On January 11, 2011, the NC Division of Coastal Management placed on hold the processing of the City of New Bern's application under the Coastal Area Management Act (CAMA) to construct a wooden boardwalk connecting Union Point Park to Pollock Street pending the resolution of several issues. To date, this office has received no additional correspondence resolving these issues. Given the 7-year time frame that has passed since Mr. Avery submitted this application and its placement on administrative hold, the Division has determined that it will be necessary to retire the city's permit application. Any future request to carry out development activities at this location will require the submission of a new CAMA major permit application. The Division remains available to provide any assistance you may need in preparing that application. If you have any questions concerning this matter, please feel free to contact me. Connect to and provide gates on existing Comfort Suites pier and connect to & provide gates to a pier (Homer) contained in this application. The improvements will consist of approximately 560 linear feet of elevated wood walkway (see attachments #4and #5) over the water approximately 6' to the waterside of the existing bulkhead. There will be two connections to the walkway for adjacent private landowners with one landowner proposing a 10-slip marina (see attachment #3) as a part of this permit application. The walkway will continue into Union Point Park along the landside of the bulkheading for approximately 260 linear feet with an additional 20 linear feet of pavers to connect the wood walkway to an existing walkway at the terminus of Pollock Street (see attachment #6). This total of 280 linear feet will be constructed of pavers (or perhaps concrete depending on budget constraints). As I stated, the Horner's proposed 10-slip docking facility should be applied for as a "stand alone" proposal. Based on our discussion, then the City of New Bern should apply for the dock extension from Union Point to Pollock Street on its own. I've attached a checklist and the appropriate forms for applying for the 10-slip docking facility. Once the boardwalk's easement has been secured as we discussed, then we can see what permitting process it will necessitate.
