This permit, issued on November 9,2, 7013 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
he subject to fines_ imprisonment or civil action. or may cause the permit to be null and void.
Expanded Docking facility
1) Unless specifically altered herein, this permit authorizes the expansion of the existing docking
facility and uses that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over public trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or
other qualified persons within twenty (20) days of the issuing
date. An appeal requires resolution prior to work initiation or
continuance as the case may be.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2016

3) Thelhthorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:67H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted with the exception of those authorized impacts necessary for the
construction of the boat ramp. New dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be applied and enforced throughout the entire existence of the
permitted structure.
4) No portion of any structure shall be located within 80 feet of the near bottom edge of the federally
maintained AIWW channel.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
6) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
7) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
8) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
9) This permit authorizes a maximum of 6 new formalized boatslips for a total of 10 formalized boatslips
associated with this expanded docking facility.
General
10) The permittee understands and agrees that, if future operations by the United States requires the
removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to free navigation of the navigable waters, the permittee will be required, upon
due notice from the Corps of Engineers, to remove, relocate or alter the work or obstructions caused
thereby, without expense to the United States or the state of North Carolina. No claim shall be made
against the United States or the state of North Carolina on account of any such removal or alteration.
11) No vegetated wetlands shall be excavated or filled, even temporarily, without permit modification.
12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

14) This Major Modification shall be attached to the original of Permit No. 81-13, which was issued on
7/2/13, as well as all subsequent renewals, and copies of all documents shall be readily available on site
when Division personnel inspect the project for compliance.
15) All conditions and stipulations of the active permit remain in force under this major modification unless
specifically altered herein.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

The project site is located at 5600 Marvin K. Moss Lane in New Hanover County. The property is adjacent to
the Atlantic Intracoastal Waterway (AIWW)/Masonboro Sound and is the location of the Center For Marine
Science (CMS) facility owned and operated by the University of North Carolina at Wilmington. To locate the
property traveling south on College Road, take a left onto Mohican Trail and travel east approximately 1.3
miles. Turn right onto Masonboro Loop Road and travel south for approximately 0.6 miles until you reach
Marvin K. Moss Lane that will be located on the left at the entrance to the CMS. Continue to travel east on
Marvin K. Moss Lane for approximately 0.5 miles until it terminates at the property of interest.
The high ground property is approximately 48.42 acres and the elevation of the property ranges from
approximately 0' to 27' above normal high water (NHW). Existing highground development on the property
includes marine science research buildings, guard building, parking areas, saltwater treatment equipment
for aquaculture facility, roads, sanitary pump -station and associated stormwater ponds. Highground
vegetation consists of maintained ornamental landscaping, lawn grasses, hardwoods and other woody
species including: Oak, Pine, Cedar and Dogwood. Vegetation bordering the highground of the property
consists primarily of high marsh and low marsh species, which supports §404 and coastal wetlands
vegetation including: Wax Myrtle (Myrica cerifera L.), Marsh -elder (Iva frutescens), Grounsel-bush
(Baccharis halimifolia), Sea Oxeye (Borrichia frutescensj, Salt Meadow Grass (Spartina patens) and
Smooth Cordgrass (Spartina a/temiflora). The high marsh then transitions into an area of low marsh,
approximately 420' in width towards the AIWW, which consists primarily of Smooth Cordgrass (Spartina
altemiflora). This vegetation also stabilizes the approximately 700' of shoreline.
Located at the eastern end of the property, just waterward of the existing road and cul-de-sac is an existing
research docking facility which currently extends into Masonboro Sound. The applicant received CAMA
Major Permit No.103-92 on 10/02/1992 for the construction of the current docking facility. Further, based on
the rules at the time of this permit, the structures were not to exceed 1/3 distance across the waterbody rule;
however, the applicant received an Ordinance through the New Hanover County Board of Commissioners
on 03/08/1993, which amended the local zoning in this location of Masonboro Sound to establish a pier
head line for research purposes. This allowed the applicant to exceed the 1/3 distance across the
waterbody rule to locate the existing facility within water depths of approximately -4.0' at mean low water
(MLW).
The current configuration consists of a fixed pier, measuring approximately 756' in length by 10' in width, of
which approximately 320' extends over open water. The pier terminates onto an uncovered fixed platform,
measuring approximately 24' in length by 55' in width, which is in a "T-head" configuration. There are two (2)
existing floating dock systems located just landward of the platform, one on each side of the access pier,
each measuring approximately 36' in length by 10' in width, which run parallel to the access pier. The
floating docks turn 90' a distance of approximately 23' in length by 8' in width, each running parallel with the
shoreline and channel, creating an "L-shaped" configuration. The existing docking facility could potentially
provide docking space for up to four (4) vessels, one of which is for the 66' R/V Cape Fear, which moors on
the waterward end of the fixed "T-head" platform. The application states that the water depth in the location
of these structures is approximately -2.0' to -3.0' at normal low water (NLW). There are also numerous
floating research shellfish bags located on the northern side of the existing "L-shaped" floating docks, which
extends approximately 115' towards the north.
The applicant received State Permit No. 81-13 on July 2, 2013 for a new floating dock, measuring
approximately 20' in length by 8' in width which extends from the existing floating dock system located on
the north end of the access pier, aforementioned. The floating dock is located just landward of the fixed
platform running perpendicular to the platform. The application states that the floating dock is utilized as an
upweller system utilized for nursery culture of bivalve mollusk research and not for docking purposes. State
Permit No. 81-13 is due to expire on December 31, 2016 (See Sheets 1 through 4 of 4 Project Narrative).

The City of Wilmington and New Hanover County 2006 Land Use Plan classifies the adjacent waters as
Conservation, and the adjacent high ground portion of the project area as ResBOWWRtion. In the
project area, the waters of Masonboro Sound are classified as SA-ORW by the NC Division of Water
Quality, and they are OPEN to the harvest of shellfish. These waters ARE designated as a Primary Nursery
Area (PNA), by the Division of Marine Fisheries.
PROPOSED PROJECT:
The applicant proposes to expand an existing research docking facility adjacent to the AIWW, in Masonboro
Sound. Modifications to the active permit include a new main floating dock, measuring approximately 76' in
length by 8' in width which would extend from the existing "L-shaped" floating dock located on the northern
side of the existing research docking facility, running parallel to the AIWW channel. Three (3) floating finger
piers, each measuring approximately 16' in length by 4' in width would extend from this main floating dock
approximately 22' apart, which would run perpendicular to the AIWW channel. Three (3) boatlifts, each
measuring approximately 12' in length by 12' in width would be installed, each on the northern side of the
proposed finger piers. A new floating dock extension, measuring approximately 17' in length by 8' in width
would extend from the existing "L-shaped" floating dock located on the southern side of the existing docking
facility, which would run parallel to the AIWW channel. Two (2) boatlifts, one (1) measuring approximately
12' in length by 12' in width would be installed on the landward side of the "L-shaped" floating dock and one
(1) measuring approximately 15' in length by 15' in width would be installed on the waterward side of the "L-
shaped" floating dock.
The application states that the expansion would accommodate an additional six (6) research vessels for a
total of ten (10) slips at this location. The application also states that the landward side of the proposed main
floating dock on the northern end of the facility would be utilized for access to the existing shellfish research
area and vessel dockage would be prohibited. The application states that the water depth in the location of
the proposed structures range from approximately -2.0' to -3.0' at NLW (See Sheets 1 through 4 of 4 and
Project Narrative).
ANTICIPATED IMPACTS:
The proposed new docking structures would incorporate 1,553 sq. ft. of Estuarine Waters and Public Trust
Areas. The structure would not encroach into the adjacent 15' riparian corridor setback requirements nor the
80' setback from the AIWW federal channel. Further, the proposed structures would not extend beyond the
established pier head line for the existing research facility. Minor turbidity increases may be expected during
the construction process.

All sanitary sewer is gravity fed from existing facilities to a lift station. The lift station then pumps to the existing Cape Fear
Public Utility sanitary sewer system.

The proposed project involves expansion of the existing dock facilities. The project will add an approximately 900SF of
floating dock structures to allow for the installation of five boatlifts providing five dry berths for research vessels. Electrical
and potable water systems will be supplied from existing services to the proposed floating dock structure to support marine
operations and research.
c.
Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type
of equipment and where it is to be stored.
The construction of the proposed floating dock system will consist of treated timbers, ranging from 2x5 to 2x12, fastened
together with various stainless steel and hot dipped galvanized hardware to prevent structural failures resulting from salt
water corrosion. The construction of the floating dock sections will take place in a secured lay down area as designated by
UNCW. The floating dock system will then be floated into position and secured in place with the installation of 10"-12" treated
pilings and galvanized hardware. All pilings will be installed utilizing water jetting via barge. Once the structures are secured,
electrical distribution will be provided from the existing pier electrical service to support the addition of five high-speed
boatlifts that will be installed with stainless steel, galvanized and aluminum components. Potable water plumbing will be
installed, from the existing pier potable water service, to the floating dock structures. Equipment will consist of a barge/water
jet pump system to install the pilings and various hand tools needed to complete carpentry, electrical and plumbing related
tasks.

The project involves expansion of the existing dock facilities at UNCW's Center for Marine Science. Existing facilities include an
800ft fixed research pier with an additional -900sf of floating dock structures. The proposed project will add an additional
900sf of floating dock structures and allow for the installation of four boatlifts providing dry and wet berths. Electrical and
potable water systems will be supplied to the proposed floating dock structure to support marine operations and research.
-Berth 1 (1 vessel): 15-ft x 35-ft dry berth to accommodate the RN Seahawk. The southwest corner of the existing dock will
accommodate the vessel; outfitted with a Neptune 24,000 lb. High Speed Drive Lift.
• Berth 2 (1 vessel): Dry Slip for North Carolina Coastal Reserve Program (NC -CRP). On the western side of the existing
floating platform, next to Berth 1 (RN Seahawk), berth for the NC -CRP boats in a 12-ft x 12-ft berth outfitted with a Neptune
13,0001b. High Speed Drive Lift. The N.C. Division of Coastal Management will upgrade this slip at the same time the NSF
supported work is being carried out in order to take advantage of the synergism between the construction programs.

copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have
waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or
113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of
Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days
of this decision on your permit. You should also be aware that if another qualified party submits a valid objection to the
issuance of this permit within twenty (20) days, the matter must be resolved prior to work initiation. The Coastal
Resources Commission makes the final decision on any appeal.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried
out in accordance with your application. Modifications, time extensions, and future maintenance requires additional
approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are
having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we request that you
complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit
conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance.

The University of North Carolina Wilmington's Center for Marine Science is
proposing to install a floating dock expansion to the existing research pier facilities
located at 5600 Marvin K. Moss Lane in Wilmington, NC.
Upon consulting with NCDENR representatives it has been determined that normal
low water level at the proposed project site is 3'(NLW) and a the proposed facility
will result in 10 overall berths for research vessels.
Upon completion the facility will allow dockage of research vessels including 4 dry
berths to accommodate 16'-20' John boats/flat bottom center consoles, 4 wet berths
to accommodate 16'-20' boats/Flat bottom center consoles,1 dry berth to
accommodate the 35' R/V Seahawk and 1 wet berth to accommodate the 66' R/V
Cape Fear.
Existing Facilities
The project involves expansion of the existing dock facilities. Existing facilities
include a fixed research pier with additional floating dock structures. Current
structures allow for the wet dockage of 5 research vessels. Potable water and
electrical services are provided to support marine operations.
To the west, at the end of the fixed research pier, one wet slip provides dockage for
the 66' R/V Cape Fear.
To the north, floating dock accommodates one wet slip for a 16'-20' research vessel.
The west side of the north floating dock structure has been designated as a shellfish
research test farm area in which boat dockage/access is prohibited at all times (see
drawing C4).
To the south, floating dock accommodates three wet slips for 16-20' research
vessels.

Proposed Facilities
The proposed project will add additional floating dock structures, fingers and"
boatlifts to provide a total of ten overall slips, five wet slips and five dry slips.
Electrical and potable water systems will be extended from the existing structures
to the proposed floating dock to support marine operations and research.
To the west, at the end of the fixed research pier, one existing, unaltered wet slip
will provide dockage for the 66' R/V Cape Fear.
To the north, floating dock structures will be extended and finger piers will be
constructed to provide three dry berths and three wet berths. The west side of the
north floating dock structure has been designated as a shellfish research test farm
area in which boat dockage/access is prohibited at all times therefore additional
pilings to restrict access and no docking cleats will be installed.
To the south two boatlifts will be installed in existing slip locations to provide dry
berths for research vessels. One existing wet slip will remain unaltered. Floating
dock structure will be added to the south providing access to load/unload the 3S'
R/V Seahawk.
The construction of the proposed floating dock system will consist of treated
timbers, ranging from 2x6 to 2x12, fastened together with various stainless steel
and galvanized hardware to prevent structural failures resulting from salt -water
corrosion. The floating dock system will be secured in place with the installation of
10-12" treated pilings and galvanized hardware. All timber will be specified to be
compatible for salt -water contact to extend the life cycle of the structure and reduce
maintenance costs.
The floating dock and finger pier sections will be constructed on land and then
trailered to a local boat ramp and floated into place and secured to 10-12" pilings.
Once the structure is secured, electrical distribution will be provided to support the
addition of four high-speed boatlifts that will be installed with stainless steel,
galvanized and aluminum components to prevent salt -water corrosion. Potable
water plumbing to the structure will then be installed.

The Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major
Permit Application for the subject project on September 26, 2013. Staff review of the plans and specifications has determined
that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The
Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from
stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000, the
stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stormwater runoff, then it is also subject to
the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an
NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the
construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed,
whichever occurs first.

Dear Mr. Morrison,
You have our approval, in accordance with the attached conditions to expand an existing non -marina
docking facility as described in your application received by the N.C. Division of Water Resources
(DWR) on September 30, 2013. After reviewing your application, we have decided that the impacts
are covered by General Water Quality Certification Number 3900 (GC 3900).

This Certification allows you to use the Regional General Permit #198000291 (GP 291) when issued by
the U.S. Army Corps of Engineers and the CAMA permit when issued by the Division of Coastal
Management. In addition, you should obtain or otherwise comply with any other required federal, state
or local permits before you go ahead with your project including (but not limited to) Erosion and
Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with
your proposed impacts or to conduct impacts to waters as depicted in your application shall expire
upon expiration of the 404 or CAMA Permit.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions.
If total fills for this project (now or in the future) exceed one acre of wetland or 150 linear feet of
stream, compensatory mitigation may be required as described in 15A NCAC 2H .0506 (h). This
approval requires you to follow the conditions listed in the attached certification and any

The Additional Conditions of the Certification are:
1. No Waste, Spoil, Solids, or Fill of Any Kind
No waste, spoil, solids, or fill of any kind shall occur in wetlands, waters, or riparian areas
beyond the footprint of the impacts depicted in the CAMA Major application. All
construction activities, including the design, installation, operation, and maintenance of
sediment and erosion control Best Management Practices, shall be performed so that no
violations of state water quality standards, statutes, or rules occur.
2. Standard Erosion and Sediment Control Practices
Erosion and sediment control practices must be in full compliance with all specifications
governing the proper design, installation and operation and maintenance of such Best
Management Practices:
a. Erosion and sediment control measures for the project must be designed, installed,
operated, and maintained in accordance with the most recent version of the North
Carolina Sediment and Erosion Control Planning and Design Manual.
b. Design, installation, operation, and maintenance of the sediment and erosion control
measures must be such that they equal, or exceed, the requirements specified in the
most recent version of the North Carolina Sediment and Erosion Control Manual.
The devices shall be maintained on all construction sites, borrow sites, and waste pile
(spoil) projects, including contractor -owned or leased borrow pits associated with the
project.
c. For borrow pit sites, the erosion and sediment control measures must be designed,
installed, operated, and maintained in accordance with the most recent version of the
North Carolina Surface Mining Manual.
d. Reclamation measures and implementation must comply with the reclamation in
accordance with the requirements of the Sedimentation Pollution Control Act.
e. Sufficient materials required for stabilization and/or repair of erosion control
measures and stormwater routing and treatment shall be on site at all times.
3. Construction Stormwater Permit NCGO10000
Upon the approval of an Erosion and Sedimentation Control Plan issued by the Division
of Energy, Minerals, and Land Resources (DEMLR) or a DEMLR delegated local
erosion and sedimentation control program, a NPDES General stormwater permit
(NCG010000) administered by DEMLR is automatically issued to the project. This
General Permit allows stormwater to be discharged during land disturbing construction
activities as stipulated by conditions in the permit. If your project is covered by this
permit [applicable to construction projects that disturb one (1) or more acres], full
compliance with permit conditions including the sedimentation control plan, self -
monitoring, record keeping and reporting requirements are required. A copy of this

4. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be
exceeded as described in 15 A NCAC 2B .0200. Appropriate sediment and erosion
control practices must be used to meet this standard. _-
5. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant is required to
return the attached Certificate of Completion to the 401/Wetlands Unit, North Carolina
Division of Water Resources, 1650 Mail Service Center, Raleigh, NC, 27699-1650.
Violations of any condition herein set forth may result in revocation of this Certification and may
result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
You can contest this Certification as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings.
You may obtain a petition form from the Office of Administrative Hearings at
http://www.ncoah.com or call (919) 431-3000 for information. Within sixty (60) calendar days
of receipt of this Certification, you must file the petition with the Office of Administrative
Hearings. A petition is considered filed when the original and one (1) copy is received in the
Office of Administrative Hearings during normal office hours (Monday through Friday between
8:00am and 5:00pm, excluding official state holidays). The petition may be faxed to the Office
of Administrative Hearings at (919) 431-3100, provided the original and one copy of the petition
is received by the Office of Administrative Hearings within five (5) business days following the
faxed transmission.

It is the staffs recommendation that the proposal appears that the project is CONSISTENT with a use standards
set forth in NCAC 07H .0208(b)(6). The proposed structures would be located entirely over open water and would
not extend beyond the established pier head line, aforementioned. Further, it also appeWei ROWIProposed
structure would not exceed beyond the terminal end of the existing fixed pier and fixed platform distance, which are
CONSISTENT with the rules set forth in NCAC 07H .0208 at the time of the original permit including the established
pier head line. As proposed this office has no objection to the proposed project. If the project is determined to be
consistent with NCAC 07H .0208(b)(6), and all other state, federal and local regulations, it is recommended that any
permit issued should include the following conditions:
This permit authorizes only the docks, piers, and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structures, whether floating or
stationary, may become a permanent part of the structure without permit modification. No non -water
dependent uses of structures may be conducted on, in, or over public trust waters without permit
modification.
2. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
3. The authorized structure and associated activity must not cause an unacceptable interference with
navigation and shall not exceed the established pierhead line.
4. The permittee must install and maintain, at his expense, any signal lights and signals prescribed bythe U.S.
Coast Guard, through regulations or otherwise, on authorized facilities.
5. In order to protect water quality, runoff from the construction must not visibly increase the amount of
suspended sediments in adjacent waters.
6. The permittee will maintain the authorized work in good condition and in conformance with the terms and
conditions of this permit. The permittee is not relieved of this requirement if he abandons the project without
having the permit transferred to a third -party.
7. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
8. The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the
PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized.
9. This permit authorizes a maximum of ten (10) boat slips. At no time shall more than ten (10) vessels be
moored or docked at the facility. The restriction of the number of vessels shall apply to all marine vessel
types, including but not limited to motorboats, sailing vessels and personal watercraft.
NOTE: The permittee is cautioned that this permit does not authorize the placement of tie piles in association with
the docking facility. Furthermore, due to the proximity of the AIWW, boats utilizing the docking facility will be
subject to frequent wave wash from passing vessels. The issuance of this permit does not relieve the
permittee from taking all proper steps to ensure the integrity of the structure and the safety of moored boats.
The permittee shall not hold the State of North Carolina or the United States liable for any damage to the
structure or moored boats.

Dear Mr. Huggett:
Reference the application of University of North Carolina -Wilmington to expand an
existing research docking facility, adjacent to the AIWW, in Wilmington, New Hanover County,
North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Approval of the structure is based on determinations that there would be no
obstruction to navigation. The structure may be damaged by wave wash from passing vessels.
Issuance of this permit should not be construed, as relieving the permittee of taking proper steps
to insure the structure and moored boats will not be damaged by wave wash.
4. Except as specified in the plans attached to this permit, no excavation, fill or
mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, in such a manner as to impair normal flows and circulation patterns
within waters or wetlands or to reduce the reach of waters or wetlands.
5. Except as authorized by this permit or any USACE approved modification to this
permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in
the construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
6. Unless otherwise authorized by this permit, all fill material placed in waters or
wetlands shall be generated from an upland source and will be clean and free of any pollutants
except in trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
7. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic
materials. In the event of a spill of petroleum products or any other hazardous waste, the
permittee shall immediately report it to the N.C. Division of Water Quality at (919) 733-5083,
Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous
Substances Control Act will be followed.
8. The authorized structure and associated activity must not interfere with the public's
right to free navigation on. all navigable waters of the United States. No attempt will be made by
the permittee to prevent the full and free use by the public of all navigable waters at or adjacent
to the authorized work for reason other than safety.
9. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities.
For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office
at (910) 772-2191.
10. If the permittee discovers any previously unknown historic or archeological remains
while accomplishing the authorized work, he will immediately notify the Wilmington District
Engineer who will initiate the required coordination procedures.
11. The permittee shall advise the Corps in writing at least two weeks prior to beginning
the work authorized by this permit and again upon completion of the work authorized by this

permit.
12. Approval of the structure was based on determinations that there would be no
obstruction to navigation. Under conditions existing in the Atlantic Intracoastal Waterway
(AIWW), a possibility exists that the structure may be damaged by wave wash from passing
vessels. Unreasonable slowing down of vessel traffic cannot be required because it would tend to
nullify the navigational benefits on which the AIWW was justified. Issuance of this permit
should not be construed, as relieving the permittee of taking proper. steps to insure the structure
and moored boats will not be damaged by wave wash normally to be expected in the AIWW.
13. The permittee shall require its contractors and/or agents to comply with the terns and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
14. The permittee shall employ all sedimentation and erosion control measures necessary
to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
15. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not.
considered significant.
16. The permittee, upon receipt of a notice of revocation of this permit or upon its
expiration before completion of the work will, without expense to the United States and in such
time and manner as the Secretary of the Army or his authorized representative may direct, restore
the water or wetland to its pre -project condition.
17. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.
18. No portion of any structure will be located within 80 feet of the near bottom edge
federally maintained navigation channel or federal setback to the channel. An as built survey of
the authorized structure will be provided to our office for review of navigation concerns.

This project is consistent and not in conflict with•the,2006 Wilmington -New Hanover
County Joint Land'Use Plan Update.
The applicant is proposing to install an additional floating dock to an existing research
docking facility adjacent to the AIW W, in Masonboro Sound, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are ORW, EW and
PT. Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County Joint Land Use Plan and offer the following comments.
The general area of the project is classified as Resource Protection.
In general, Wilmington -New Hanover County allows development in Resource
Protection classified AECs, which is consistent with the State's minimum use standards.
The 2006 Wilmington -New Hanover County Joint Land Use Plan contains some policies,
which exceed the State's minimum use standards. However, none of these standards
appear to be applicable to this proposal.
This project appears to be consistent with the 200 Wilmington -New Hanover County
Joint Land Use Plan.

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for proposed
development located at 5600 Marvin K. Moss Lane, adjacent to Masonboro Sound, in New Hanover County. It was
received as complete on September 24, 2013 and appears to be adequate for processing at this time. The projected
deadline for making a decision is December 9, 2013. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from September 24, 2013, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting
will be held within five working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a
public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property; or at a point along the road right-of-way where a private road would lead one into your property.
Failure to post this notice could result in an incomplete application.
A field report has been prepared and is in the process of being circulated to the various state and federal review agencies
for their comments. If additional information is required based on this review, the agencies may contact you directly.
