I have reviewed the information submitted to this office in your inquiry concerning the necessary
filing of an application for a minor development permit under the Coastal Area Management Act.
After making a site inspection on April 13, 2018, 1 have determined that the activity you propose is
exempt from needing a minor development permit as long as the project remains in accordance with
your project scope submittal, which was received by this office on April 10, 2018 and meets the
conditions specified below. If your plans should change and your project will no longer meet these
conditions, please contact me before proceeding.
15A NCAC 07H .0311 INSTALLATION AND MAINTENANCE OF SAND FENCING
A. Sand fencing may only be installed for the purpose of building sand dunes by trapping
windblown sand; the protection of the dune(s) and vegetation (planted and existing).
B. Sand fencing shall not impede existing public access to the beach, or emergency vehicle
access. Sand fencing shall not be installed in a manner that impedes or restricts established
common law and statutory rights of public access and use of public trust lands and waters.
C. Sand fencing shall not be installed in a manner that impedes, traps, or otherwise endangers
sea turtles, sea turtle nests, or sea turtle hatchlings. CAMA permit applications for sand
fencing shall be subject to review by the Wildlife Resources Commission and the U.S. Fish
and Wildlife Service in order to determine whether or not the proposed design or installation
will have an adverse impact on sea turtles or other threatened or endangered species.
D. Non-functioning, damaged, or unsecured sand fencing shall be immediately removed by the
property owner.
E. Sand fencing shall not be placed on the wet sand beach area.
This exemption issued to 1704 N. Lumina Ave. authorizes the following:
1. Installation of Sand Fencing starting 5 feet from the base of the primary dune.

2. The proposed repairs must be consistent with all other applicable local ordinances and with
North Carolina Building Code standards.
3. The project shall adhere to the scope of work that was submitted to this office.
The Town of Wrightsville Beach also imposes the following condition:
• Reflectors must be mounted on both the first post and the last post in a series of sand
fencing sections to ensure that the sand fencing can easily be seen by emergency vehicles
during low visibility situations.
This exemption to CAMA permit requirements does not alleviate the necessity of your obtaining any
other State, Federal, or Local authorization. This exemption expires 90 days from the date of the
letter. Please contact this office upon the completion of work for an inspection.
