HomeMy WebLinkAbout146-01 Minor Mod 2005 River Dunes CorporationPermit Class MODIFICATION/NIINOR Permit Number 146-01 STATE OF NORTH CAROLINA Department of Environment and Natural Resources and Coastal Resources Commission Verint"t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to River Dunes Corporation, PO Box 1505, New Bern, NC 28563 Authorizing development in Pamlico County at Confluence of Broad Creek and Neuse River, SR 1317 (Orchard Creek Road), as requested in the permittee's letter received 12/03/04. This permit, issued on February 8. 2005 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) This minor modification authorizes the use of a hydraulic dredge for the excavation of 8000 cy of material as opposed to a clam shell and bucket barge with the condition that a turbidity curtain be installed around the project area. 2) This minor modification authorizes the temporary placement of dredge spoils in the partially excavated entrance canal. 3) In accordance with commitments made by the permittee, and earthen plug shall be left between the area to be excavated and Broad Creek, and a 24 hour period after completion of excavation shall elapse prior to plug removal to prevent unnecessary siltation into the adjacent water body. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2006 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature ofPermittee River Dunes Corporation Permit #146-01 Page 2.Of 2 ADDITIONAL CONDITIONS 4) The disposal area effluent shall be contained by pipe, trough, or similar device to a point at or beyond the mean low/normal water level to prevent gully erosion and unnecessary siltation. 5) The terminal end of the pipeline shall be positioned at or greater. than 0 feet from any part of the dike and a maximum distance from spillways to allow settlement of suspended sediments. 6) A water control structure shall be installed at the intake end of the effluent pipe to assure compliance with water quality standards. 7) The diked disposal area shall be constructed a sufficient distance from the mean high water level or any marsh to eliminate he possibility of dike erosion into surrounding wetlands or waters. 8) The spoil disposal area must be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 9) This minor modification must be attached to the original of Permit No. 146-01, which was transferred to the permittee on 7/13/04, as well as all subsequent modifications, refinements, and renewals, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 10) All conditions and stipulations of the active permit remain in force under this minor modification unless altered herein.
