Authorizing development in Brunswick County at adj. to the AIWW, at 343 Serenity Lane in
Holden Beach as requested in the permittee's application dated 10/11/21,
including attached workplan drawings (4), Sheets 1,2,4 of 4 dated 10/14/21 and Sheet 3 of 4 dated 12/20/20.
This permit, issued on February 18, 2022 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the boatlift and other structures and uses located in or over the water that
are expressly and specifically set forth in the permit application. No other structure, whether floating
or stationary, shall become a permanent part of this docking facility without permit modification. No
non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without
permit modification.
2) This permit authorizes 1 additional formalized boat slips for a maximum of 3 formalized boat slips at
this docking facility.

This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ and the Chair
qualified persons within twenty (20) days of the issuing date. of the Coastal Resources Commission.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2025
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
4) The authorized structure and associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the dimensions shown on the attached permit drawings.
5) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
Sedimentation and Erosion Control
6) In order to protect water quality, runoff from construction shall not visibly increase the amount of
suspended sediments in adjacent waters.
7) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
General
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
9) All construction debris associated. with the removal or construction of the permitted docking facilities
shall be contained within the authorized project area and disposed of in an approved upland location.
10) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 20211696.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this' determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high-water level.
NOTE: An application processing fee of $250 was received by DCM for this project.

Please Note: Due to recent changes with the 2020 Section 401 Certification Rule a pre -filing meeting
request is no longer required 30-days prior to a certification request. The pending complete date under the
2020 Section 401 Certification Rule was 11/11/21. The new complete date is November 4, 2021 due to
retraction of this rule
The square footage of the proposed docking facility is calculated as follows:
Shoreline length =100 it. x 8 SF/LF = 800 SF allowable.

Boatlift =1 @ 16' x 16' = not considered in platform allocations
Total increase in proposed constructed features = 0 sq. ft.
Existing:
Access Pier— 6' x 5661= not counted for access credit
Fixed Platform =10' x 8' = 80 sq. ft.
Fixed Platform-13' x 171= 221 sq. ft.
Floating Dock =12' x 16' =192 sq. ft.
Total Existing= 493 sq. ft.
The proposed development would increase docking space for one additional vessel, increasing the slip count
from 2 to 3 within water depths measuring approximately -5' @ NLW. Application materials stated
water depths of 5' in the project area, however site visit by DCM Staff observed 34' @ NLW
@ project area. As proposed, the project would be CONSISTENT with the use standards set forth in
NCAC 07H .0208(b)(6), including the established pier -head line, the eight -square foot rule, and the pier -width
rule. The docking facility would be located entirely over open water.

within the AIWW. The project is located at 343 Serenity Lane on the eastern end of
Holden Beach, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT and CW.
Waters at the project site are classified as SA; HQW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Holden Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted are
classified as Conservation.
In general, the Town of Holden Beach allows development in Residential and
Conservation classified AECs, which is consistent with the State's minimum use
standards. The Town of Holden Beach Land Use Plan contains some policies, which
exceed the State's minimum use standards. However, none of these standards appear to
be applicable to this proposal.
This project appears to be consistent with the Town of Holden Beach Land Use Plan.

9. PROJECT DESCRIPTION
The proposed project is located at 343 Serenity Lane, adjacent to the AIW W, on the eastern end of Holden
Beach, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Holden
Beach. At the Supply intersection, turn left onto NC 211 S. 'ravel .3 miles down NC 211 S and turn right onto
Stone Chimney Road SW. Drive down Stone Chimney Road for 5.5 miles and continue onto Old Ferry
Connection SW for 1.1 miles. Turn right onto Sabbath Home Road SW and then take the next left onto NC 130
E towards Holden Beach. Travel over the Holden Beach bridge and left a right onto Ocean Blvd. Continue for
l .l miles and take a left onto Dunescape Drive. Continue 0,1 mile and turn right on Windswept Way. Continue
0.2 miles, turn left onto Serenity Lane, and the project location will be located on the left hand side.
The project site is approximately 1.3 acres and is vegetated on the uplands with domestic grasses and
ornamental landscaping. The high ground portion is elevated approximately I V above the normal high water
(NHW) level, and the shoreline along the AIW W (+/- 100 linear feet) is not currently stabilized. Between the
uplands and the shoreline, there is an expansive area of Maritime Shrub Thicket and 404 wetlands,, spanning a
30darea lengthwise and the 100' width of the property. Along the shoreline, there are coastal wetlands
present, consisting primarily of Smooth Chrordgrass (Spartina Alterntflora), and Black Needlerush (Juncus
Romerianus). Residential properties border the project site to the east and the west side of the property is
bordered by a vacant lot, zoned for residential use. -
Existing structures on the project site include a single family residence, and a private two (2) slip docking
facility. The existing docking facility was permitted in February 2021 via CAMA General Permit 778000D
(included in the application materials). The current docking facility is accessed by a fixed access walkway and
pier (6' x 566'). From the terminus of the fixed access pier, a ramp leads waterward to a floating dock (12' x
16') oriented parallel with the shoreline. To the immediate west of the terminus of the access pier there is an
existing boatlift (14' x 14') and on the east side of the end of the pier, there is an existing uncovered fixed
platform (10'xg') and an existing covered fixed platform (13' x IT). The docking facility currently contains
two (2) formalized boat slips.
The waters of the AIW W are classified SA-HQW by the Division of Water Quality and ARE NOT designated
as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvest of
shellfish. Based on visual observations made by DCM staff during the site visit, there appears to be NO
Submerged Aquatic Vegetation (SAV) in the surrounding waters.
PROPOSED PROJECT
The applicant proposes to install a second boatlift, increasing the total slip count from two (2) to three (3) within
the AIW W. The applicant is proposing a second boatlift to the immediate east of the existing fixed covered
platform. A boatlift (16' x 16') would extend to the east in alignment with the existing fixed covered platform
creating an additional slip (See Page 2 of 5, Proposed Structures). The proposed boatlift would not encroach
into the eastern riparian corridor setback. The constructed features would increase the slip count from 2 to 3.
According to the applicant, the waterward end of the docking facility would be located in water greater than 5'
at NLW.
10.ANTICIPATED IMPACTS
The proposed docking facility expansion would incorporate an additional 256 SF of Estuarine Waters and
Public Trust Area. The docking facility would remain consistent with similar pier length requirements
(established pier -head line). The proposed docking facility would not encroach into the 15-foot riparian corridor
setback of the eastern property owner and no new work is being proposed on the western side of the riparian
corridor. Application materials stated water depths of 5' in the project area, however site visit by DCM Staff
observed 34' rt NLW rr project area. Minor increases in turbidity should be expected during piling installation.

existing docking facility includes a walkway (6' x-566'), a floating dock (12' x 16% a boat lift (14' x 14%

The Division of Coastal Management hereby acknowledges receipt of your application for development of the subject
property, on behalf of Nicholas and Deirdre Sarif, located at 343 Serenity Lane, adjacent to the AIWW, in Holden
Beach, in Brunswick County. Please Note: Due to recent changes with the 2020 Section 401 Certification Rule a
pre -filing meeting request is no longer required 30-days prior to a certification request. The pending complete date
under the 2020 Section 401 Certification Rule was November 11, 2021. The new complete date is November 4,
2021 due to retraction of this rule. It was received as complete on November 4, 2021 and appears to be adequate for
processing at this time. The projected deadline for making a decision is January 18, 2022. An additional 75day
review period is provided by when such time is necessary to complete the review. If you have not been notified of
a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be -
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 4, 2021, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and If additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

Water, LLC (do Jeff Stokley) proposed to construct a new bulkhead water ward of the existing
failing bulkhead and reconfigure & expand existing deck to include a new rooftop deck at the
existing commercial waterfront restaurant at 313 Canal Dr., adjacent to the Carolina Beach Yacht
Basin in Carolina Beach, New Hanover County, On November 18, 2011, Victoria Detweiler
