HomeMy WebLinkAbout15-22 Greene, Janie & HobbyPermit Class NEW STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS l 13A-118 Excavation and/or tilling pursuant to NCGS 1 13-229 Permit Number 15-22 Issued to Janie and Hobby Greene, 107 SW 9n' Street, Oak Island, NC 28465 Authorizing development in Brunswick County at adj. to Davis Canal, at 110 SW 91h Street in Oak Island , as requested in the permittee's application dated 8/6/21 including attached workplan drawings (5), Sheets 3-7 of 7, all dated 9/24/21. This permit, issued on February 18, 2022 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, covered platform, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) This permit authorizes a maximum of 6 formalized boat slips. (See attached sheets for Additional Conditions) This permit action maybe appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2025 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Peilnittee Janie and Hobby Greene ADDITIONAL CONDITIONS Permit No.15-22 Page 2 of 3 3) No portion of the authorized docking facility, including tie piles, shall extend more than one quarter of the width of the water body. Measurements to determine width of the water body shall be made from the normal high water line or the waterward edge of any coastal wetland vegetation which borders the water body, whichever is more restrictive. 4) Should the eastern adjacent lot be sold prior to the initiation of construction of the docking facility, the permittee shall obtain a written agreement from the new owner(s) waiving the minimum setback, and authorization to construct the portion of the docking facility within the property owner's riparian setback, and submit it to the Division of Coastal Management prior to initiating construction of the docking facility. 5) The pier, covered platform, and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the western adjacent property owner's area of riparian access. 6) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 7) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 8) Any portion of the permitted access pier and docking facilities built over wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet above the wetland substrate as measured from the bottom of the decking. 9) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. 10) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the mooring. Any sewage discharged at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Standard Dredeine Moratorium 11) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Janie and Hobby Greene Permit No. 15-22 Page 3 of 3 Sedimentation and Erosion Control 12) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 13) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) All construction debris associated with the removal or construction of the permitted docking facilities shall be contained within the authorized project area and disposed of in an approved upland location. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 20211578. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high-water level. NOTE: An application processing fee of $250 was received by DCM for this project. PROJECT DESCRIPTION The proposed project is located at 110 SW 91h Street, in the Davis Canal in Oak Island, Brunswick County. The property can be reached by traveling NC HWY 17 south towards Shallotte/Myrtle Beach then take NC-906 to SW 9'h Street in Oak Island. Turn left onto SW 911 Street and the property is at the street end on the left. The subject property is approximately .63 acres and is vegetated primarily with grasses, shrubs, and mature trees. The high ground portion is elevated approximately T-17' above the normal high water (NHW) level, and the shoreline (+/- 120 linear feet), which is stabilized by an existing bulkhead. There are coastal wetlands (Spartina alterniora) within the riparian corridor of the applicant's property between the canal and existing bulkhead (approximately 12%16' in width). The applicant's property is situated on Davis Canal, bordered by residential properties to the east and north, and SW 9th Street (town property) borders to the west. The width of the canal measures approximately 100' feet at the proposed project site. Existing structures on the project site include a single family residence, an existing bulkhead (authorized in 2006 via CAMA General Permit GP- 45830), and a private docking facility (no permit history was located at time of review). The applicant plans to demolish the existing docking facility, which consists of an access pier, floating dock, and two boatlifts (3 slips). The waters of the canal system are classified SA by the Division of Water Quality and ARE designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. The water depths range from -3.1 @ NLW on the landward side of the proposed features to -T @ NLW on the waterward end of the proposed features. PROPOSED PROJECT The applicant proposes to demolish an existing docking facility, construct two new access piers, a fixed covered platform, two floating docks, and four boat lifts, resulting in an increase of 3 additional slips for a total of 6 slips along Davis Canal. Approximately 35' east of the southwestern property corner, the applicant is proposing to construct a fixed access pier (6'wide x 9'long) extending to the southwest from the bulkhead, which would land on a fixed covered platform (17' x 17'). From the east side of the platform, a proposed bumpout platform (4'x6') would support a gangway, extending in a waterward direction, which would land on a proposed floating dock (8' x 20') oriented perpendicular to the shoreline, serving as slip 2. The proposed floating dock would be flanked immediately on either side by two proposed boat lifts (12' x 12') serving as slips 1 & 3. Approximately 35' west of the southeastem property corner, the applicant is proposing to construct a second fixed access pier (6'wide x 20'long) extending waterward from the bulkhead. From terminus of the pier, a proposed gangway would extend in a waterward direction, and would land on a proposed floating dock (10'4-32Toriented perpendicular to the shoreline, serving as slip 5. The proposed floating dock would be flanked immediately on either side by two proposed boat lifts (one @ 12' x 12', one @ I V x I I') serving as slips 4 & 6. No portion of the proposed constructed features would extend into the riparian corridor setback of the neighbor to the west. (Town). The easternmost proposed boat lift (slip 6) would located in the 15' riparian corridor setback for the eastern neighbor however the appropriate waiver was obtained. The application states that existing water depths in the vicinity of the proposed constructed features would range from approximately -3.1' to -7.0' @ NLW. Water depths were verified by DCM staff on a site visit. As proposed, the constructed features would be located within the established pier head line and within Y, of the width of the waterbody. ANTICIPATED IMPACTS The proposed docking facility would incorporate 1322 SF of Estuarine Waters and Public Trust Area, and shade 190 SF of Coastal Wetlands. The proposed docking facility would not encroach into the 15- foot riparian corridor setback of the western property owner, and the appropriate waiver has been obtained for the proposed eastern side encroachment. Minor increases in turbidity should be expected during piling installation.
