in an area of environment concern pursuant to Section 113A-118 of the

Issued to Stuart Bayley, authorizing development in the Estuarine Shoreline (AEC) at 311 Florida Ave, in Carolina
Beach, as requested in the permittee's application, dated May 2nd, 2018. This permit, issued on May 111h, 2018, is
subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations
and special conditions and notes set forth below, Any violation of these terms may subject permittee to a fine,
imprisonment or civil action, or may cause the permit to be null and void.
This permit authorizes: The placement of 0-Y of topsoil, placement of 0-3" of gravel on existing driveway footprint, construction of a
fence along the property line with Town of Carolina Beach Property, and the installation of an irrigation system.
(1) All proposed development and associated construction must be done in accordance with the permitted work plat
drawings(s) dated received on 05/02/2018.
(2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations,
applicable local ordinances and FEMA Flood Regulations.
(3) Any change or changes in the plans for development, construction, or sand use activities will require a re-evaluation
modification of this permit,

This permit action may be appealed by the permittee or other qualified persons RECEIVE[-*
within twenty (20) days of the issuing date. From the date of an appeal, any

(5) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all
development/construction shall be located a distance of 30 feet landward of Normal High Water Line.
(6) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective
sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must
be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area
has been property stabilized with a vegetative cover.
(7) Any proposed for grading within the 30' buffer from the Normal High -Water Line must be contoured to prevent
additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized and must
remain in a vegetated state,
(8) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction
completion.

discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit
the following additional information to this office:
1. Please update the application to include all proposed work within the 75' AEC. Upon site inspections on 3/29 and
3/30/2017, a set of stairs within the 30' buffer has been added since the Minor Application was submitted on
3/24/2017.
2. A professional site plan, sealed by a surveyor or engineer, showing all proposed work, including all fill areas, the
boundaries of the stone driveway, and the proposed stairs should be submitted for review.
In accordance with the Department of Environment and Natural Resources regulations, we note that a certain time has passed
while the application has remained in our office. Upon resubmission of a complete application, a local decision will be made in
seven days, provided this period is not extended as provided by law.
