After making a site inspection on March 12, 2019 I have determined that the activity you propose to replace the walkway to the ocean in the exact same footprint as existing is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received March 12, 2019 stamped by Gary Gurganus and dated 2-21-2019 with notes and meet the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. STRUCTURAL ACCESSWAY EXEMPTED CONDITIONS BELOW: 1. The accessway must not exceed 4 feet in width and shall provide only pedestrian access to the ocean beach. 2. The accessway shall be a minimum of 5 feet from the property line. 3. The accessway must be constructed so as to make no alterations to the dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. Construction of the accessway be shall consistent with all other applicable local ordinances and N. C. Building Code standards. 5. The walkway shall meet all conditions of the Holden Beach Chapter 94. 5. A as built survey is required prior to final inspection so that we verify that the walkway meets all town ordinances and exemption conditions. 6. Clearly visible numbers that meet requirements of town ordinance 157.087 shall be in place prior to the final inspection. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter.
