After making a site inspection on January 9, 2019 I have determined that the activity you propose is exempt from needing a minor development permit as long as it remains consistent with your site drawing dated received January 9, 2019 and meet the conditions specified below. If you plans should change and your project will no longer meet these conditions, please contact me before proceeding. STRUCTURAL ACCESSWAY EXEMPTED CONDITIONS BELOW: 1. The accessway must not exceed 4 feet in width and shall provide only pedestrian access to the ocean beach. 2. The accessway shall be a minimum of 5 feet from the property line. 3. The accessway must be constructed so as to make no alterations to the dunes. This means that the accessway must be constructed on raised posts or pilings of five feet or less in depth, so that wherever possible only the posts or pilings touch the frontal dunes without any alteration to the dunes. In no case shall the frontal dune be altered so as to significantly diminish its capacity as a protective barrier against flooding and erosion. 4. Construction of the accessway be shall consistent with all other applicable local ordinances and N. C. The lot shall have more than 300 feet from the seaward toe of the frontal dune to the last line of natural stable vegetation, as determined by the local CAMA officer, may install a single walkway with a 4 feet inside width; the walkway shall be a minimum of 3 feet high above the vegetation with a maximum height not to exceed 4 feet; and shall terminate at the last line of natural stable vegetation. 5. A as built survey is required prior to final inspection so that we verify that the walkway meets all town ordinances. 6. Clearly visible numbers that meet requirements of town ordinance 157.087 shall be in place prior to the final inspection. This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any other State, Federal or Local authorization. This exemption expires 90 days from the date of the letter.
