Kelly Spivey, representative for the Division of Coastal Management, issued to you on 28 April 2005 for unauthorized development in violation of the Coastal Area Management Act (LAMA). The violation occurred on -site your property located at the intersection of SR 1214 and SR 1210 in the Town of Columbia adjacent a man-made canal that flows into the Scuppernong River, in Tyrrell County, North Carolina. The violation resulted from the unauthorized filling and grading of ±7600 ftz of Coastal Shoreline with earthen material. Mr. Raleigh Bland of the US Army Corps of Engineers delineated approximately 2,645 ft2 of the graded and filled area as Section 404 wetlands. The violation involved Coastal Shoreline, which is an Area of Environmental Concern designated by the Coastal Resources Commission. Based upon a site visit conducted by Mr. Kelly Spivey and myself on I December 2005 and information from Mr. Raleigh Bland, the restoration requested is complete to the satisfaction of the Division of Coastal Management. The Coastal Area Management Act provides that a civil assessment of up to $2,500 may be assessed against any violation. It is the policy of the Coastal Resources Commission to assess a civil penalty for all violations. This is done to recover some of the cost of investigating violations and/or to compensate the public for any damage to its natural resources. Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount of $700 is appropriate for this violation. You may expeditiously resolve this matter prior to the assessment of a formal civil penalty by accepting responsibility for the violation and paying the amount proposed above. This letter also confirms that on 23 March 2005 I met you at your business regarding the above referenced property. The purpose of my on -site inspections was to investigate unauthorized filling and grading. Information gathered by me for the Division of Coastal Management indicates that you have undertaken major development in violation of the Coastal Area Management Act (CAMA). No person may undertake activity constituting major development within a designated Area of Environmental Concern (AEC) without first obtaining a permit from the North Carolina Department of Environment and Natural Resources. This requirement is imposed by North Carolina General Statutes (NCGS)113A-118.. Information I have indicates that you are responsible for the unauthorized filling and grading of +7600 f12 of Coastal Shoreline with earthen material. Mr. Raleigh Bland has delineated approximately 2,645 ft2 of the graded and filled Coastal Shoreline as Section 404 wetlands. Coastal Shoreline is an Area of Environmental Concern (AEC) as designated by the Coastal Resources Commission. Coastal Shoreline is defined in part, as the area extending from the normal water level along estuarine waters for a distance of 75' landward. A permit was not issued to you for this work. If the development completed to date is not consistent with the applicable standards, as in this case, you will be required to restore the area to its former condition and/or bring all aspects of the project into compliance with the applicable State and Federal regulations. A civil assessment of up to $2,500 may be assessed against any violator. Each day that the development activity described in this Notice is continued or repeated may be considered a separate violation as provided in NCGS 133A-126(d) and may be subject to an additional civil assessment. An injunction or criminal penalty may also be sought to enforce any violation as stipulated in NCGS 113A-126. It is the policy of the Coastal Resource Commission to levy a minimum civil assessment of $350 not to exceed $2500 against all violations. This is done to recoup some of the cost of investigating violations and/ or to compensate the public for any damage to its natural resources. Whether a higher amount will be assessed depends on several factors, including the nature and amount of resources affected, the extent of the damage to the resources, and whether full cooperation is forthcoming in bringing the project into compliance. Based upon N.C. Administrative Code Title 15A Subchapter 7H, State Guidelines for Areas of Environmental Concern, the activity you have undertaken is not consistent with section .0209, Coastal Shoreline. Therefore, I am requesting that the unauthorized fill material placed in the section 404 Wetlands be removed and placed on high ground. As per our conversation daring the 25 April 2005 on - site meeting, you agreed to remove the earthen fill. Provided you intend to cooperate with the request, you should sign the attached Restoration Agreement and return it to me in the enclosed self- addressed envelope. No response from you within 10 days of the receipt of this letter will be interpreted as a refusal to cooperate and a court injunction will be sought ordering the restoration.
