This permit, issued on 1.9minry 13, 2006 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. 1) As depicted on the attached workplan drawings, this minor modification authorizes: a. the adjustment of the proposed property lines and road layout including the refinement of the layout for the riverside club, pool, walkways and chapel, b. the modification of the permitted entrance plan from SR1317, c. the relocation of the community service and marina building, d. the addition of a wellness and environmental education center, e. the elimination of the 200-boat dry stack storage facility, f. the modification from a vertical bulkhead around the marina basin to a keystone retaining wall with a sloped edge, g. the addition of a retaining wall approximately 4000' in length on the Neuse River, h. the addition of three infiltration ponds and, i. the addition of a gravel access road to the storage basin and (2) 8" water transmission lines, all as depicted in the attached workplan drawings. (See attached sheet for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. An appeal requires resolution prior to work initiation or continuance as the case may be. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000. We are forwarding Permit No. SW7060811 dated September 20, 2006, for the construction of the subject project. This permit shall be effective from the date of issuance until September 20, 2016, and shall be subject to the conditions and limitations as specified therein. Please pay special attention to the Operation and Maintenance requirements in this permit and in the submitted application. Failure to establish an adequate system for operation and maintenance of the stormwater management system will result in future compliance problems. IL SCHEDULE OF COMPLIANCE 1. The stormwater management system shall -be constructed in its entirety,.vegetated and operational for its intended use prior to the construction .of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded:areas:of<the system will be repaired immediately. 3. The permittee shall at.all times provide:the operation and maintenance; necessary to ,assure the permitted stormwater_ system -functions at, optimum,efficiency. The,approved Operation and Maintenance Plans must be followed in its entirety and maintenance must -occur at the scheduledintervals including, but not limited to: ,!;jmiannt aI scheduled inspections (every 6 months). This permit shall become;voidable,unless the facilities are constructed in accordance with the;condtions of this permit, the approved plans and specifications, and other supporting data. 6 Upon completion of construction, priorto issuance of a.Certificate of Occupancy, and pnonto.operation of this permitted, facility, a: certification must. be received from an appropriate designer for the system installed. certifying that;the permitted..facility, has been installed in accordance with this permit: the approved plans and specifications, and other supporting documentation. Any deviations from the approved:plans,and: specifications must be noted on the Certification. A modification may be required for those deviations: . 7. The stormwater systems shall not be used as Erosion Control devices They must be kept off line,and.free from sediment until the project is complete andrthe entire site has, been stabilized. 8. .Access to.the stormwater -facilities shall be. maintained via -appropriate easements at all times. 9. The permittee shall submit to :the Director and shall have received; approval for revised plans, specifications, and calculations prior to construction, for any modification tothe approved plans, including, but not limited to, those listed below: , a. Any revision to any, item shown on the approved plans, including.the stormwater management measures, built -upon area,,, details,;etc. b. Project name change. C. Transfer of ownership. d., Redesign or addition to the approved amount of built -upon area,or to,the,drainage. area. e. Further subdivision, acquisition, lease or, sale of all or part of the project area. The project area is defined as all property owned bythe.permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was ought:;. f; Filling in, altering, or piping of any vegetative conveyance shown on the, approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained .on file by.the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director,may.,notify the permittee when the,permitted site does not meet,one,or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum, requirements.,The permittee shall provide, copies of, revised plans and certificatiom in writing.to the Director that the changes have been made. . No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such asyswales) shown on.the approved plans as part of the stormwatermanagementsystem without, submittinga-revislonto the permit:and>receiving'approval from the, -,Division. 15. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ :personnel. The facility must be incompliance with all permit conditions: Any -items' not in . compliance -must be repaired or replaced -to design condition prior to; the transfer. Records`of maintenance activities performed to date will -be required' 16. III. GENERALCONDITIONS 1. This permit is not transferable except after notice to and approval by the Director, -'In the event of a change of ownership, or a name change, the permittee must submit a formal permittransfe Tequest to the Division of Water Quality, accompanied' by a completed name/ownership change form; documentation°from°the parties involved';-and';other supporting materials as may be appropriate. The approval of this request will: be:,: considered on its merits and may or may not be approved. The permittee is responsible for'corholiance-with all permit conditions, until such time -as the Divisionapprovesthe transfer request. 2. Failure toabide by the conditions and limitations contained in this permit may subject the Pe rrnittee,'to'enforcement action by the Divisionof Water Quality; in ac'cordance.with North Carolina General Statute 1'43-215:6A+to 1'43-215.6C. 3. The issuance ofthis permit does not- preclude --the Permittee from complying with any and all statutes, rules, regulations,-'or`ordinances, which maybe imposed: by other government agencies (local, state, and federal) having jurisdiction. 4 - Arf the event^that the,facilities fail to perform satisfactorily, including the -creation of nuisance conditions, the Permittee shall take immediate corrective action including '=those as may be required by_ thi"s`Division,`such ,as the construction oUadditional or replacement stormwater management systems; 5. Unless specified elsewhere, permanent seeding requirements for the stormwater control must follow th'e=guidelines established in the North Carolina'Erosionand Sediment Control"Planning'and' Design' Manual. 8. No homeowner/lot owner/developer shall be allowed to fill in, alter; or. pipe any vegetative practices (such as swales) shown on.the approved plans as.part of the stormwater management system without submitting a r-evi,sion to the ;permit and receiving approval from the rDivision. 9:e,_t Each of the -lots .in the subdivision will be -limited to the:,amount of-built-upon,a-rea indicated in the approved plans and consistent.with item 1-above. 4 10. The permittee is responsible- for .verifying: that the proposed home plans 'do not exceed the ..allowable built - upon area. Once the lot transferii"s.complete, the home plan may not be revised without approval.- from the permittee, and responsibility for meeting the built- -upon ° area limit is transferred to the" individual' ',homeowner. 11. Deed restrictions are incorporated into this permit by reference and must be recorded, with the Office of Register of Deeds. A copy of the recorded restrictions must be received by this 'Office within` 30, -days of the date -of -recording. Recorded deed restrictions must include, as a minimum, the following statements related to,s'tormwater management: " a. III. GENERAL CONDITIONS 1. Failure to abide by the conditions and limitations contained in this permit may subject the Permittee to an enforcement action by the Division of Water Quality, in accordance with North Carolina General Statutes 143-215.6A to 143-215.6C. 2. The permit, issued; shall ; continue in force.'- and��effect iuntil revoked or terminated. 3. The permit may be modified, revoked and, '.reissued or terminated for cause. This permit was originally issued to Weyerhaeuser Real Estate Development Companyon 11/20/01 for the construction of a 600 home subdivision, a 400-boat slip high ground marina basin, a boat ramp, and to install 11,300 ft of shoreline stabilization. The permit was transferred from Weyerhaeuser to Granite Investment Properties, LLC on March 17, 2003. It was then transferred from Granite Investment Properties, LLC to the River Dunes Corporation on July 13, 2004. The permit was renewed on December 13, 2004 and is set to expire on December 31, 2006. A minor modification of the permit was issued on February 8, 2005 to allow the use of a hydraulic dredge for the proposed excavation of the access channel as opposed to barge mounted excavator with a clam shell bucket. The community developer along with the many stakeholders, including numerous agencies within NCDENR have collaborated in a comprehensive planning approach that combines the health of the environment with the strength of the economy to enhance the character of the community. As the community has moved forward from concept to site design and now implementation, there have been refinements and actions taken that we hope will yet still improve the original plan. I will first give a brief permit history, followed by a summary review of several of our meetings in recent months, and then item by item cover the minor modifications that we are requesting to permit # 146-01. Permit #146-01 was originally issued to Weyerhaeuser Real Estate Development Company in 2001. Weyerhaeuser sold the tract to Granite Investment Properties in 2002, and the permit was transferred. In April, 2004 the property was sold to River Dunes Corporation and the permit was transferred to River Dunes Corporation and then renewed in December 2004. During this time the land plan has evolved with several minor refinements that we believe have enhanced the overall quality of the design and helped minimize impacts. Attached you will find the refinement to the original Conservation Development Plan dated 3/9/01. As discussed in our May 14, 2004 meeting we waited until just prior to platting lots so that any refinements would be as near complete as possible. Since our meeting with you and Ted Tyndall in May, 2004, there have been numerous meetings to discuss and update the community's progress. At our November 16a' meeting on site we had an opportunity to meet with you and Terri Barrett and go over the site plan, at a subsequent meeting on December P, in Morehead City we discussed how to handle the refinements and modifications. The following bullets will summarize the minor modifications to the site plan, all of which are shown on the new site plan that is attached for your review: 1. The original 600 lots and associated roads have been adjusted to improve the open space design and to include a 238 acre conservation easement established to further protect the Gum Thicket Creek Watershed. The original lot count and overall density have not changed. 2. The original entrance plan has been modified to improve the safety as recommended and approved by NCDOT. (see attached plan) As stated in the original permit, the entrance will be approved by NCDOT. 3. The site of the marina and community service buildings that are adjacent to the marina basin have been moved to better facilitate the traffic flow in the marina and to help centralize them in the village plan. There are still 400 slips in the marina with a pump out and fuel station. (see attached marina plan) 4. The residential areas around the marina, originally shown as village pods, have been further identified and planned by Historical Concepts. This plan follows the original concept of a maritime village around the marina basin with access to the boats in a protected environment. A wellness center and an environmental education center are being added and are shown on the latest refinement. 5. The 200 boat dry storage facility in the original land plan has been removed as it was deemed inappropriate for the site. The boat and RV storage yard will provide covered storage for boats with trailers as originally planned. 6. The bulkhead surrounding the marina basin has also been modified to accommodate a vegetated sloped edge with a keystone retaining wall. The original vinyl and concrete bulkhead material has been replace with a stone wall. The idea of a natural sloped edge around the basin was encouraged by several of the agencies. This material change was reviewed in our February 4a', meeting in Morehead City, specifications and samples were delivered with a letter identifying the change (see attached marina plan and cross sections) 7. The riverside club, pool area and the walkways, along with the chapel have been further designed and given more open space and public water views. A 1 to 2 foot high landscape retaining wall has been added to prevent sedimentation and erosion at the top of the slope, this will be approximately 50' from the NWL along the Neuse River frontage. For Drainage Area 6, a portion of the stormwater runoff, 2,615 cf, will be captured and treated in bioretention area BR-5. These two systems are to work in series in order to provide the minimum storage for the 1.5 inch design storm. 11. All eight (8) treatment systems are designed to bypass and/or overflow into a flow spreader prior to discharging across the minimum 50 foot Neuse Riparian Buffer. The flow spreaders are required to be regularly maintained at design conditions as shown per the approved plans. 12. Stormwater runoff in Drainage Area 4 is conveyed; to the infiltration trench 1-1 by the use of porous/permeable pavement. The porous/permeable pavement is required to be properly constructed, operated and maintained in accordance with the approved plans and signed Operation and Maintenance Agreement. 13. This permit covers the construction of lots 39-43 & 45-50 of Section 4A, lots 2-5, 8-10, 15-18, Common Areas 3-5 & the Guest Qtrs. of Harbor Village I, and lots 1-26 of Harbor Village II -A of River Dunes Marina & Residential Development. See Exhibit A for built upon areas per lot. II. SCHEDULE OF COMPLIANCE 1. The stormwater management system shall be constructed in its entirety, vegetated and operational for its intended use prior to the construction of any built -upon surface. 2. During construction, erosion shall be kept to a minimum and any eroded areas of the system will be repaired immediately. 3. The permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The approved Operation and Maintenance Plans must be followed in its entirety and maintenance must occur at the scheduled intervals including, but not limited to: a. Semiannual scheduled inspections (every 6 months). b. Sediment removal. C. Mowing and revegetation of slopes and the vegetated filter. d. Immediate repair of eroded areas. e. Maintenance of all slopes in accordance with approved plans and specifications. f. Debris removal and unclogging of bypass structure, filter media, flow spreader, catch basins, piping and vegetated filter. g. A clear access path to the bypass structure must be available at all times. 4. Records of maintenance activities must be kept and made available upon request to authorized personnel of DWQ. The records will indicate the date, activity, name of person performing the work and what actions were taken. 5. The facilities shall be constructed as shown. on the approved plans. This permit shall become voidable unless the facilities are constructed in accordance with the conditions of this permit, the approved plans and specifications, and other supporting data. 6. Upon completion of construction, prior to issuance of a Certificate of Occupancy, and prior to operation of this permitted facility, a certification must be received from an appropriate designer for the system installed certifying that the permitted facility has been installed in accordance with this permit, the approved plans and specifications, and other supporting documentation. Any deviations from the approved plans and specifications must be noted on the Certification. A modification may be required for those deviations. They must be kept off line and free from sediment until the project is complete and the entire site has been stabilized. , 8. Access to the stormwater facilities shall be maintained via appropriate easements at all times. ' 9. The permittee shall submit to the Director and shall have received approval for revised plans, specifications, and calculations prior to construction, for any modification to the approved plans, including, but not limited to, those listed,below: a. Any revision to any item shown on the approved plans, including the stormwater management measures, built -upon area, details, etc. b.. Project name change. c. Transfer of ownership. d. Redesign or addition to the approved amount of built -upon area or to the drainage area. e. Further subdivision, acquisition, lease, or sale of all or part of the project area. The project area is defined as all property owned by the permittee, for which Sedimentation and Erosion Control Plan approval or a CAMA Major permit was sought. f. Filling in, altering, or piping of any vegetative conveyance shown on the approved plan. 10. The permittee shall submit final site layout and grading plans for any permitted future areas shown on the approved plans, prior to construction. 11. A copy of the approved plans and specifications shall be maintained on file.by the Permittee for a minimum of ten years from the date of the completion of construction. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of revised plans and certification in writing to the Director that the changes have been made. 13. 1 This permit shall be effective from the date of issuance until June 26, 2016. Application for permit renewal shall be submitted 180 days prior to the expiration date of this permit and must be accompanied by the processing fee. 14. No homeowner/lot owner/developer shall fill in, alter, or pipe any drainage feature (such as swales) shown on the approved plans as part of the stormwater management system without submitting a revision to the permit and receiving approval from the Division. 15. Prior to transfer of the permit, the stormwater facilities will be inspected by DWQ personnel. The facility must be in compliance with all permit conditions. Any items not in compliance must be repaired or replaced to design condition prior to the transfer. Records of maintenance activities performed to date will be required. 1& Prior. to the sale of any lot, the following deed restrictions must be recorded: a. The following covenants are intended to ensure ongoing compliance with State Stormwater Management Permit Number SW7060507, as issued by the Division of Water Quality under NCAC 2H.1000. b. The State of North Carolina is made a beneficiary of these covenants to the extent necessary to maintain compliance with the Stormwater Management Permit. C. Alteration of the drainage as shown on the approved plans may not take place without the concurrence of the Division of Water Quality. f. The maximum built -upon area per lot is (see Exhibit A) square feet. This allotted amount includes any built -upon area constructed within the lot property boundaries, and that portion of the right-of-way between the front lot line and the edge of the pavement. Built upon area includes, but is not limited to, structures, asphalt, concrete, gravel, brick, stone, slate, coquina and parking areas, but does not include raised, open wood decking, or the water surface of swimming pools. g. Lots within CAMA's Area of Environmental Concern may be subject to a reduction in their allowable built -upon area due to CAMA regulations. h. All runoff on the lot must drain into the permitted system. This may be accomplished through providing roof drain gutters, which drain to the street, grading the lot to dram toward the street, or grading perimeter swales and directing them into the pond or street. Lots that will naturally drain into the system are not required to provide these measures. i. Built -upon area in excess of the permitted amount will require a permit modification. 17. A copy of the recorded deed restrictions must be submitted to the Division within 30 days of the date of recording the plat, and prior to selling lots. The recorded copy must contain all of the statements above, the signature of the Permittee, the deed book number and page, and the stamp/signature of the Register of Deeds. 18. III. GENERAL CONDITIONS 1. This permit is not transferable except after notice to and approval by the Director. In the event of a change of ownership, or a name change, the permittee must submit a formal permit transfer request to the Division of Water Quality, accompanied by a completed name/ownership change form, documentation from the parties involved, and other supporting materials as may be appropriate. The approval of this request will be considered on its merits and may or may not be approved. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. 2. Failure to abide by the.conditions and limitations contained in this permit may subject the Permittee to enforcement action by the Division of Water Quality, in accordance with North Carolina General Statute 143-215.6A to 143-215.6C. 3. The issuance of this permit does not preclude the Permittee from complying with any and all statutes, rules, regulations, or ordinances, which may be imposed by other government agencies (local, state, and federal) having jurisdiction. 4. In the event that the facilities fail,to perform satisfactorily, including the creation of nuisance conditions, the Permittee shall take immediate corrective action, including those as may be required by this Division, such as the construction of additional or replacement stormwater management systems. 5. The permittee grants DENR Staff permission to enter the property during normal business hours for the purpose of inspecting all components of the permitted stormwater management facility. This permit was originally issued to Weyerhaeuser Real Estate Development Company on 11/20/01 for the construction of a 600 home subdivision, a 400-boat slip high ground marina basin, a boat ramp, and to install 11,300 ft of shoreline stabilization. The permit was transferred from Weyerhaeuser to Granite Investment Properties, LLC on March 17, 2003. It was then transferred from Granite Investment Properties, LLC to the River Dunes Corporation on July 13, 2004. The permit was renewed on December 13, 2004 and is set to expire on December 31, 2006. A minor modification of the permit was issued on February 8, 2005 to allow the use of a hydraulic dredge for the proposed excavation of the access channel as opposed to barge mounted excavator with a clam shell bucket. Dear Mr. Lane: As described in the project narrative, River Dunes is a predominately residential community with an overall project density of approximately 1 residential living unit per 2 acres with associated marina, recreational and service amenities. The community developer along with the many stakeholders, including numerous agencies within NCDENR have collaborated in a comprehensive planning approach that combines the health of the environment with the strength of the economy to enhance the character of the community. As the community has moved forward from concept to site design and now implementation, there have been refinements and actions taken that we hope will yet still improve the original plan. I will first give a brief permit history, followed by a summary review of several of our meetings in recent months, and then item by item cover the minor modifications that we are requesting to permit #146-01. Permit 9146-01 was originally issued to Weyerhaeuser Real Estate Development Company in 2001. Weyerhaeuser sold the tract to Granite Investment Properties in 2002, and the permit was transferred. In April, 2004 the property was sold to River Dunes Corporation and the permit was transferred to River Dunes Corporation and then renewed in December 2004. During this time the land plan has evolved with several minor refinements that we believe have enhanced the overall quality of the design and helped minimize impacts. Attached you will find the refinement to the original Conservation Development Plan dated 3/9/01. As discussed in our May 14, 2004 meeting we waited until just prior to platting lots so that any refinements would be as near complete as possible. Since our meetingwith you and Ted Tyndall in May, 2004 there have been numerous C r Y Y Y> ., i�.,,y meetings to discuss and update the community's progress. At our November,16`h meeting on site we had an opportunity to meet with you and Terri Barrett and go over the site plan, at a subsequent meeting on December Yd, in Morehead Cit}r ve dis'ciisge'dlhow Iy to handle the refinements and modifications. The following bullets will summarize the minor modifications to the site plan, all of which are shown on the new site plan that is attached for your review: 1. The original 600 lots and associated roads have been adjusted to improve the open space design and to include a 238 acre conservation easement established to further protect the Gum Thicket Creek Watershed. The original lot count and overall density have not changed. 2. The original entrance plan has been modified to improve the safety as recommended and approved by NCDOT. (see attached plan) As stated in the original permit, the entrance will be approved by NCDOT. 3. The site of the marina and community service buildings that are adjacent to the marina basin have been moved to better facilitate the traffic flow in the marina and to help centralize them in the village plan. There are still 400 slips in the marina with a pump out and fuel station. (see attached marina plan) 4. The residential areas around the marina, originally shown as village pods, have been further identified and planned by Historical Concepts. This plan follows the original concept of a maritime village around the marina basin with access to the boats in a protected environment. A wellness center and an environmental education center are being added and are shown on the latest refinement. 5. The 200 boat dry storage facility in the original land plan has been removed as it was deemed inappropriate for the site. The boat and RV storage yard will provide covered storage for boats with trailers as originally planned. 6. The bulkhead surrounding the marina basin has also been modified to accommodate a vegetated sloped edge with a keystone retaining wall. The original vinyl and concrete bulkhead material has been replace with a stone wall. The idea of a natural sloped edge around the basin was encouraged by several of the agencies. This material change was reviewed in our February 4`h, meeting in Morehead City, specifications and samples were delivered with a letter identifying the change (see attached marina plan and cross sections) The riverside club, pool area and the walkways, along with the chapel have been further designed and given more open space and public water views. A 1 to 2 foot high landscape retaining wall has been added to prevent sedimentation and erosion at the top of the slope, this will be approximately 50' from the NWL along the Neuse River frontage. The original proposed rip -rap shoreline stabilization along the Neuse River is proposed to be replaced by an off shore granite sill with a vegetated sloped bank, ( this request will be handled under a major modification).
