Dear Mr. Mitchell:
This correspondence is in reference to your letter of June 23, 2006, whereby you requested to
place two floating channel markers approximately 50' waterward of the River Dunes marina basin
entrance canal. The development was authorized and constructed previously under State Permit #146-
01. The permit was originally issued for a subdivision, marina, boat ramp, and shoreline stabilization.
The permit has been modified and transferred several times, and is set to expire on 12/31/06.
The current request is depicted on the submitted plat dated June 22, 2006, and received June
23, 2006. I agree with the memo from Stephen Lane dated December 08, 2006, that the development
proposed is consistent with the General and Specific Use Standards found in 15A NCAC 07H.0208.
Please consider State Permit #146-01 refined to include the 2 floating channel markers by way of this
letter. Note that this refinement must be attached to the original permit for Division inspection, and all
other conditions of the original permit still apply.

SUBJECT: REFINEMENT REQUEST- CAMA MAJOR PERMIT#146-01,
RIVER DUNES CORPORATION, PAMLICO COUNTY
DATE: December 8, 2006
Please find enclosed a request from Mr. Ed Mitchell, President of River Dunes
Corporation, to refine State Permit # 146-01. This permit was originally issued to
Weyerhaeuser Real Estate Development Company on 11/20/01 for the construction
of a 600 home subdivision, a 400-boat slip high ground marina basin, a boat ramp,
and to install 11,300 ft of shoreline stabilization. The permit was transferred from
Weyerhaeuser to Granite Investment Properties, LLC on March 17, 2003. It was
then transferred from Granite Investment Properties, LLC to the River Dunes
Corporation on July 13, 2004. The permit was renewed on December 13, 2004 and
is set to expire on December 31, 2006. A minor modification of the permit was
issued on February 8, 2005 to. allow the use of a hydraulic dredge for the proposed
excavation of the access channel as opposed to barge mounted excavator with a
clam shell bucket. A second minor modification of the permit was issued on
January 13, 2006 and included the following:
1) the adjustment of the proposed property lines and road layout including the
refinement of the layout for the riverside club, pool, walkways and chapel,
2) the modification of the permitted entrance plan SR1317,
3) the relocation of the community service and marina buildings,
4) the addition of a wellness and environmental education center,
5) the elimination of the 200-boat dry stack storage facility,
6) the modification from a vertical bulkhead around the marina basin to a keystone
retaining wall with a sloped edge,
7) the addition of a retaining wall approximately 4000' in length on the Neuse River,
8) the addition of three infiltration ponds, and,
9) the addition of a gravel access road to the storage basin and (2) 8" water
transmission lines.

Mr. Mitchell now proposes to refine the permit by the addition of two floating channel
markers. The channel markers are proposed to be 50' waterward of the marina basin
entrance canal and will match the two existing floating channel markers which are located
approximately 350' waterward of the entrance canal.
By virtue of Section 15A NCAC 07J .0405, the permittee is allowed to request a
modification of this permit. I have determined the request for the refinement of the permit
is consistent with the 15A NCAC 07H.0208 regulations of this Division. Therefore, I have
no objections to the proposal with reference to the. attached drawing if all existing
conditions remain valid unless modified herein.

1) Refinement to add two channel markers at the protection jetty for the
safety of the boaters entering the channel.
Dear Mr. Lane:
Per the attached diagram we request a refinement to the channel marker layout allowing
two additional floating markers to provide navigational protection to boaters entering the
channel at River Dunes. These two markers would be located approximately 50' ft. off
the jetty on both sides of the entrance channel. They shall be Coast Guard approved and
match the two markers previously approved.
