as authorized by the State of North Carolina, Department of Environmental Quality
and the Coastal Resources Commission for development in an area of environment
concern pursuant to Section 113A-118 of the General Statutes, "Coastal Area
Management"
Issued to David and Susan Gray, authorizing development in the Estuarine Shoreline (AEC) at 204 North Shore
Drive West, in Sunset Beach, Brunswick County as requested in the permittee's application, dated April 18,
2017, initially received by the Division of Coastal Management on April 19, 2017 and handed over to the Town of
Sunset Beach on April 25, 2017 (at which point a letter of additional information was issued and final submittal of
this information was received by the Town on October 8, 2018). This permit, issued on October 17, 2018, is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable
regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee
to a fine, imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: Construction of a new two-story single family residence, minor site work, and a new retaining
wallibulkhead.
(1) All proposed development and associated construction must be done in accordance with the permitted site drawing
dated received by the Town on October 8, 2018.
(2) All construction must conform to the N.C. Building Code requirements, the Town of Sunset Beach Unified
Development Ordinance and all other local, State and Federal regulations, applicable local building and zoning
ordinances and NFIP Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation
and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at 910-579-6297 for a final inspection at
completion of work.

This permit action may be appealed by the permittee or other qualified persons
within twenty (20) days of the issuing date. This permit must be on the project
site and accessible to the permit officer when the project is inspected for
compliance. Any maintenance work or project modification not covered under
this permit, require further written permit approval. All work must cease when this
permit expires on:
December 31, 2021
In issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances. This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

Dear Mr. Gray:
On June 1, 2018, we sent you a letter requesting additional information for this project. This was a
reminder in a long list of communications between us seeking this additional information, the first of
which was on May 11, 2017. You have submitted various documents over the past year but have not
submitted the information for which we need: a final site design which displays all the relevant CAMA
AEC information, CAMA setbacks, Coastal Wetlands, reconfigured bulkhead, and the 404 wetlands as
determined by the ACoE.
To date, The Town of Sunset Beach LPO office has received no additional correspondence on this issue
since your reply on June 1, 2018. Therefore, you are requested to notify this office of your intentions
concerning the proposed project within 10 days of receipt of this letter. If a response is not received, we
will assume that you are not interested in pursuing Coastal Area Management Act authorization at this
time, and your application will be retired.

I had previously sent you a letter via email (April 25, 2017) requesting additional information for your permit applicati
for construction of a two-story single family residence. One of the items was that the survey/site plan needed to indic
a more recent marking for the high water line and requesting you to inform us when you were ready for us to flag. I h
not heard back from you yet and wanted to inform you that Mr. Sean Farrell reflagged the normal high water line at t
location on Wednesday May 10, 2017. Please use this line in your resubmission of the survey/site plan. We also notice
that it appears the property has been flagged by Army Core of Engineers for wetlands delineation. Please include this
information and the survey as well.

Dear Applicant:
We originally accepted your application under the impression that it was complete. On subsequent review, I
have discovered that additional information is needed to complete the review process. Accordingly, I am
requesting that you submit the following additional information to this office:
1. Show Coastal Shoreline 75' AEC on site plan, and include impervious surface calculations
specific to this 75' AEC. (Per 15A NCAC 07H .0209(d)(2) Impervious surface limited to 30%
within AEC unless accompanied by an approved stormwater plan.)
2. Clarify on site plan the location of the actual 30' buffer. Plan will also need to be updated with
a more recent flagging for the mean high water mark. Please contact us to let us know before
so that we can have the line marked.
3. Please also include the deed to the property.
In accordance with the Department of Environment and Natural Resources regulations, we note that a
certain time has passed while the application has remained in our office. Upon resubmission of a complete
application, a local decision will be made in 18 days remaining from the 25 day review period, provided this
period is not extended as provided by law.
