Shoreline Stabilization — Bulkhead and Rip Ran 1) The bulkhead and rip rap shall be constructed in accordancewith the alignment depicted on the attached workplan drawings. _ 2) No open water shall be excavated or tilled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead and rip rap shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Collier ADDITIONAL CONDITIONS Permit No. 29-22 Page 2 of 3 4) The rip rap material shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete with no exposed rebar. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. 5) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 6) The bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. waterward of -the -approved -al' 9) The fill material shall be clean and free of any pollutants except in trace quantities. 10) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 11) No backfill material is to be placed within 30 feet. of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 12) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Sedimentation and Erosion Control 13) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 14) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 15) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE:. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-00133). NOTE: • The N.C. Division of Water resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1855. NOTE: Future development of the permittee's property may require a modification of this permit. The project site is located at 288 Griggs Acers Drive, Point Harbor, Currituck County, and is adjacent to the Albemarle Sound. The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the construction activities involved shall be consistent with the management objective of the Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, -RECEIVED t. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(D) states that development shall not increase siltation. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for r.CE-11; } navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The proposed development is consistent with the intent of this rule. DEC 22 2021 Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (7) Bulkheads peAQM-MHD CITY to this project, and those subparagraphs not listed are not applicable to this project. Paragraph (7) Bulkheads Subparagraph (7)(A) states, "Bulkhead alignment, for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level." Inconsistent: The proposed bulkhead alignment averages t15.5' waterward of NWl.. The previous bulkhead on the lot was breached in early 2020. The applicant is only proposing to relocate the new bulkhead in the alignment of the previous bulkhead. The proposed bulkhead alignment will tie into the existing bulkhead on the south eastern corner of the lot and will align with the exiting riprap located at the north west corner. Recommendations December 17, 2021 Page 3 Subparagraph (7)(B) states, "Bulkheads shall be constructed landward of coastal wetlands in order to avoid significant adverse impacts to the resources." Consistent: The proposed development is consistent with the intent of this rule. Subparagraph (7)(C) states, "Bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management pursuant to this Section, or if the bulkhead is a pan of a permitted project involving excavation from a non -upland source, the material so obtained may be contained behind the bulkhead." Consistent: The applicants have indicated that clean fill will be used. Subparagraph (7)(D) states, "Bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, whether it results from natural causes or adjacent bulkheads, or it has unusual geographic or geologic features, e.g. steep grade bank, which will cause the applicant unreasonable hardship under the other provisions of this Rule; Consistent: The proposed development is consistent with the intent of this rule. (ii) the bulkhead alignment extends no further below normal high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geologic features; Consistent: The proposed development is consistent with the intent of this rule. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners; Consistent: The proposed development is consistent with the intent of this rule. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management; Consistent: The proposed development is documented in a Field Investigation Report. SUBJECT: Major Permit Request by Betty Collier to install 100 linear feet of vinyl bulkhead and a 10 foot wide by 100 foot long section of riprap on the Albemarle Sound; at 288 Griggs Acres Drive, in the Point Harbor community, Currituck County. DATE: January 4, 2022 Consistency Determination: The request is consistent with/not in conflict with the Currituck County 2006 Core Land Use Plan (LUP) certified by the CRC on May 18, 2007 as amended through December 7, 2021. Overview: The .57 acre subject property has approximately 100 linear feet of shoreline along the Albemarle Sound. Water depths near the shoreline range from -.5 foot to -2 feet and average - 1.5 feet. Vegetation consists of yard grasses and trees. Site elevation is approximately 10 feet above Normal Water Level (NWL). The site is located primarily outside of a floodzone, with shoreline located in the AE floodzone. A single-family house is located on the site. Existing shoreline improvements consist of a failing bulkhead and two (2) remnant groins/return walls, one at each property line. The bulkhead failed between July 2019 and February 2020, resulting in erosion, with the bulkhead alignment being located 20 feet waterward of NWL. Since erosion occurred within the previous year, CAMA General Permit 78713A was issued in November 2020 to allow for construction of a new bulkhead in the same alignment. The bulkhead was not constructed and it has now been over a year since the bulkhead failed. Installation of 100 linearfeet of vinyl bulkhead and a 10 foot wide by 100 foot long section of riprap is proposed. The bulkhead will be located along the same alignment and tie into the existing remnant groins/return walls at the property lines. Given the erosion that has occurred, the bulkhead will be located a maximum distance of 26 feet and an average distance of 15.5 feet waterward of NWL. Backfill material will be obtained from a clean upland source. Riprap will be installed immediately waterward of the bulkhead. No submerged aquatic vegetation was observed growing at the project site. Based on available information, there appear to be no archaeological sites on or near the property. Anticipated impacts resulting from this project are expected to include: the filling of 2,550 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC) and 2,450 sq. ft. of High Ground within the Estuarine Shoreline AEC. Basis for Determination: The property is designated as "Limited Service" on the Currituck County Future Land Use Map (FLUM); with Areas of Environmental Concern (AECs) also designated as "Conservation Areas" as indicated on Page 11-1. The property is also located in the "Point Harbor" sub area. As indicated on Page 11-1, the purpose of the Conservation designation is to provide for the long- term management and protection of significant, limited, or irreplaceable areas. Proper management is needed to conserve the natural, cultural, recreational, scenic or biologically productive values of these areas. The designation is applied to areas that should not be developed at all (preserved), or if developed, done so in a very limited manner characterized by careful planning and' cautious attention to the conservation of environmental features. As indicated on Page 11-2, the standards of the Conservation class shall be applied in accordance with the site specific information made available during special studies and/or the land development process. Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial support". RECEIVED DEC 22 2021 DCM-MHD CITY Betty Collier Field Investigation Report Page 2 Proiect Setting The project site is located at 288 Griggs Acers Drive, Point Harbor, Currituck County, and is adjacent to the Albemarle Sound. The lot is 24,829 ft2 (.57 acres) in size with an elevation of approximately 10' above NWL. Manmade features on the property consist of a single family dwelling and 2 remnant groins. The properties shoreline was recently hardened with a wooden bulkhead which failed between July of 2019 and February 2020 (Source: satellite imagery) most likely due to a storm event. (Most likely Hurricane Dorian September 2019). The breached bulkhead was first observed during a site visit on 3-8-2020 by DCM staff and at the time of the site visit the maximum distance waterward of the original bulkhead alignment to NWL was 20'. Because the erosion occurred within the previous year, per 15A NCAC 07H. 1105(a)(3), CAMA General Permit 78713A was issued on 11-4-2020 to construct a new bulkhead in the original alignment. Development authorized through this permit did not occur and it has now been longer than 1 year since the breach. According to the USDA's Natural Resources Conservation Service's Web Soil Survey, the soil on the property is made up of Conetoe loamy sand. Vegetation includes yard grasses and trees. No wetlands were observed. Based on available information, no archaeological sites are on or near this property. The adjacent riparian property to the northwest contains a single family dwelling with a riprap shoreline and a docking facility made up of a pier, platform, and a boatlift. The adjacent property to the southeast contains a single family dwelling, a bulkheaded shoreline and an aging pier with attached boatlift. The location of the proposed development is within the Albemarle Sound and is classified as Coastal waters by agreement with the Marine Fisheries Commission and Wildlife Resources Commission. The Division of Environmental Management's water quality classification for this area is SC and it is closed to shellfish taking. Water depths within the project site range from -0.5' to -2 and average -1.5'. Submerged aquatic vegetation, as per DMF's definition, was not observed in the proposed project location. Development Proposal To prevent further erosion and to protect the existing dwelling, the applicants propose to construct a 100' long vinyl bulkhead in the same alignment as the previous bulkhead which will tie into the adjacent bulkhead to the southeast and will connect to the remaining return wall on the northwest corner. This alignment will be the same as the previously breached bulkhead. This alignment will result in a maximum distance waterward of 26', and will average 155, as measured from normal water level. All backfill material will be from a clean upland source. In addition to the proposed bulkhead, the applicants propose to install riprap immediately waterward of the newly constructed bulkhead. This riprap will extend no more than 10' waterward of the proposed bulkhead. Anticipated Impacts • The construction of the bulkhead along the proposed alignment will result in the filling of t1,550 ft2 of the PTA and EW AEC and t2,450 ft2 of highground with clean fill from an upland source along 100' of the ES AEC. • The installation of the riprap will result in the filling of t1,000 ft2 of the PTA and EW AEC.
