastal Management, you will be notified as to the amount of the civil
assessment for undertaking development without first obtaining the proper permit(s) and/or development that is inconsistent
with Coastal Resources Commission rules.

I, Mr. Freddie Stancil, agree to move the spoil material from 502 Trade Winds Drive to lots 24 & 25 Galleon Bay as
proposed on the plans dated 03-07-2005, sheet 3 of 3 (attached). In addition, the site at 502 Trade Winds shall be graded

I agree to complete this restoration to the satisfaction of the Division of Coastal Management (DCM) by July 27, 2005, or
provide an explanation for non-compliance and a reasonable request for time extension. When corrective actions are
complete, I will notify the DCM so the work can be inspected.

It is the policy of the Coastal Resources Commission to levy a minimum civil assessment $350 and higher against all
violations of this type depending upon the damage to the resources. If restoration is not undertaken or satisfactorily
completed, a substantially higher civil assessment will be levied and an injunction sought to require restoration.

RE: NOTICE OF VIOLATION AND REQUEST TO CEASE UNAUTHORIZED DEVELOPMENT

Dear Mr, Stancil:
This letter confirms that on June 2, 2005, 1 was onsite at your property located at 502 Trade Winds Drive
adjacent to the North Galleon Bay Canal located in North Topsail Beach, off North New River Inlet Road,
Onslow County, North Carolina. The purpose of the visit was to investigate unauthorized development of a 149'
bulkhead, excavation of a boat basin, and maintenance dredging within the North Galleon Bay Canal. On June
3, 2005 we spoke over the phone concerning why the work on your property had been done while your Major
Permit Application was still under review. You stated that when you received the Approval of 401 Water Quality
Certification (DWQ Project #050564) you thought that this was your CAMA Major Permit. We discussed the fact
that this was not your CAMA Major Permit but just a general certification from DWQ for the proposed work. On
Tuesday June 7, 20051 spoke with Pat Antinori and A.D. Register on site and verbally told them to stop all work
and install a silt fence around the spoils and also along the perimeter of the bulkhead to prevent any sediments
from entering the canal.
Information gathered by me for the Division of Coastal Management indicates that you have undertaken major
development in violation of the Coastal Area Management Act (CAMA). No person may undertake major
development in a designated Area of Environmental Concern (AEC) without first obtaining a permit from the
North Carolina Department of Environment and Natural Resources. This requirement is imposed by North
Carolina General Statute (N.C.G.S.) 11 3A-1 18.
Information I have indicates that you have undertaken, or are legally responsible for the installation of 149 linear
feet of bulkhead, of which 64' was installed an average of 9' waterward of Normal High Water (NHW), the
excavation of a 16' x 42' boat basin into high ground, the maintenance dredging of a 64' x 44' x -6.1' @ MLW
section of the Galleon Bay North Canal, and the storage of spoil material on the site without installing the proper
sedimentation control measures on the aforementioned property. This activity took place in Estuarine Waters,
Estuarine Shoreline, and Public Trust Areas that are contiguous with the North Galleon Bay Canal. Estuarine
Waters (EW), Estuarine Shoreline (ES), and Public Trust Areas (PTA) are designated as Areas of
Environmental Concern (AEC). No permit was issued to you for work in this area. Based on these findings, I am
initiating an enforcement action by issuing this Notice of Violation for violation of the Coastal Area
Management Act.

I request that you immediately CEASE AND DESIST any further unauthorized development within designated
Areas of Environmental Concern. A CAMA Major Permit Application is under review by the N.C. Division of
Coastal Management (DCM) and the permit decision was pending comments from other resource agencies.
DCM will coordinate with other resource agencies to determine if this project could have been permitted.
Pending comments from the other resource agencies and review of our use standards for EW, ES, and PTA
AECs, restoration in addition to the installation of the aforementioned silt fence may be required. Based upon
the North Carolina Administrative Code, Title 15A, Subchapter 07H. State Guidelines for Areas of
Environmental Concern, if the activity you have undertaken, the installation of a 149 linear feet bulkhead, the
excavation of a high ground boat basin, and maintenance dredging of the canal in the Estuarine Waters,
Estuarine Shoreline and Public Trust Area AEC(s), is not consistent with Section 15A NCAC 7H .0208 Use
Standards (b)(1)(E),(F),(J) and (b)(7)(B),(C),(D)(i-v), you will be required to restore all affected areas to their
conditions prior to the unauthorized development activity. A civil assessment of up to $2,500 may be assessed
against any violator. Each day that the development described in this notice is continued or repeated may
constitute a separate violation that is subject to an additional assessment of up to $2,500. An injunction or
criminal penalty may also be sought to enforce any violation in accordance with N.C.G.S. 1 13A-1 26.
It is the policy of the Coastal Resources Commission to levy a minimum civil assessment of $350 not to exceed
$2,500 against all violations. This is done to recoup some of the costs of investigating violations and/or to
compensate the public for any damage to its natural resources. Whether a higher amount will be assessed
depends on several factors, including the nature and area of the resources that were affected and the extent of
the damage to them. If the requested restoration is not undertaken and completed satisfactorily, a substantially
higher civil assessment will be levied and a court injunction will be sought ordering restoration.
The relevant statutes and regulations are available from this office, and I am willing to assist you in complying
with the requirements of these laws. A site inspection will be made in the immediate future to determine
whether this REQUEST TO CEASE AND DESIST has been complied with. I request that you contact me
immediately.
Thank you for your time and cooperation in resolving this important matter. If you have any questions about this
or related matters, please call me at (910) 796-7215. After consultation with the appropriate resource agencies
you will be notified of any additional required restorations. Finally, pending completion of any and all required
restoration, you will be notified as to the amount of a civil assessment for undertaking development without first
obtaining the proper permit(s).
