I understand that the staff of the Department of Environment and Natural Resources will
propose the assessment of a civil penalty in the amount of $100.00 against Dare Resorts, Inc.
for violation of the Coastal Area Management Act, NCGS 113A-100 et sec, committed on or
near the property of Dare Resorts, Inc., at Avalon Pier, more specifically 2111 N. Virginia
Dare Trail, Kill Devil Hills in Dare County, North Carolina. In order to resolve this matter
with no further action or expense on my part, I accept responsibility for the violation as
described in the Notice of Violation letter dated July 18, 2005, and agree to pay the proposed
civil assessment of $100.00.

This letter is in reference to the Notice of Violation dated July 18, 2005, that Local Permit
Officer Donna Elliott, for the Town of Kill Devil HIlls, issued to Dare Resorts, Inc. for the
unauthorized construction of an oceanfront bulkhead on the west side of an existing bulkhead at
the Avalon Pier at 2111 N. Virginia Dare Trail, in Kill Devil Hills, Dare County. The
violation involved the Ocean Erodible Area, which is an Area of Environmental Concern
designated by the Coastal Resources Commission. Based upon the site visit conducted on
September 20, 2005 by Donna Elliott, the restoration requested is complete.
The Coastal Area Management Act provides that a civil assessment of up to $250.00 may be
assessed for any minor violation. It is the policy of the Coastal Resources Commission to
assess a civil penalty for all violations in order to recover some of the costs of investigating
violations and/or to compensate the public for any damage to its natural resources.
Under the rules of the Coastal Resources Commission, a proposed civil penalty in the amount
of $100.00 is appropriate for this violation. You may expeditiously resolve this matter prior to
the assessment of a formal civil penalty by accepting responsibility for the violation and paying
the amount proposed above. In order to do this, you must: (1) sign one of the attached copies
of an "Agreement to Pay Civil Assessment;" (2) attach a check or money order for $100.00
made payable to the North Carolina Department of Environment and Natural Resources
(NCDENR); and, (3) return the signed agreement and payment to this office in the enclosed,
self-addressed envelope within ten (10) days of your receipt of this letter. Upon deposit of
your check in the Department's account, you will receive a Notice of Compliance officially
closing this enforcement action.

Doling 2002 and 2003, the beach sand was constantly Mowing ieto our parking lot and was
buildint up along the bulkhead(parking lot side). "ibis allowed vehicles, especially 4X4,'tn ride
up on the sand and above the buried conesete barriers to get a better view of the ocean, it was 'lot
long until the planks of the bulkhmd were being damaged from the contact of rite flint bumpers,
with some breaking is two.
Our ihiukiog wag this; if we just replaced those damaged boards, the vehicles would still be able
to damage the bulkhead, and the sand was not going anywhere. So we built a wooden barrier in
front of the bulkhead to protect it. The "reap' bulkhead, or the "erosion control" bulkhead is
constructed of 20 ft planks with 15 ft buried in the sand. The wooden barner has 4 A planks flush
to the ground. Its sole purpose was to protect our bulkhead, but it also provides a better aesthetic
look than any altomativcs we came up with. We liken it to a fence. Nothing more, And Binoe it
was west of the bulkhead, we thought it did not come under the CAMA umbrella. It appears we
might be wrong.
WI would like to be able to keep this barrier, as it has proven to be very effective in protecting
the bulkhead. But if I need to tear it down, apply for a permit, end rebuild it, we will do so. Or, if
it is not permissible, work with your of ct to determine a plan of action. Whatever you decide,

Dear Mr. Lehman:
In December of 2003, Lynn Mathis of the -Division of Coastal Management was onsite at the Avalon Pier
located at 2111 N, Virginia Dare Trail, adjacent to the Atlantic Ocean, in the Town of Kill Devil Hills, In Dare
County, North Carolina. The purpose of the visit was to investigate the unauthorized construction of an
oceanfront bulkhead. On March 29, 2004, the Town of Kill Devil Hills notified Dare Resorts, Inc, that a
violation existed on the property where the Avalon Pier is located.
Information gathered by the Local Permit Officer and the NC Division of Coastal Management shows that
Dare Resort, Inc. did Undertaken minor development in violation of the Coastal Area Management Act. No
person may undertake minor development in a designated Area of Environmental Concern without first
obtaining a permit from the North Carolina Dcparirrient of Environment and Natural Resources, North
Carolina General Statutes (N.C.GS.) 113A-118,
I have Information that Dare Resort, Inc. is legally responsible for, minor development on the property by
Constructing a new bulkhead landward (west) of an existing bulkhead, adjacent to the Avalon Pier parking
lot, This activity took place in the Ocean Hazard Area that is contiguous with the Atlantic Ocean. The
Ocean Hazard Area is designated as an Areas of Environmental Concern (AEC). No pemlit was issued to
you for work in this area. Based on these findings, I am initiating an enforcement action by Issuing this
Notice of Violation for violation of the Coastal Area Management Act
A civil assessment of tip to $250 may be assessed against any violator. Each day that the development
described in this Notice is continued or repeatod may constitute a separale violation that Is subject to an
additional assessment of $250, An injunction or criminal penalty may also be sought to enforce any
violation in accordance with N.C.133.113A-126,

It is the policy of the Coastal Resources Commission to assess a minimum civil penalty of $100,00 against
all violations of this type, This is done to recoup some of the costs of investigating the violation andlor to
compensate the public for any damage to its natural resources. Whether a higher amount will be assessed
will depend on several factors, including the nature and area of the resources affected and the extent of the
damage to them. If restoration of the affected resources is requested, but is not undertaken or completed
satisfactorily, a substantially higher civil penalty will be assessed and a court injunction will be sought
ordering restoration.
In 2003, a bulkhead was constructed on the east side of the Avalon Pier parking lot, within the Ocean
Hazard Area. Based on the North Carolina Administrative Code, Title 15A, Subchapter 07H
which prohibits the use of permanent erosion control structures such as bulkheads the structure must be
removed. Please refer to the enclosed Restoration Agreement.
If you intend to cooperate with my request, please sign one of the attached Restoration Agreements and
return it to me in the enclosed, solf-addressed envelope within ten (10) days of receipt of this IeHer. Failure
to comply with this request or respond back to this office prior to the requested deadline with an acceptable
schedule for compliance will be interpreted as a refusal to cooperate and will result in a Notice of
Continuing Violation, as well as a court injunction being sought ordering compliance.
The relevant statutes and regulations are available from this office, and I am willing to assist you in
complying with the requirements of these laws. A site inspection will be made in the future to determine
whether tttis request has been complied with.
Thank you for your time and cooperation in resolving this important matter. Upon completion of the
restoration as requested in the Restoration Plan Agreement to the satisfaction of the Division of Coastal
Management, you will be notified as to the amount of the civil assessment for undertaking development that
is inconsistent with Coastal Rosoumes Commission rules.

This letter is in reference to the Notice of Violation tf05.18A sent to you 7111y 18, 2005
-for tho bulkhead within the ocean hazard AEC is or near the Atlantic Occan. The
violation took place on your properly located at 2111 North Virginia -Dare Trail in Kill
Devil Hills in Dare Cowmty, North Carolina. This unauthorized activity constituted
development and you were requested to remove the bullhead.. In atoordmice With the
North Carolina Administrative Coda Title 15A, Subchapter 7.1.0410, any violation
involving development which is inconsistent with guidelines for development with Areas
of Lnvitonmcotal Concern rant be corrected by restoring the prof Oct site to pre -
development conditions to recover lost resalrrces or to prevent tlrrther resou rro damage.
I conducted a site visit at the aforementioned property on September 20, 2005, to inspect
tho restoration of the unauthorized activity addressed in the Nodee of Violation #05-1 SA.
Based on this inspection, it has been dotcrmined that the restoration appears to have been
accomplished to lbe satisfaction of this Division. Upon my submission of an
enforcement report, you will be notified as to the amount of the civil pcdalty far
undertaking this unauthorized activity within an Area of LnVironmental concem-
