Statement of Compliance and Consistency
This permit is subject to compliance with this application and permit conditions. Any violation of these terms m4y
subject the permittee to a fine or criminal or civil action; and may cause the permit to become null and void.
This permit must be on the project site and accessible to the permit officer when the project is inspected for
compliance. The applicant certifies by signing this permit that: 1) prior to undertaking any activities authorized by this
permit, the applicant will confer with appropriate local authorities to confirm that this project is consistent with the
local land use plan and all local ordinances, and 2) a written statement from the adjacent riparian property owner(s)
has been obtained, or proof of delivery of certified mail notification of the adjacent riparian property owner(s).
The State of North Carolina and the Division of Coastal Management, in issuing this permit under the best available
information and belief, certify that this project is consistent with the North Carolina Coastal Management Program.

Based on the information that you provided (pictures, field summary)
It does not appear that 404 wetlands will be impacted by the bulkhead project.
The Corps has determined that your client may install the bulkhead behind the coastal vegetation line.

I think the bulkhead would be ok if placed on the slope directly behind the grass line (not sure what that is, but looks like one of the
coastal grasses) In between the tree and grass line in photos 4 & 5.

Hey Gary,
I have attached a pdf with some pictures of a lot in Oak Island (118 SE 7th St.). The property is proposing to put a bulkhead landward
of the coastal wetland line. There is an elevation change and sandy soil landward of the elevation change but I wanted to get your
opinion on potential 404 that may be claimed by USACE. Can you share whether or not you would need to make a site visit or if you
can make a desktop determination with picturestlidar?
