This letter is in reference to the Notice of Violation dated October 17, 2005 that Jennifer O'Brian,
Local Permitting Officer for the Village of Bald Head Island, issued to you for unauthorized
development of a system to pump storm water without a permit at 270 Cladach Court, adjacent
to the Atlantic Ocean in Bald Head Island, Brunswick County. The violation involved an Ocean
Erodible Area and a High Hazard Flood Area, which are Areas of Environmental Concern
designated by the Coastal Resources Commission.
The Coastal Area Management Act provides that a civil assessment of up to $2,500 may be
assessed for any violation. It is the policy of the Coastal Resources Commission to assess a
civil penalty for all violations in order to recover some of the costs of investigating violations

a civil assessment to be levied against you consistent with the North Carolina Administrative
Code, Title 15A, Subchapter 7J, Section .0409, as adopted by the Coastal Resources
Commission.
