RESTORATION ACCEPTANCE— CAMA WOLATION #05-11A Morehead City DCM Dear Mr. Harris: This letter is in reference to the Notice of Violation # 05-11A sent to you dated August 31, 2005 for the excavation of estuarine shoreline, the installation of pilings for the construction of a pedestrian ramp, the installation of numerous pilings for a bulkhead, the installation of pilings for a proposed dock, and the installation of riprap groins within the Estuarine Waters, Estuarine Shorelines, and Public Trust Areas in or near the Pamlico Sound. The violation tooK place on your property locatea at z44riz i%, Iz m or near me community of Waves in Dare County, North Carolina. This unauthorized activity constituted development and you were requested to: 1. Remove the 18 pilings associated with the construction of a pedestrian ramp, or incorporate this proposed development within a major permit application associated with a request for a dock and/or small boat launching platform; 2. Remove the 2 pilings associated with the construction of a proposed dock, or incorporate this proposed development within a major permit application; 3. Remove all riprap groin material placed in excess of the limitations of General Permit 40262A, or incorporate this proposed development within a major permit application, providing the site specific conditions that would justify groin structures of these lengths. 4. Remove the approximately 50 bulkhead pilings that have established a bulkhead alignment that is approximately an average of 33 feet beyond Normal Water Level. In accordance with the North Carolina Administrative Code, Title 15A, Subchapter 7J.0410, any violation involving development which is inconsistent with guidelines for development within Areas of Environmental Concern (AEC) must be corrected by restoring the project site to pre -development conditions to recover lost resources or to prevent further resource damage. I conducted a site visit at the aforementioned property on November 18, 2005 to inspect the restoration of the unauthorized activity addressed in the Notice of Violation 05-11A. Based on this inspection and your recent submission of a major permit application, it appears the restoration is accomplished to the satisfaction of this Division. Also present at this meeting was Mr. Jeff Emanuelson (Emanuelson and Dad) and Mr. Brian Rubino (Quible and Associates). The purpose of the visit was to determine if groin and bulkhead development activity was continuing under General Permit 40262A which had expired on April 26,2005. Information gathered by me for the Division of Coastal Management (DCM) indicates that you have undertaken major development in violation of the Coastal Area Management Act (CAMA). No person may undertake Major Development in a designated Area of Environmental Concern (AEC) without first obtaining a permit from the North Carolina Department of Environment and Natural Resources. This requirement is imposed by North Carolina General Statute (N.C.G.S.) 11 3A-1 18. I have information that indicates you have undertaken or are legally responsible for the excavation of estuarine shoreline, the installation of pilings for the construction of a pedestrian/boat ramp, and the installation of pilings for a proposed dock on the aforementioned property, for which no CAMA or Dredge and Fill Permit had been issued. In addition, I have information that you have installed numerous pilings for a bulkhead not consistent with the alignment authorized under General Permit 40262A, and have installed riprap groin structures with dimensions in excess of those authorized under General Permit 40262A. These activities took place in Estuarine; Waters, Estuarine Shorelines, and Public Trust Areas that are contiguous with the Pamlico Sound. Estuarine Waters, Estuarine Shorelines, and Public Trust Areas are designated as Areas of Environmental Concern (AEC). General Permit 40262A was issued on January 25, 2005, and it expired on April 26, 2005. No additional permit was issued to you for work in this area. A civil assessment of up to $2,500 may be assessed against any violator. Each day that the development described in this notice is continued or repeated may constitute a separate violation that is subject to an additional assessment of up to $2,500. An injunction or criminal penalty may also be sought to enforce any violation (N.C.G.S.113A-126). It is the policy of the Coastal Resources Commission to levy a minimum civil assessment of $500.00 not to exceed $2,500 against all violations. This is done to recoup some of the costs of investigating violations and/or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed depends on several factors, including the nature and area of the resources that were affected and the extent of the damage to them. You are also in violation of the State's Dredge and Fill Act which requires a permit from the North Carolina Department of Environment and Natural Resources before undertaking any excavating or filling in any estuarine waters, tidelands, marshlands, or state-owned lakes pursuant to N.C,G.S. 113-229. Therefore, I also request that you immediately CEASE AND DESIST such unauthorized activity and contact me about this matter as well. Violations of the State's Dredge and Fill Act may be enforced by a criminal penalty or a civil action for damages or an injunction in accordance with N.C.G.S.113-229. Based upon the North Carolina Administrative Code (NCAC), Title 15A, Subchapter 07H. State Guidelines for Areas of Environmental Concern, Subchapter 07J. Procedures for Handling Major Development Permits, and the North Carolina General Statutes (GS) the activities you have undertaken and relevant inconsistencies are summarized below: • The excavation of 420 square feet (35 feet by 12 feet) of estuarine shoreline is not consistent with GS 113-229(a), 15A NCAC 07J.0201, and 15A NCAC 07H.0209; • The installation of 18 pilings up to 55 feet beyond normal water level for the construction of a pedestrian/boat ramp is not consistent with 15A NCAC 07J.0201, and 15A NCAC 07H.1305(a) and (b); • The installation of 50 bulkhead pilings an average of 33 feet beyond normal water level is not consistent with the development authorized under General Permit 40262A and 15A NCAC 07H.0206, 15A NCAC 07H.0207,15A NCAC 07H.0208(b)(7),15A NCAC 07H.1102(b)(1) and (c); • The installation of riprap groins is not consistent with the development authorized under General Permit 40262A, and 15A NCAC 07H.0206,15A NCAC 07H.0207,15A NCAC 07H.0208(b)(9)(A) in that the dimensions exceed those authorized by the General Permit, with the northern groin being approximately twice the length authorized; and • The installation of two pilings approximately 100 feet offshore for a proposed dock is not consistent with 15A NCAC 07J.0201. Failure to comply with this request or respond back to this office prior to the requested deadline with an acceptable schedule for compliance will be interpreted as a refusal to cooperate and will result in a Notice of Continuing Violation, as well as a court injunction being sought ordering compliance. If you intend to cooperate with my request, please accomplish the required onsite restoration, and submit the required major permit application by September 30, 2005. I want to be sure that I understand what's going on with the restoration/compliance request. I know we don't issue after -the -fact permits and need clarification on this one. Could you or John call or e-mail me and please clarify for my own self -edification what we are requesting in this case? On most typical cases, if the unauthorized development could have been permitted, we allow the structures/development to remain. Otherwise, if inconsistent with the rules, it must be restored and/or brought into compliance. In violations where we are unsure (in this case?) if we could have permitted the development, we normally issue the cease and desist (restoration pending template) and hold off requesting restoration until we consult with the other resource agencies. Then we have them apply for a permit to finish the rest of the development, which might be the case here from what I am gathering. But I want to be sure so I would appreciate further information on this case. The applicant had submitted a major permit application for pretty much what they have begun to build at this location. Dennis kept it around for a long time, approximately 74 days, and then convinced the consultant to withdraw the application. At that time, he issued a GP to build a bulkhead forward of coastal wetlands (which Ted T. has made a decision that he does not wish to claim and require restoration, given the Dennis situation and the fact that COE will not claim them because they lack hydric soils), construct two groins and a pier. John Cece checked on the activity that he saw taking place and asked to see their permit. The GP was by that time expired, and the bulkhead alignment went out in a "V" from the north and south boundary lines, contrary to the straight alignment that Dennis had depicted on the GP. However, Dennis had not staked the alignment, but rather allowed the consultant to stake the alignment and then indicated verbally that he concurred with the alignment that the consultant had staked. This alignment was way out there, 15 to 30 feet beyond the actual NWL. One groin was built way beyond, about 50' past what the GP allowed and both groins were higher than a GP would allow. The pier was being constructed in a position that was not authorized. However, both the groins and the pier could be allowed under a major permit. When John, Frank, and I met with Joe Lassiter of Quible, to indicate that they would be getting a NOV and that restoration would be required because of the bulkhead forward of the wetlands and way beyond NWL, he requested that he be allowed to resubmit the Major Permit that he felt they were hoodwinked into withdrawing by Dennis. I indicated to him that this would be irregular in that we do not allow after the fact permitting, but that I would put his request forward to Ted Tyndall when I spoke with him. Ted T. was adamant that the bulkhead would have to be removed, but that he would be willing to listen to Joe's arguments, given the situation. Subsequently, Ted T. and Joe talked, and you conveyed to us that Ted T. had agreed to requiring the limited restoration on the points where he felt a major permit would not authorize, and to leave the other issues in abeyance until such time as the major permit was reveiwed. Roy, I have not reviewed the file on this, and am just giving the story to you by memory, so my measurements and recall may be a little off.
