This permit, issued on February 21, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Shoreline Stabilization — Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) No open water shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. 3) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Brandon Mitchell Permit No. 17-22 Page 2 of 3 ADDITIONAL CONDITIONS 4) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal or vinyl sheet piles, or other suitable materials approved by Division personnel. 5) The bulkhead shall be constructed prior to any backfilling activities. 6) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 7) This permit does not authorize any excavation waterward of the approved alignment. 8) The fill material shall be clean and free of any pollutants except in trace quantities. 9) Unless altered herein, all backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. , 10) No backfill material is to be placed within 30 feet of the normal water level, except that which will be used to backfill the area behind the permitted bulkhead. 11) All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. Docking Facility 12) This permit authorizes only the piers and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non - water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 13) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 14) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 15) This permit authorizes a maximum of three (3) formalized boat slips. 16) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access. 17) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Brandon Mitchell Permit No. 17-22 Page 3 of 3 ADDITIONAL CONDITIONS 18) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. Upland Development 19) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the boardwalk, all as expressly and specifically set forth in the attached permit application and workplan drawings. Sedimentation and Erosion Control 20) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 21) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. 22) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. General 23) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 24) All construction debris associated with the removal or construction of the permitted development shall be contained within the authorized project area and disposed of in an approved upland location. 25) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2022-00131). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2021-1857. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. SE."EC `Ia.`�'.�N INHHO SUBJECT: Brandon Mitchell;156 Sir Chandler Drive, Colington Major Permit Recommendations The applicant proposes the construction of a ± 57' replacement bulkhead along a hardened shoreline (existing derelict bulkhead) that will tie into existing bulkheads along adjacent properties. The proposed alignment will average 10' waterward of Normal Water Level (NWL) with a maximum distance of 14' waterward. In addition to the bulkhead, the applicant is proposing the construction of a 34'x5' pier with a 5'x7' lower platform, 19'x10' boat lift, and 6'x3' PWC lift located on the eastern side of the pier. Three designated mooring slips (a boat lift, a PWC lift, and an area to the west of the proposed pier) are being proposed as part of the docking facility. Associated high ground development proposed is the construction of a 57'x6' slatted wooden boardwalk along the bulkhead alignment and a 25'x6' slatted wooden walkway from the upland area for a total of 492 W. The site of the proposed development is located at 156 Sir Chandler Drive (Lot 68) within Section B of the Colington Harbour subdivision. The property is located in Colington, Dare County and is adjacent to a canal known as Frigate Inlet which connects to the Albemarle Sound. The proposed development involves the Public Trust Area (PTA), Estuarine Waters (EW), and Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's). I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this project and my findings are as follows: 15A NCAC 07H.0208 Use Standards Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are not water dependent within the EW and PTA and lists uses that may be considered water dependent. Consistent: The applicant proposes to construct a pier, platform, boat lift, and PWC Lift. This sub -paragraph considers these structures as water dependent. Consistent: The development is designed to not interfere with shellfish beds, submerged aquatic vegetation (SAV), and/or spawning and nursery -areas. -The location is not within any primary nursery areas and is closed to shellfish taking. No SAV was reported to be growing within the project area, and the area is not designated by NCDMF as SAV habitat. Paragraph (a)(2)(B) states that development shall comply with state and federal water and air quality standards. Consistent: The proposed development will not violate water & air quality standards. Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented archaeological or historic resources as identified by the N.C. Department of Cultural Resources. Consistent: There are no known archeological or historical resources on the property. Paragraph (a)(2)(D) states that development shall not increase siltation. Consistent: It does not appear that the development will measurably increase siltation. Paragraph (a)(2)(E) states that development shall not create stagnant water bodies. Consistent: It does not appear that the development will create stagnant water bodies. Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts on life cycles of estuarine and ocean resources. Consistent: The proposed development will have minimum adverse effects on the life cycle of estuarine resources. Paragraph (a)(2) (G) states that development shall not jeopardize the use of the waters for navigation or for other public trust rights in public trust areas including estuarine waters. Consistent: The development proposes minimal effects on navigation. Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (6) Piers and Docking Facilities and (7) Bulkheads pertain to this project, and those subparagraphs not listed are not applicable to this project. , IE cc :a Paragraph (b) (6) (A) states that piers shall not exceed six feet in width. Brandon Mitchell January 31, 2022 Page 3 of 8 Paragraph (b)(6)(B) states that the total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. Consistent: The shoreline of the property is ± 57 feet in length allowing for 456 ftz of shading impact.. The proposed platform will shade 35 W. Therefore, the total area of applicable shading impacts will be significantly less than 456 W. Paragraph (b)(6)(C) states piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking. Consistent: The development will not impact any wetlands. Paragraph (b)(6)(D) states a boathouse shall not exceed 400 square feet except to accommodate a documented need for a larger boathouse and shall have sides extending no farther than one-half the height of the walls and covering only the top half of the walls. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Consistent: No boathouse is proposed with this development. Paragraph (b)(6)(E) states the total area enclosed by an individual boat lift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift. Consistent: One boat lift and one PWC lift are being proposed with this development. The boat lift, being the largest of the two lifts, is 19'x10' or 190 ftz which is less than the 400 square feet allowed. Paragraph (b)(6)(F) states piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow for second story use. Consistent: The proposed piers and docking facilities are all single story and no roofed areas are being proposed. Paragraph (b)(6)(G) states piers and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use. Consistent: The proposed pier and docking facility length is consistent with other established piers along the same shoreline. (ii) not extending into the channel portion of the water body. Consistent: The proposed pier and docking facility will not be extended it o the c"% E' portion of the water body. F E B 1 2022 Brandon Mitchell January 31, 2022 Page 4 of 8 (iii) not extending more than one-fourth the width of a natural water body, or human -made canal or basin. Consistent: The width of the canal adjacent to the project location is estimated to average ± 129 feet across to the opposite shoreline. The proposed pier, at 31' in length, is below one- fourth the width (± 32') of the water body. Paragraph (b)(6)(H) states piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of 1 foot each 100 foot increments of length longer than 400 feet. Consistent: The proposed docking facility is 31 feet in length and less than 400 feet. Paragraph (b)(6)(1) states piers and docking facilities shall not interfere with the access to any riparian property and shall have a minimum setback of 15 feet between any part of the pier or docking facility and the adjacent property owner's area of riparian access. Consistent: The proposed docking facility is located 15' west of the eastern property line and 27' east of the western property line. The docking facility will not encroach within either 15' setback. Paragraph (b)(6)(J) states applicants for authorization to construct a pier or docking facility shall provide notice of the permit application to the owner of any part of a shellfish franchise or lease over which the proposed dock or pier would extend. The applicant shall allow the lease holder the opportunity to mark a navigation route from the pier to the edge of the lease. Consistent: The location of the proposed development is adjacent to a canal which is closed to shellfish taking. Paragraph (b)(7)(A) states bulkhead alignments for the purpose of shoreline stabilization, shall approximate the location of normal high water or normal water level. Inconsistent: The location of the proposed bulkhead is waterward of normal water level (NWL) an average of± 10 feet with a maximum of 14 feet. (Please refer to Paragraph (b)(7)(D) for consistency) Paragraph (b)(7)(B) states bulkheads shall be constructed landward of coastal wetlands in order to avoid significant impacts to the resources. Consistent: The location was found to contain no coastal wetlands. Paragraph (b)(7)(C) states bulkhead backfill material shall be obtained from an upland source approved by the Division of Coastal Management. Consistent: The fill will consist of clean soil and sand. F1 CIE INT D FEB 1 2.022 Ft""'IF, S t C T I Q N M `D Brandon Mitchell January 31, 2022 Page 5 of 8 Paragraph (b)(7)(D) states bulkheads shall be permitted below normal high water or normal water level only when the following standards are met: (i) the property to be bulkheaded has an identifiable erosion problem, which will cause the applicant unreasonable hardship under the other provisions of this Rule. Consistent: The property does have an identifiable erosion problem. (ii) the bulkhead alignment extends no further below high water or normal water level than necessary to allow recovery of the area eroded in the year prior to the date of application, to align with adjacent bulkheads, or to mitigate the unreasonable hardship resulting from the unusual geographic or geological features. Consistent: The proposed bulkhead alignment extends beyond NWL for the purpose of aligning with existing adjacent bulkheads. (iii) the bulkhead alignment will not adversely impact public trust rights or the property of adjacent riparian owners Consistent: An objection was raised by an adjacent property owner mostly in regards to the reported rate of erosion by the applicant. His objection did not directly identify the proposed bulkhead alignment as an issue and is not anticipated to adversely affect his bulkheaded property. The public trust rights, while impacted, are not adversely so as the proposed alignment is t 2' in front of an existing derelict concrete bulkhead and even with adjacent bulkhead alignments. (iv) the need for a bulkhead below normal high water or normal water level is documented by the Division of Coastal Management. Consistent: The Division of Coastal Management has documented a need for a bulkhead below normal water level. (v) the property to be bulkheaded is in a non -oceanfront area. Consistent: The property is adjacent to a canal which leads to the Albemarle Sound and is in a non -oceanfront area. Paragraph (b)(7)(E) states where possible, sloping rip -rap, gabions, or vegetation shall be used rather than bulkheads. Consistent: Due to the location being adjacent to a canal with hardened shorelines on either side and the wave energy from consistent boat traffic, a bulkhead may be the best method of shoreline stabilization at this location. It is the historic method as seen by the existing derelict concrete bulkhead. FEB 1 n22 Brandon Mitchell January 31, 2022 Page 6 of 8 15A NCAC 07H.0209 Use Standards Paragraph (d) addresses General Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: Paragraph (d)(1) states all development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, resistant clay shorelines, and cypress -gum protective fringe areas adjacent to vulnerable shorelines. Consistent: The proposed development is consistent with the intent of this rule as the shoreline was previously hardened & does not contain any of the conditions listed. Paragraph (d)(2) states all development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Impervious surfaces shall not exceed 30 percent of the AEC area ofthe lot, unless the applicant can effectively demonstrate, through innovative design, that the protection provided by the design would be equal to or exceed the protection by the 30 percent limitation. Redevelopment of areas exceeding the 30 percent impervious surface limitation maybe permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. Consistent: The proposed landward development will be constructed using wooden decking and clean sand/soil as fill material. The development is therefore considered pervious. Paragraph (d)(3) states all development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. Consistent: The. proposed development is consistent with the intent of this rule. (B) No development project proposal or design shall permit an angle for graded slopes or fill which rt^m cs'^ n Md is greater than an angle which can be retained by vegetative cover or other ° con�r,,(, es or structures. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Consistent: The land disturbance proposed by the development is ± 1,357 W or 0.03 acres which is below one acre of disturbance. Paragraph (d) (4) states development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Consistent: The proposed development is consistent with the intent of this rule. Paragraph (d)(5) states development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. Consistent: The development proposed will not interfere with public rights of access and will enhance accessibility for the property owners and other users of the property. Paragraph (d)(6) states no public facility shall be permitted if such a facility is likely to require public expenditures for maintenance and continued use, unless it can be shown that the public purpose served by the facility outweighs the required public expenditures for construction, maintenance, and continued use. Consistent: The proposed development is intended for private use. Paragraph (d)(7) states development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Cultural Resources. Consistent: There are no known archaeological or historical resources on the property. Paragraph (d)(8) states established common-law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Overview: The. 19 acre vacant and unimproved subject property has approximately 57 linear feet of shoreline along Frigate Inlet Canal, which connects to the Albemarle Sound. The canal ranges from 120 feet to 138 feet wide at the subject property. Water depths in the canal are — 3 feet to - 5 feet below Normal Water Level (NWL) between the shoreline and 31 feet waterward of the shoreline. Site elevation averages approximately 3.1 feet above NWL. The site is vegetated with lawn grasses, with some trees along the shoreline. An erosion escarpment averaging approximately 2.5 feet above NWL is located near the shoreline. The property is located primarily within the AE(4) Floodzone, with some Shaded X to the south and southeast. Existing shoreline improvements consist of a failed and submerged concrete bulkhead located an average of 10 feet waterward of NWL. There is no record of CAMA permits being issued for the property, but since the lot was platted in 1968 it is possible that the failed bulkhead was installed before creation of the Coastal Area Management Act and any associated permitting requirements. The wooden walkway will connect upland areas on the property to the shoreside boardwalk, with the boardwalk connecting to the pier and platform. The Albemarle Sound in this area is classified as SB and Joint Waters and is closed to shellfishing. No Submerged Aquatic Vegetation (SAV) was reported in the project area. A review of historic and archaeological resources was not provided. Anticipated Impacts resulting from this project are expected to include: the shading of 398 sq. ft. of Public Trust Area/Estuarine Waters Areas of Environmental Concern (AEC); the filling of 467 sq. ft. of Public Trust Area/Estuarine Waters AEC, and; the coverage of 342 sq. ft. of Estuarine Shoreline AEC and 150 sq. ft. of Highground outside of an AEC. Basis for Determination: The Dare County Land Classification Map identifies the subject property as "Community Residential". As indicated on Page 217, the "Conservation" designation applies to all CAMA Areas of Environmental Concern (AECs). PROJECT SUMMARY: The applicant proposes the construction of a replacement bulkhead along a hardened shoreline (existing derelict bulkhead) that will tie into existing bulkheads on adjacent properties. The construction of a pier, lower platform, boat lift, PWC lift, boardwalk, and walkway is also proposed in the center of the lot for water access use. Project Setting The proposed development is located at 156 Sir Chandler Drive (Lot 68) within Section B of the Colington Harbour subdivision. The property is located in Colington, Dare County, adjacent to a canal known as Frigate Inlet which connects to the Albemarle Sound. The property is platted at ± 8,230 ftz (± 0.19 acres) and contains ± 57' of shoreline. Elevation averages ± 3.1' above Normal Water Level (NWL) in the high ground areas. At this time, the lot is vacant and undeveloped containing no man-made features. The property is primarily vegetated with domestic lawn grasses and cacti species, but also contains a small wooded area adjacent to the shoreline with semi -evergreen trees, Smilax species, and wax myrtle. The shoreline of the property was previously hardened and contains an existing, failed, concrete bulkhead that extends an average of 10' waterward of NWL and is currently under the water's surface. An erosion escarpment exists landward of the existing concrete bulkhead and averages ±2.5' above NWL. The landward side of the erosion escarpment is mostly woody species while the waterward side is unvegetated sand and remnant tree root systems. The applicant purchased the property in June 2021. No permit history was known or submitted, and a search of CAMA records also found no permits issued. According to Dare County records, Lot #68 was platted with a date of June 1968 which is prior to the creation of the Coastal Areas Management Act (CAMA). Therefore, the existing concrete bulkhead may have been constructed prior to any permitting requirements. The property has not been evaluated for archeological significance The property is adjacent to canal waters connected to the Albemarle Sound. The waters of the Albemarle Sound are joint waters, classified as SB, and are closed to shellfish taking. The canal width at this location ranges from ±138' at the western property line to ±120' at the eastern property line. The bottom substrate is hard bottom sand topped with a layer of soft mud. No wetlands were found to exist along the shoreline and the location is not classified as a Primary or Secondary Nursery Area by the INC Division of Marine Fisheries (NCDMF). No SAV was reported to be growing within the project area, and the area is not designated by NCDMF as SAV habitat. The shorelines of the adjacent properties are similarly hardened with bulkheads. Adjacent properties along the canal are developed with man-made structures including single family dwellings, piers, platforms, and docking facilities of various sizes. Development Proposal/Project Description The applicant is proposing the construction of a vinyl bulkhead for the purpose of shoreline stabilization. The proposed alignment will tie into an existing bulkhead on an adjacent property to the east (owned by Kevin Clark) and will extend ± 57' in a westerly direction to connect with an existing bulkhead on an adjacent property owned by David & Anne Morgan. The proposed alignment will average 10' waterward of NWL with a maximum distance of ± 14' waterward. Back fill material will consist of clean sand brought to the site from an upland source. Brandon Mitchell Field Investigation Report Page 3 In addition to the proposed bulkhead, the applicant is proposing the construction of a 31'x5' pier with a 5'x7' lower platform, 19'x10' boat lift, and 6'xT PWC lift located on the eastern side of the pier. The lower platform and PWC lift will also be located adjacent to the proposed bulkhead alignment. Three designated mooring slips (a boat lift, a PWC lift, and an area to the west of the proposed pier) are being proposed as part of the docking facility. Water depths within the proposed development location ranges from ± S to ± 5' below NWL. The proposed pier and platforms are similar to others in the area, meet the Y<width rule, and do not encroach within the 15' riparian access setback. The proposed pier and platforms are located ± 40' to the east and ±87' to the west of adjacent docking structures. Associated high ground development proposed is the construction of a 57'x6' slatted wooded boardwalk along the length of the proposed bulkhead and a 25'x6' slatted wooden walkway centrally located and perpendicular to the shoreline to provide access to the uplands of the lot. The majority of the wooden decking is within the 30' Coastal Shoreline AEC Buffer for a total of 492 ft2. Anticipated Impacts The construction of the bulkhead along the proposed alignment will result in the filling of ± 467 ft2 of Estuarine Waters and Public Trust Area AEC's. Bulkhead installation, back fill, associated grading, and the construction of the proposed boardwalk and walkway will result in ± 959 ft2 (0.02 acres) of land disturbance within the Estuarine Shoreline AEC and existing property lines. The construction of the walkway and boardwalk will place 492 ft2 of slatted wooden decking within the 30' Coastal Shoreline AEC Buffer. As an adjacent riparian neighbor to the development location, the CAMA Permit process requires that we notify you by Certified Mail of the proposed project. This provides you with the opportunity to advise the NC Division of Coastal Management of whether you have any comments relating to the proposed work. Landowners have 30 days from the date of notification in which to comment. Such comments will be considered by the Department in reaching a final decision on the application.
