Good morning Braxton,
I have another situation where there has been severe erosion recently adjacent to a soundside
dwelling and I wanted to get your thoughts on using the 07H .1700 Emergency GP for a
bulkhead. This is a similar situation to the .1700 bulkhead GP we issued in Bertie County in
2020 where NWL was encroaching on the pilings of the structure. I've attached a .pdf file with
on ground pictures from this past Wednesday (2/16/2022). As of now, we have not spoken to
the owner about using the .1700 GP, this is just to get ahead of the game in case it comes up.
Yvonne visited the site on 9/1/2021 (Page 1 picture) for a bulkhead consultation, and at that
time there was a strong SW wind so the water was high and above the NWL, but Yvonne
estimated that there was —22' between the SW piling of the structure and the water level.
Shortly after that visit, the property was sold and the new owner hired a contractor to start
the bulkhead GP process. This was one of the situations I have brought up in a DM meeting
where the southern adjacent riparian owner objected due to erosion concerns from the return
wall and the guidance was to see if the two could reach a design where the objection was
removed, otherwise a major permit application would have to be submitted due to the
legitimate erosion concerns (similar to the Randolph case). At this time, a compromise
between the two has not been made, but we have heard that they are discussing options and
a different contractor may be involved now. The applicant has reached out to us indicating he
has been having erosion and on Wednesday, while meeting with Doug Dorman, he told us he
was asked to look at the site that morning and he let us know that there has been significant
erosion, so Yvonne and I decided to go check it out since we were in the area.
Page 2 & 3 of the .pdf file shows where we flagged the current NWL in relation to the SW
piling of the structure (water level was estimated to be 8"-10" low due to northerly winds). We
measured 6' from the piling to NWL with an erosion escarpment forming on the landward side
of the piling. The stakes in the pictures are where we laid out the potential bulkhead
alignment not exceeding 20' from the structure (see pages 4 & 5).
