This permit, issued on March 23, 2022 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation >f these terms may be subject to tines, imprisonment or civu action; or may cause uIe Porrir w VO uw. auu Docking Facility 1) - This permit authorizes only the docks, piers, boatlift, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. . ' . 2) This permit authorizes 1 additional formalized boat slip for a maximum of 4 formalized boat slips at this docking facility. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee John Hollmeyer Permit No. 32-2k ` Page 2 of 3 ADDITIONAL CONDITIONS 3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the mean high-water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 4) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the mooring shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 7) Should the southern adjacent property be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. Sedimentation and Erosion Control 8) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 9) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to.a third party without the written approval of the Division of Coastal Management. 11) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. 12). The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4501 and assigned the project DWR Project No. 20211815. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within.30 feet of the mean high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. Fayetteville Street, Hollmeyer, John Page Two 9. PROJECT DESCRIPTION The project site is located at 15 W. Fayetteville Street on Wrightsville Beach, adjacent to Banks Channel, in New Hanover County. To locate the property, travel east on Eastwood Road and cross the Wrightsville Beach Drawbridge. Follow Causeway Drive over the Banks Channel bridge and take a left at the stop light. Travel north on N. Lumina Avenue for 0.5 miles and turn left onto W. Fayetteville Street. The subject property is located at the end of the street on the left. The property is located on the western side of the island portion of Wrightsville beach, between the two access bridges, adjacent to Banks Channel. The 0.15 acre parcel has an existing single family residence and is approximately 3' above normal high water (NHW). Upland vegetation on the property currently consists of ornamental landscaping and lawn grasses. The approximately 140' of shoreline frontage is currently stabilized by a concrete bulkhead. The applicant currently maintains an existing 3 slip private docking facility. A 5' by 145' fixed pier extends west from the bulkhead into Banks Channel, terminating in an 11' by 16' gazebo. An access ramp extends north off the side of the fixed pier just landward of the gazebo onto an L-shaped floating dock. The floating dock connected to the access ramp measures approximately 6.5' by 28.5' and is positioned perpendicular to the shoreline. The other portion of the floating dock measures approximately 4.5' by 12', attached to the landward end of the 6,5' by 28.5' floating dock, positioned parallel with the shoreline. At the end of the access pier on the southern side is an additional floating platform measuring approximately 6' by 33' accessed by an aluminum ladder. Aerial imagery indicates the facility in the current configuration without the gazebo was constructed sometime before 1993, no permit history was found for the original facility. The terminal gazebo was added in 1998 through General Permit 18072-D. The existing floating docks were replaced through General Permit 72202-D issued on October 22, 2018 for Hurricane Florence damage. Most recently the fixed pier was replaced in the same footprint through General Permit 67233-D issued on September 23, 2016. The private facility accommodates up to three (3) vessels. The Wrightsville Beach 2019 Land Use Plan classifies adjacent waters as Conservation and the high ground portion at the property as Low Density Residential. The waters of Banks Channel, adjacent to the parcel are classified SB by the Division of Water Quality. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to expand the existing docking facility by adding a new fixed finger pier and boatlift for a total of 4 slips. The proposed 6' by 23' fixed finger pier would be added to the south side of the access pier approximately 35' landward of the existing gazebo. Anew ramp would be added to the finger pier extending west onto the existing 6' by 33' floating dock. A new 13' by 14' boatlift would be added to the landward side of the proposed new fixed finger pier (see Sheet 1 of 2). The proposed new fixed finger pier and boatlift would extend approximately 14' into the 15' riparian setback, a waiver from the adjacent riparian neighbor has been obtained. The current docking facility extends to the Wrightsville Beach Pier Headline, which is less than the % of the waterbody. The proposed expansion would not extend the docking facility any further waterward. Water depths measured by DCM during the site visit on December 8, 2021 are consistent with the depths the applicant provided on Sheet 1. The proposed development would encroach 14' into the adjacent 15' riparian setback shared with the property owner to the south. The proposed expansion would not extend the 155' long docking facility father into the approximately 971' wide waterbody adhering to the %., nor would it exceed the Wrightsville Beach pier headline. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction.
