Ct in Wilmington, New Hanover County, as requested in the permittee's application, dated May 21, 2018, and received
complete May 22, 2018. This permit, issued on May 30, 20181 is subject to compliance with the application and site
drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below.
Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be
null and void.
This permit authorizes: installation of a retaining wall and fill on the souther northern and eastern sides of the property
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on May 22, 2016.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal
regulations, applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or land use activities will require a re-
evaluation and modification of this permit.
(4) A copy of this permit shall be posted or available on site. Contact this office at (910) 798-7110 for a final
inspection at completion of work.

This permit must be on the project site and accessible to the permit officer when
the project is Inspected for compliance. Any maintenance work or project
modlfica*m not covered under this permit, require further written permit
approval. All work must cease when this permit expires on;
December 31 2021
In Issuing this permit it is agreed that this project is consistent with the local Land
Use Plan and all applicable ordinances, This permit may not be transferred to
another party without the written approval of the Division of Coastal
Management.

(5) The amount of impervious surface shall not exceed 25% of the lot area within 575 fleet of Normal High Water
(Estuarine Shoreline — ORW Area of Environmental Concern), in this case, 1429 total square feet is authorized.
(6) finless specifically allowed in 15A NCAC 07H, =9(dX10), and shown on the permitted plan drawing, all
developmenticonstruction shall be located a distance of 30 feet landward on Normal High Water.
(7) All unconsolidated material resulting from associated grading and landscaping shall be retained on sile by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier Gne of fiver cloth must
be lasWled between the land disturbing activity and the adjacent marsh or wafter areas, until such time as the area
has been properly stabilized with a vegetative cover.
(8) Any proposed grading within the 30' buffer from the Normal High Water must be contoured to prevent additional
storm water runoff to the adjacent marsh. This area shall be InT ediately vegetatively stabilized, and must remain in
a vegetative state.
(9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.
(10) This permit does not authorize development in any wetlands or open water areas,

This letter is in response to your correspondence, which was received by New Hanover County on
June 4, 2018, regarding your concerns about the proposed development by Robert and Sharon
Allan, at 5936 Nautical Isle Ct., adjacent to the Inter -coastal waterway, in New Hanover County.
The project consists of Installation of a Retaining Wall. The proposed project has been determined
to comply with local regulations and the Rules of the Coastal Resources Commission
(7H.0209(d)(10), per your concern, Tim Lowe, PE Chief Project Engineer, New Hanover County was
contacted and stated the retaining wall cannot encroach onto the drainage easement, a revised
site plan is attached and as such, a permit has been issued to authorize the development. I have
enclosed a copy of the permit, as well as, the applicable rules.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Appeal. The Chairman of the Coastal Resources Commission will consider each case and determine
whether to grant your request to file for a Contested Case Hearing. The hearing request must be
filed with the Director, Division of Coastal Management, in writing and must be received within
twenty (20) days of the disputed permit decision. I have enclosed the applicable forms and
instructions that must be fled prior to that deadline. Please contact me at 910-798-7118, if you

I have questions and concerns about the CAMA permit for a retaining wall on 5936 Nautical
Isle court Wilmington, NC. I own the adjacent lot, 5932 Nautical Isle Court. I have expressed my
concerns to the builder Mr. David Logan and I will reiterate them to you.
1. Will the existing grade on the already finished and sodded backyard of 5936 Nautical
Isle Court be altered or changed from the existing state? My backyard at 3932 was
designed allowing for the existing height and grading of 5936. If they are going to
change and elevate the existing grade, it will mean that I will be getting their runoff. The
topographical map that Mr. Logan provided implies that the existing yard at 5936 will be
raised approximately one foot, from its present state. For instance, based on the survey
information provided to me, the area Mr. Logan labels as 15 feet is currently
approximately 14 feet.
2. There is a drainage pipe in the backyard of 5936 that I believe is from the rain gutters of
5936. Is this going to remain on the 5936 side of the retaining wall or will the pipe be on
my side of the retaining wail and drain towards my property?
3. There is a large storm sewer pipe that drains between the property line of 5932 and
5936. How far past the sewer pipe does the retaining wall on 5936 extend? I am
concerned that if the retaining wall extends past the sewer pipe, that it will divert more
water towards my property causing erosion of the natural berm on my side of the sewer
pipe.
