This permit, issued on March 16, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Docking Facility
This permit authorizes only the docks, piers, gazebo, and other structures and uses located in or over
the water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) This permit authorizes a maximum of 2 formalized boat slips.
(See attached sheets for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of
the width of the water body. Measurements to determine width of the water body shall be made from the
mean high-water line or the waterward edge of any coastal wetland vegetation which borders the water
body, whichever is more restrictive.
4) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six
feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured
from the bottom of the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or .
inclement weather.
6) In accordance with commitments made by the permittee and in order to satisfy concerns of the resource
agencies, physical stops shall he placed on the floating dock and boatlift at a minimum height of 18" above
the bottom substrate to prevent the floating dock and boatlift from disturbing the bottom substrate. The
physical stops shall remain in place for the life of the permitted docking facility.
7) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches are permitted.
Lattice is specifically excluded from being used under this authorization.
8) The roof of the gazebo shall not be designed for second story use.
0) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
10) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with .
NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or
excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat
propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire
existence of the permitted structure.
Sedimentation and Erosion Control
12) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.

General
14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
15) All construction debris associated with the removal or construction of the permitted docking facilities
shall be contained within the authorized project area and disposed of in an approved upland location.
1.6) . The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers has assigned the proposed project SAW Action Id. No. 2015-
01264
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4622 and assigned the project DWR Project No. 20150580v2.
NOTE: Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the mean high-water level.

restoration order, a Class I administrative penalty, and/or appropriate legal action.
This verification will remain valid until the expiration date identified below unless the nationwide
and/or regional general permit authorization is modified, suspended or revoked. If, prior to the
expiration date identified below, the nationwide and/or regional general permit authorization is
reissued and/or modified, this verification will remain valid until the expiration date identified below,
provided it complies with all requirements of the modified nationwide permit. If the nationwide and/or
regional general permit authorization expires or is suspended, revoked, or is modified, such that the
activity would no longer comply with the terms and conditions of the nationwide permit, activities
which have commenced (i.e., are under construction) or are under contract to commence in reliance
upon the nationwide and/or regional general permit, will remain authorized provided the activity is
completed within twelve months of the date of the nationwide and/or regional general permit's
expiration, modification or revocation, unless discretionary authority has been exercised on a case -
by -case basis to modify, suspend or revoke the authorization.
Activities subject to Section 404 (as indicated above) may also require an individual Section 401

Recommendations for State Permit- Long Private Docking Facility
The square footage of the proposed docking facility is calculated as follows:
Shoreline length =103 ft. x 8 sq. ft. = 824 sq. ft. allowable.
Proposed:
Access Pier = 6' x 453' (As measured from NHW) = 2,718 ft. (Credit)
Finger pier = 6' x 8' = 48 sq. ft.
Floating Dock = 8' x 24' =192 sq. ft.
Gazebo =12' x 18' = 216 sq. ft.
Open Platform = 10' x 16' =160 sq. ft.
Boatlift =13' x 13' =169 (Not Counted)
Total (proposed) = 616 sq. ft.
The proposed development would provide docking space for a total of two (2) vessels. The proposed docking
facility would extend 147' beyond the marsh, terminating at the established pier -head line and remaining landward
of the 'A width limit. This distance would be CONSISTENT with NCAC 07H .0208 (b)(6)(6)(iii). The
application appears to be CONSISTENT with the remaining use standards set forth in NCAC 07H .0208 (b)(6),
including those which dictate the maximum allowable platform area, the 15' riparian setback, and the federal
channel setback.

Consistency Determination:
This project is consistent with the Sunset Beach Land Use Plan Update.
The applicant proposes to install a private pier with a gazebo, open platform, floating
dock, and boatlift for a total of two formalized slips on the AIWW. The property is
located at 516 Twisted Oak Lane, adjacent to the AIWW in Sunset Beach, Brunswick
County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT, CW and EW.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use
Plan and offer the following comments.
The general area of the project is classified as Mainland Residential.
In general, the Town of Sunset Beach allows development in Mainland Residential
classified AECs which is consistent with the State's minimum use standards. The Town
of Sunset Beach Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Town of Sunset Beach Land Use Plan.

A North Carolina Division of Marine Fisheries (DMF) Fisheries Resource Specialist has
reviewed the CAMA Major Permit application for proposed actions that impact fish and fish,
habitats. The applicant proposes to install a private pier with a gazebo, open platform,
floating dock, and boatlift for a total of two formalized slips on the AIW W. The waters of the
AIW W are classified SA by the Division of Water Resources and are designated as a Primary
Nursery Area (PNA) by the N.C. Division of Marine. Fisheries. They are closed to the harvest
of shellfish.
The applicant proposes to build a 6' x 470' access pier (as measured from MHW) that
would originate from an upland point and extend toward the southeast The proposed
access pier would lead to a 6' x 8' finger pier on the west side of the pier. The finger pier
would lead to a gangway and down to an 8' x 24' floating dock oriented perpendicular to
the shoreline. Water depths verified by DCM staff show -1.3' MLW at the waterward end of
the proposed boatlift and floating dock. Water depths on the landward side of the proposed
floating dock show -.6.'' L1DC Due to the minimal water depths the DMF supports this
application as the design includes the floating dock would be outfitted with 'stops' at 8"
a o�the substrate, and the 13' x 13' open boatlift would also be outfitted with 'stops' at
18" above the substrate to minimize damage to the soft bottom habitat

Dear Mr. & Mrs. Long:
Attached hereto is a copy of Certification No. WQC004622 issued to Mark and Regina Long, dated January
28, 2022. This Certification replaces the Certification issued on July 16, 2015. This approval is for the
purpose and design described in your application. The plans and specifications forthis project are
incorporated by reference as part of this Water Quality Certification. If you change your project, you must
notify the Division and you may be required to submit a new application package with the appropriate fee.
If the property is sold, the new owner must be given a copy of this Certification and is responsible for
complying with all conditions. [15A NCAC 02H .0507(d)(2)].
This Water Quality Certification does not relieve the permittee of the responsibility to obtain all other
required Federal, State, or Local approvals before proceeding with the project, including those required
by, but not limited to, Sediment and Erosion Control, Non -Discharge, Water Supply Watershed, and Trout
Buffer regulations.
This Water Quality Certification neither grants nor affirms any property right, license, or privilege in any
lands or waters, or any right of use in any waters. This Water Quality Certification does not authorize any
person to interfere with the riparian rights, littoral rights, or water use rights of any other person and does
not create any prescriptive right or any right of priority regarding any usage of water. This Water Quality
Certification shall not be interposed as a defense in any action respecting the determination of riparian or
littoral rights or other rights to water use. No consumptive user is deemed by virtue of this Water Quality
Certification to possess any prescriptive or other right of priority with respect to any other consumptive
user.
Upon the presentation of proper credentials, the Division may inspect the property.
This Water Quality Certification shall expire on the same day as the expiration date of the corresponding
Section 404 Permit. The conditions shall remain in effect for the life of the project, regardless of the
expiration date of this Water Quality Certification.

Non-compliance with or violation of the conditions herein set forth may result in revocation of this Water
Quality Certification for the project and may also result in criminal and/or civil penalties.
If you are unable to comply with any of the conditions of this Water Quality Certification you must notify
the Wilmington Regional Office within 24 hours (or the next business day if a weekend or holiday) from
the time the permittee becomes aware of the circumstances.
The permittee shall report to the Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards 115A NCAC 02B .0200] including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next business
day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.
This approval and its conditions are final and binding unless contested [G.S. 143-215.5].
This Certification can be contested as provided in Chapter 150B of the North Carolina General Statutes by
filing a Petition for a Contested Case Hearing (Petition) with the North Carolina Office of Administrative
Hearings (OAH) within sixty (60) calendar days. Requirementsfor filing a Petition are set forth in Chapter
150B of the'North Carolina General Statutes and Title 26 of the North Carolina Administrative Code.

CERTIFICATION #WQc004622 is issued in conformity with the requirements of Section 401, Public Laws 92-
500 and 95-217 of the United States and subject to North Carolina's Regulations in 15 NCAC 02H .0500 and
15A NCAC 026 .0200, to Michael and Regina Long; who have authorization for the impacts listed below, as
described within your application received by the N.C. Division of Water Resources (Division) on December
10, 2021, and by Public Notice issued by the Division of Coastal Management on December 16, 2021.
The State of North Carolina certifies that this activity will comply with water quality requirements and the
applicable portions of Sections 301, 302, 303, 306, 307 of the Public Laws 92-500 and PL 95-217 if

CONDITIONS OF CERTIFICATION [15A NCAC 02H .0507(c)]:
1. You will comply with any moratoriums perthe NC Division of Marine Fisheries and the NC Wildlife
Resources Commission. Dredging moratoriums shall be observed as required by the NC Division of
Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and National Marine Fisheries. If such
activities should take place during periods of high biological activity (e.g. anadromous species and
shorebirds), biological monitoring may be required at the request of other state and federal agencies
and coordinated.with these dredging activities.

2. The Permittee shall adhere specially to 15A NCAC 02B .0220 Tidal Salt Water Quality Standards for
Class SC Waters.
(12) pH: shall be normal for waters in the area, which generally shall range between 6.8 and 8.5
except that swamp waters may have a pH as low as 4.3 if it is the result of natural conditions;

(19) Turbidity: the turbidity in the receiving water shall not exceed 25 NTU; if turbidity exceeds this
level due to natural background conditions, the existing turbidity level shall not be increased.

3. The waters of the AIWW in the location are classified as SA;HQW by the Division of Water Resources
(DWR) and has been determined to be a Primary Nursery Area (PNA) by the Division of Marine
Fisheries (DMF). Please understand that the waters around your project area have been identified as
a PNA, and should requests for dredging within the proposed project area arise in the future, they will
be denied. Please be aware that new dredging within a PNA is not permitted under 15A NCAC 02B
.0220. This activity results in degradation of water quality standards and is therefore considered a
water quality violation. Any turbidity standard violations of waters going into these creeks are also
considered Water Quality Violations.

4. The permittee shall report to the DWR Wilmington Regional Office any noncompliance with, and/or any
violation of, stream or wetland standards 115A NCAC 02B .0200], including but not limited to sediment
impacts to streams or wetlands. Information shall be provided orally within 24 hours (or the next
business day if a weekend or holiday) from the time the permittee became aware of the non-compliance
circumstances.

5. No waste, spoil, solids, or fill of any kind shall occur in wetlands or waters beyond the footprint of the
approved impacts (including temporary impacts).

6. When applicable, all construction activities shall be performed and maintained in full compliance with
G.S. Chapter 113A Article 4 (Sediment and Pollution Control Act of 1973). Regardless of applicability of
the Sediment and Pollution Control Act, all projects shall incorporate appropriate Best Management
Practices for the control of sediment and erosion so that no violations of state water quality
standards, statutes, or rules occur.
Design, installation, operation, and maintenance of all sediment and erosion control measures shall be
equal to or, exceed the requirements specified in the most recent version of the North Carolina
Sediment and Erosion Control Manual, or for linear transportation projects, the North Caroline
Department of Transportation Sediment and Erosion Control Manual.
All devices shall be maintained on all construction sites, borrow sites, and waste pile (spoil) sites,
including contractor -owned or leased borrow pits associated with the project. Sufficient materials
required for stabilization and/or repair of erosion control measures and stormwater routing and
treatment shall be on site at all times.
For borrow pit sites, the erosion and sediment control measures shall be designed, installed, operated,
and maintained in accordance with the most recent version of the North Carolina Surface Mining
Manual. Reclamation measures and implementation shall comply with the reclamation in accordance
with the requirements of the Sedimentation Pollution Control Act and the Mining Act of 1971.

If the project occurs in waters or watersheds classified as Primary Nursery Areas (PNAs), SA, WS-I, WS-
II, High Quality Waters (HQW), or Outstanding Resource Waters (ORW), then the sedimentation and
erosion control designs shall comply with the requirements set forth in 15A NCAC 04B .0124, Design
Standards in Sensitive Watersheds.

7. Sediment and erosion control measures shall not be installed in wetland or waters except within the
footprint of temporary or permanent impacts otherwise authorized by this Certification. If placed
within authorized impact areas, then placement of such measures shall not be conducted in a manner
that results in dis-equilibrium of any wetlands, streambeds, or streambanks. Any silt fence installed
within wetlands shall be removed from wetlands and the natural grade restored within two (2)
months of the date that DEMLR or locally delegated program has released the specific area within the
project to ensure wetland standards are maintained upon completion of the project.

8. Erosion control matting that incorporates plastic mesh and/or plastic twine shall not be used along
streambanks or within wetlands.

9. If the project is covered by NPDES Construction Stormwater Permit Number NCG010000 or NPDES
Construction Stormwater Permit Number NCG250000, full compliance with permit conditions
including the erosion & sedimentation control plan, inspections and maintenance, self -monitoring,
record keeping and reporting requirements is required.

10. Application of fertilizer to establish planted/seeded vegetation within disturbed riparian areas and/or
wetlands shall be conducted at agronomic rates and shall comply with all other Federal, State and
Local regulations. Fertilizer application shall be accomplished in a manner that minimizes the risk of
contact between the fertilizer and surface waters.

11. If concrete is used during construction, then all necessary measures shall be taken to prevent direct
contact between uncured or curing concrete and waters of the state. Water that inadvertently
contacts uncured concrete shall not be discharged to waters of the state.

12. All mechanized equipment operated near surface waters shall be inspected and maintained regularly
to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or other toxic
materials. Construction shall be staged in order to minimize the exposure of equipment to surface
waters to the maximum extent practicable. Fueling, lubrication, and general equipment maintenance
shall be performed in a manner to prevent, to the maximum extent practicable, contamination of
surface waters by fuels and oils.

14. In accordance with 143-215.85(b), the permittee shall report any petroleum spill of 25 gallons or
more; any spill regardless of amount that causes a sheen on surface waters; any petroleum spill
regardless of amount occurring within 100 feet of surface waters; and any petroleum spill less than 25
gallons that cannot be cleaned up within 24 hours.

15. The permittee and their authorized agents shall conduct all activities in a manner consistent with State
water quality standards (including any requirements resulting from compliance with 4303(d) of the
Clean Water Act), and any other appropriate requirements of State and Federal Law.

16. The permittee shall require its contractors and/or agents to comply with the terms and conditions of
this permit in the construction and maintenance of this project, and shall provide each of its

project site during the construction and maintenance of this project.

9. PROJECT DESCRIPTION
The property consists of a residential house located on a 1.72-acre parcel approximately 8' above normal high
water (NHW) and is vegetated with landscape grasses and typical coastal -plain tree species. The property has
approximately 103 linear feet of shoreline frontage along the southern edge of the property and is stabilized
with native vegetation. High marsh Coastal Wetlands within the property's riparian corridor extend
approximately 35' waterward of the high ground and include Saltmeadow Cordgrass (Spartina patens) and
Spike Grass (Distichlis spicata). The low marsh extends approximately 306' waterward of the high marsh and
consists of a vast mud flat and sporadic patches of dense Smooth Cordgrass (Spartina altern flora). The
proposed docking facility would be located entirely over open water in the AIW W. Residential properties
border the project site to the west and east. The width of the AIW W measures approximately 630' at the
proposed project site.
The waters of the AIW W are classified SA by the Division of Water Resources and ARE designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish. Based on visual observations made by DCM staff during the December 2021 site visit, there appears
to be NO Submerged Aquatic Vegetation (SAV) in the surrounding waters. Water depths at the waterward end
of the proposed docking facility are approximately -1.3' MLW, according to the applicant. These measurements
were confirmed by DCM during a site visit on 12-1-2021. Tidal amplitude in the project area is approximately
6' between MLW and MHW.
PROPOSED PROJECT
The applicant proposes to install a private pier with a gazebo, open platform, floating dock and boatlift for a
total of two formalized slips on the AIW W.
The applicant proposes to build a 6' x 470' access pier (as measured from MHW) that would originate from an
upland point and extend toward the southeast. The proposed access pier would lead to a 6' x 8' (48 sq. ft.)
finger pier on the west side of the pier. The finger pier would lead to a gangway and down to an 8' x 24' (192
sq. ft.) floating dock (Slip 1, See Sheet 3 of 4) oriented perpendicular to the shoreline. As proposed, the floating
dock would be outfitted with `stops' at 18" above the substrate due to insufficient water depths in the project
area. The access pier would continue south beyond the finger pier another 3' and terminate with a 12' x 18'
(216 sq. ft.) gazebo and a 10' x 16' (160 sq. ft.) open platform (See Sheet 3 of 4). To the west of the open
platform, a 13' x 13' open boatlift (Slip 2) would also be outfitted with `stops' at 18" above the substrate to
minimize damage to the soft bottom habitat. Water depths verified by DCM staff show -1.3' MLW at the
waterward end of the proposed boatlift and floating dock. Water depths on the landward side of the proposed
floating dock show -.6' MLW.

10. ANTICIPATED IMPACTS
The property has approximately 103 linear feet of shoreline and the facility's design appears to remain within
the applicant's area of riparian access and would not encroach into either 15 ft. adjacent riparian access. The
applicant's design extends to the pier head line of adjacent docking facilities and does not exceed the %width
of the waterbody. According to the applicant's measurements, the docking facility would extend across
approximately 23% of the waterbody. The proposed design would terminate approximately 67' landward of the
USACOE 80' federal channel setback.
According to the application, the proposed docking facility would incorporate approximately 1,547 sq. ft. of
Estuarine and Public Trust Area and would shade approximately 2,046 sq. ft. of Coastal Wetlands. The
proposed boatlift and floating dock would be located over an area of shallow water (-.6' MLW to -1.36' MLW
as verified by DCM staff) in a Primary Nursery Area. The installation of stops located at 18" above the
substrate could theoretically reduce impacts to soft bottom habitat while limiting usage to periods of mid and
high tides. Despite using stops to physically limit the structure height above the substrate, prop scouring in
critical habitat is still a concern during ingress and egress. Minor increases in turbidity should be expected
during construction.

The Owner of 516 Twisted Oak Lane in Sunset Beach NC wishes to install a new pier two at their property. The pier will extend
to the existing pier head line approximately 430 Linear feet from MHW.
The pier head will consist of a 10'x 16' open deck with a 18'x 12' covered deck. Additionally, the pier head will host two boat

The Division of Coastal Management hereby acknowledges receipt of your application for State approval for the
construction of a 2-slip docking facility located at 516 Twisted Oak Lane, Sunset Beach, Brunswick County. It was
received complete on December &i 2021 and appears to be adequate for processing at this time. The projected
deadline for making a decision is Feb 19di, 2022. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated
above, you should consider the review period extended. Under those circumstances, this letter will serve as your
notice of an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from December 61, 2021 you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing' postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
