Dear Mr. Logan:
This letter is in reference to the February 6, 2014 visit onsite at SHP&L Investors, LLC property
at 808 Howe's Point Place, in Wilmington, New Hanover County, North Carolina. The purpose
of the onsite visit was to investigate unauthorized development on the aforementioned property in
the ORW Estuarine Area of Environmental Concern (AEC). I also hat a telephone conversation
with Dustin Jones on February 6, 2014..
Information gathered by me shows that your actions as contractor for SHP&L Investors, LLC
are in violation' of the Coastal Area Management Act (CAMA). No person may undertake minor
development in a .designated Area of Environmental Concern without first obtaining a permit
from the North Carolina Department of Environment and Natural Resources, North Carolina
General Statutes (N.C.G.S.) 113A-118.
I have information that you have undertaken, or are legally responsible for, minor development by
clearing and starting construction on a single family residence, including the digging of footers on
the aforementioned property. This activity took place in ORW Estuarine Area of Environmental
Concern that is contiguous with the Howe's Creek. ORW Estuarine areas are designated as
Area(s) of Environmental Concern (AEC).
You are hereby requested to STOP WORK IMMEDIATELY. The property owner or
authorized agent must file the necessary application with this office for a CAMA Minor
Development Permit by February 26, 2014. NO WORK MAY PROCEED UNTIL THE

PERMIT IS ISSUED. If you comply voluntarily, no fiuther action will be necessary beyond the
issuance of a permit.
Failure to file an application or continuation of work after receipt of this Notice may constitute a
violation of the Act and you may be subject to civil and/or criminal penalties as provided by
North Carolina General Statute (NGGS) 113A-126. Each day that the development described in
this Notice is continued or repeated may constitute a separate violation that is subject to an
additional assessment of $1,000. An injunction or criminal penalty may also besought to enforce
any violation in accordance with NCGS 113A-126.
Since this is your first documented offense, there will be no assessment levied against you.
However, if you continue to violate the Coastal Area Management Act, you should consider
yourself forewarned and expect a civil assessment to be levied against you consistent with the
North Carolina Administrative Cod&, Title 15A, Subchapter V, Section ,0409,, as adopted by the
Coastal Resources Commission.
Thank you for your time and cooperation in resolving this important matter. The relevant statutes
and regulations are available from this office, and I am willing to assist you in complying with the
requirements of these laws. ' A site inspection will be made in .the near future to determine
whether this STOP WORK ORDER has been complied with. I request that you contact me
immediately about these important matters

808 Howe's Point Place — CAMA violation

On February 6, 2014 while posting a notice for CAMA:permit for 801 Howe's Point Place linoticed that
work was ongoing at the above address. I knew that I'hadn't issued a minor CAMA.permit for this
address. I returned to the office and upon further research found that no permit had been issued. I
called the contact person (Dustin Jones) listed on the building permit which should not have been
issued, an explained that a CAMA minor permit was necessary for this pr6ject.-1 told him that work
needed to stop until a CAMA permit was issued. I also explained the procedures for getting.a permit and
a SFR exemption: I was out of work on the 7th and then we had a week of bad weather. On Monday,
February 17, 2014 having not received an application from the contractor, I again visited the site. During
this visit I spoke with some construction workers who stated Dustin was in Leland. Work had progressed
to the point that footings were dug and rebar installed. I told those on site that work must stop. Before,'I
left I saw them gathering up the equipment.
Once I return to Gov. Center I proceed to have astop work order issued. They also had an inspection
called in for the following day which,: also had stopped. New Hanover County posted the Stop work
order at 11:05 on February 18, 2014.
I spoke with Robb Mairs on February 6th about this and also called the City of Wilmington who released
the zoning portion of the permit which should have caught the need for a CAMA minor permit. On the
17'h I'spoke with Tara MacPherson and started the process for a CAMA violation and stop work order,
