This permit, issued on April 3, 2018 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
u mese terms may oe suelect to ones, imprisonment or civil action; or may cause the permit to be null and void.
Repair/Replace Non -Conforming Structure
1) This permit authorizes only the pier, platforms, boat lift and replacement of the non -conforming
single-family residence, and other structures and uses located in or over the water that are expressly
and specifically set forth in the permit application.
2) No sewage, whether treated or untreated, shall be discharged into waters of the State at any time from
the non -conforming single-family residence. Any sewage discharge at the non -conforming single-
family residence shall be considered a violation of this permit for which the permittee is responsible.
This prohibition shall be applied and enforced throughout the entire existence of the permitted
structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
A turbidity curtain shall be installed around the entire project site and construction site located in
Estuarine Waters and the Public Trust Area during all phases of demolition and construction. The
turbidity curtain shall remain effective and in place for the duration of all work over Estuarine Waters
and the Public Trust Area.
All debris associated with this development must be contained within the authorized project area. The
permittee shall be responsible for the immediate removal of any displaced debris, trash, or litter
sassociated with the project site.
The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
This permit authorizes a maximum of 2 formalized boat slips.
r No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
The non -conforming single-family residence shall not be enlarged beyond existing dimensions.
"The non -conforming single-family residence shall not change in use, and continue to be utilized as a
private, single-family residence.
General
The Division of Coastal Management shall be notified immediately in the event of any spillage of any
hazardous, toxic, or harmful materials or substances (e.g. paint, stain, fuel, polyurethane) into the
Estuarine Waters or the Public Trust Area.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
No excavation or filling of any vegetated wetlands or surrounding waters is authorized under this permit.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.

ADDITIONAL CONDITIONS
This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
E: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2018-00390) issued 4/1/18.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4097 and assigned the project DWR Project No. 18-0193.
This permit does not convey any rights, either in real estate or material.
E: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 808-2808 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal water level unless specifically exempted
by Environmental Management Commission's (EMC) Neuse River buffer regulations in
place at the time of such development.
E: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

SUBJECT: Comments and Recommendations - CAMA Major Permit —John Zannis,
Craven County
The following is my assessment and consequent recommendations of the above referenced proposal: This
proposal shades 1,117 square feet of Public Trust inland waters. These waters of the Trent River are closed to
shellfish harvest. This waterbody is not a Primary Nursery Area. This area is subject to the Neuse River Basin
Riparian Buffer Rules. The proposed docking facility would meet the rules and conditions of a routine General
Permit found under 15A NCAC 07H .1200.
However, the existing dwelling over the Trent River does not meet the current use standards outlined in 15A
NCAC 07H .0208(a)(1) because its use is not water dependent. Therefore, its proposed reconstruction must be
evaluated under 15A NCAC 07J .0211, which addresses "non -conforming development." This standard
imposes specific criteria that the proposal must meet before it can be authorized. The non -conforming
development must have been built prior to the effective date of the rule with which it is inconsistent.
The applicant has provided documentation from the Craven County tax office that the dwelling was built in
1975. The effective date of the rule with which it is inconsistent is September 9, 1977. The proposed
replacement of this non -conforming dwelling would meet the remaining criteria found under 15A NCAC
07J .0211 by serving the same use within the existing footprint, and not having any practical alternatives to
comply with current use standards (except to remove it or to perform gradual repairs until the structure is
eventually restored). Assuming other state and federal agencies concur, the Morehead City District staff
recommends that the project be authorized as it is proposed.

SUBJECT: Addendum to Memo dated 2-6-2018 on the John Zannis proposal, Craven County
This proposal involves the replacement of a non -conforming structure. Therefore, it must meet the standards set forth
in 15A NCAC 07J .0211 which states: "A non -conforming structure is any structure within an AEC other than Ocean
Hazard and Inlet Hazard AECs that is inconsistent with current CRC rules, and, was built prior to the effective date(s) of
the rule(s) with which it is inconsistent.
Replacement of such structures shall be allowed when all of the following criteria are met:
(1) the structure will not be enlarged beyond its original dimensions;
(2) the structure will serve the same or similar use;
(3) there are no practical alternatives for replacing the structure to provide the same or similar benefits in
compliance with current rules; and
(4) the structure will be rebuilt so as to comply with current rules to the maximum extent possible."
The effective date of the rule, 15A NCAC 07H .0208(a)(1), with which it is inconsistent is September 9, 1977. This rule
prohibits non -water dependent uses within public trust areas. The applicant has provided documentation from the
Craven County tax office that the dwelling was built in 1975. Therefore, the structure was built prior to the effective
date of the rule with which it is inconsistent.
The proposed replacement of this non -conforming dwelling would have to meet the remaining four criteria found under
15A NCAC 07J .0211:
(1) The proposed replacement dwelling would not be enlarged beyond its original existing dimensions, including its
length, width, and height;
(2) The proposed replacement dwelling would continue to serve the same private single family residential use;
(3) There are no practical alternatives for replacing the dwelling to provide the same benefits because such a structure
could not exist under current rules; and
(4) would be rebuilt to comply with numbers 1-3 to the maximum extent possible.
The Morehead City District staff would recommend enforcing numbers 1 & 2 as conditions of the CAMA permit.

Consistency Determination: The request is consistent with/not in conflict the New Bern - River Bend -
Trent Woods Regional Land Use Plan certified by the CRC on February 24, 2011, provided the following
policy statements are met regarding the projects location in a Special Flood Hazard Area AE (EL 8):
Policy NH2: Development and redevelopment within special flood hazard areas shall* meet the
standards of the National Flood Insurance Program. *shall is defined in the LUP as "mandatory, not
optional" (pg. x).
Policy NH3: In addition to improved protection from flood hazards for life and property, any proposed
redevelopment or expansion of a site within the special flood hazard areas should* demonstrate that
post -development conditions will improve the capacity of the area to provide storage or conveyance of
flood waters. *should is defined in the LUP as "ought to, if no valid reason not to" (pg. x).
Overview: The project is located on a 2-acre parcel at 5001 Trent Woods Drive, Trent Woods, NC, Craven
County, North Carolina. The applicant is proposing to replace and expand an existing docking facility,
and replace a 637-sq.ft. non -conforming habitable structure within the Trent River for private use.
According to Craven County tax records the structure was originally constructed circa 1975. The
proposed structure would remain in the same footprint as the existing 637-sq.ft footprint.
The parcels high ground is about 14' above normal water level. Existing site improvement include
driveway, docking facility non -conforming habitable structure immediately adjacent to the dock out in
the river. The residence on the upland has been demolished. Vegetation on site consists of mature trees
and shrubs.
AECs in the proposed project area include Public Trust Areas (PTA). The site is located in the Special
Flood Hazard Area AE (Elevation 8). The waterbody is classified as SB;Sw;Nutrient Sensitive Waters.
There site is not classified as a Primary Nursery Area, there is no SAV observed in the area, and the area
is closed to shellfish harvest. There are no Coastal Wetlands within the project area. There are no

cultural resources in the nearby vicinity of the project. The project is subject to the Neuse River Riparian
Buffer Rules.
Anticipated impacts resulting from this project are expected to include: the shading of 1,117-sq.ft of
inland waters and the usurping of approximately 2,000-sq.ft of Public Trust Area. The habitable
structure cannot be enlarged beyond its original dimensions as per CRC rule 15A NCAC 07H .0211J.
Basis for Determination:
The project is subjecf to the New Bern — River Bend —Trent Woods Regional Land Use Plan. The Future
Land Use Map (FLUM) classifies the site as Developed. "This classification provides for continued
intensive development and redevelopment of the municipalities in the region" (pg. 99).
The following LUP policies may be applicable to this request:
Natural Hazard Policies
Policy NH 1: Special Flood Hazard Areas (those areas having a 1 percent chance of flooding in any year
— 100-yearflood) may be flooded during major storm events and pose risks. The regional municipalities
will take measures to mitigate these risks and will avoid taking any action in these areas that materially
increases risks to life and property.
Polity NH2: Development and redevelopment within special flood hazard areas shall meet the standards
of the National Flood Insurance Program.
Policy NH3: In addition to improved protection from flood hazards for life and property, any proposed
redevelopment or expansion of a site within the special flood hazard areas should demonstrate that
post -development conditions will improve the capacity of the area to provide storage or conveyance of
flood waters.
Estuarine Waters and Public Trust Areas
Policy EW 1: The municipalities will restrict development in estuarine waters and public trust areas to
those uses which will not cause significant degradation of the natural function or condition of these
waters.
Action Item EW la: Only those uses which are water dependent and cannot function elsewhere will be
permitted in estuarine waters and public trust areas consistent with CAMA 7H Use Standards and the
Land Use Ordinance, including piers, marinas, docks and other water dependent uses.

Dear Mr. Zannis:
The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s)198000292 issued by the US Army Corps of Engineers (USAGE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it,
In accordance with the attached General Certification #4144 (GC 4144), the impacts described in your
application do not require written authorization to utilize GC 4144. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at htto:/Iwww.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received

Narrative Description:
The property is located adjacent to the Trent River at 5001 Trent Woods Drive near New Bern,
Craven County. This property is currently developed with a driveway, docking facility, and a non-
conforming habitable structure immediately adjacent to the dock out in the river. The upland
residence has been demolished. The adjacent riparian properties are developed with single family
residences.
The habitable structure is considered a non -water dependent use as per the NC Coastal Resources
Commission (CRC) rule, 15A NCAC 07H .0208(a)(1), which depicts residences and apartments as
not being water dependent. Therefore, the structure is non -conforming to the existing rule which took
effect on September 9, 1977. However, the structure was built in 1975, prior to the effective date of
the rule to which it is inconsistent.
The elevation of the high ground of the parcel is about 14' above the normal water level (nwl).
Vegetation on the parcel mainly consists of mature trees and shrubs. There are no Coastal Wetlands
within the project area. The 2-acre parcel has approximately 195' of continuous shoreline along the
Trent River. Immediate offshore water depths adjacent to the parcel range from —1' to —10' normal
water level (NWL). The subaqueous substrate is firm without shell.
There is not a cultural resource in the nearby vicinity of the project area. This waterbody is
approximately 1,950' across at this location. These inland waters are not classified as a Primary
Nursery Area. Submerged aquatic vegetation was not observed at this location. This area is closed to
shellfish harvest and is classified as SB; Sw; Nutrient Sensitive Waters. There is not a defined
Federal Channel near the project area. This parcel is subject to the Neuse River Riparian Buffer
Rules.
Proposed Development:
The applicant proposes to replace and expand the existing docking facility, and replace the existing
non -conforming habitable structure that is within the Trent River, in Trent Woods. The proposed
development would take place 5001 Trent Woods Drive, Craven County. This proposal is for private
residential use.
A 5' wide and 18' long pier access is proposed at the south side of the parcel to wharf out into the
Trent River. A 5' wide and 19.5' long platform is proposed at the eastern terminus of the proposed
pier access. Connecting to that, is a 7' wide and 20.7' long platform that leads to a 5' wide and 20'
long proposed finger pier. The proposed finger pier will support a 13' by 15' boat lift on its eastern
side to. Connecting to the southwestern terminus of the proposed pier access, a 5' wide by 35' long
platform is proposed. A 12' by 20' wet slip is proposed at its south side terminus. A total of two boat
slips are being proposed at this docking facility.

In between the proposed platforms and finger pier, the applicant is proposing to replace an existing
habitable structure within the Trent River that was damaged during Hurricane Matthew. According to
the Craven County tax records, this existing habitable structure was originally constructed circa 1975.
The proposed structure would remain in the same footprint as the existing 637 square foot habitable
structure. It would retain its current private residential use.
Anticipated Impacts:
This proposal would not pose a hazard to navigation. The proposed dock and habitable structure
would shade 1,117 square feet of inland waters and usurp approximately 2,000 square feet of Public
Trust Area. The habitable structure cannot be enlarged beyond its original dimensions as per CRC
rule 15A NCAC 07H .021 U Therefore, there would not be any new impacts caused by its
replacement.
Traditional marine construction methodology will be utilized during the construction of this
project. Traditional silt fencing would be used for sedimentation and erosion control. Turbidity
impacts are not anticipated during the construction activities in the Trent River.
There is not a cultural resource in the nearby vicinity of the project area. This project area is
subject to the Neuse River Riparian Buffer Rules. These waters of the Trent River are not
classified as a Primary Nursery Area and the presence of submerged aquatic vegetation was not
observed. This area is closed to shellfish harvest and is classified as SB; Sw; Nutrient Sensitive
Waters. There is not a defined Federal Channel near the project area.

Trent Woods Drive near New Bern, Craven County. It was received on February 2, 2018, and
appears to be adequate for processing at this time. The projected deadline for making a decision
is April 18, 2018. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from February 2, 2018, you may
request a meeting with the Director of the Division of Coastal. Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which
must be posted at the property of your proposed development. You should post this notice at
a conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-
of-way fronting your property, or at a point along the road right-of-way where a private road
would lead one into your property. Failure to post this notice could result in an incomplete
application.

Zannis Proposed Dwelling at Dock
5001 Trent Woods Drive
New Bern, North Carolina
John and Stephanie Zannis are the owners of the property located at 5001 Trent Woods Drive in New
Bern, North Carolina. The property covers a total area of 86,753 sf, 1.99 acres and is located on the
Trent River. The Trent River at this location has a surface water classification of SB, Sw, NSW and a
Stream Index of 27-101(31). The property exists at an average elevation of approximately 14' above
normal water level. Neuse Riparian Buffer areas and CAMA Areas of Environmental Concern (AEC) exist
on the property as delineated on the site plan.
The property was previously developed and utilized for single-family residential purposes. The
residential dwelling once located on the property has been demolished. A new residential dwelling will
be constructed on the property at some point in the future. A dwelling exists at the existing dock
facilities. The dwelling is in a dilapidated condition. It is the desire of the owner to replace the existing
pier and dwelling with new construction. It is proposed that the new dwelling structure be built within
the same footprint of the existing structure. The dock areas will be enlarged slightly to provide uniform
deck widths. A boat lift is also proposed to be constructed.
The existing dwelling is a non -conforming structure pursuant to the current Rules. Replacement of the
structure is allowable if the following criteria are met.
1. Structure was built prior to the effective date of the Rules.
The existing dwelling was constructed in 1975 according to Craven County Tax Records (see
attached). Additionally, the attached 1974 and 1989 aerial photographs shows the dwelling
structure to be on the river adjacent to the property. The effective date of Rule 15A NCAC 07J
.0211 is listed as 1977.
This criteria is satisfied.
2. The structure shall not be enlarged beyond its original dimensions.
The new dwelling is proposed to be built in the same footprint as the existing dwelling. The
footprint will not be enlarged.
This criteria is satisfied.
3. The structure will serve the same or similar use.
The proposed structure will be used for dwelling purposes and is consistent with the current and
former use of the existing structure for dwelling purposes.

4. There are no practical alternatives for replacing the structure to provide the same or similar
benefits in compliance with the current Rules.
The current Rules will not allow the construction of a new dwelling structure over the water
where none presently exists. It is not possible to capture the aesthetic values with a dwelling
constructed landward of the normal water level. The aesthetic value of the unobstructed views
of the Trent River cannot be replaced with construction landward of the normal water level. If
the structure is constructed landward of the normal water level, the views would be obstructed
by adjacent development and adjacent vegetation.

The existing facility will be demolished from a barge and the existing dock system. The new dwelling
and dock will be constructed from a barge, walk boards and the proposed new dock facility. Equipment
to be utilized on the project includes a barge, pile driver and customary hand tools.
All construction other than the approach dock extending from the land will occur over the open waters
of the Trent River. Measures will be implemented during demolition and construction such as trash
screens and the use of tarpaulins to ensure that no debris is discarded into the Trent River. No dredging
is proposed to occur.
Public water and public sewer service (City of New Bern) will serve the proposed dwelling. The location
of these services are depicted on the attached plans.
The proposed pier access, platform, and finger piers are larger than the existing. A total of 650 sf of new
dock is proposed. The width of the docks are specified as 5 feet and 7 feet wide. The existing dock
covers a total area of approximately 274 sf and has widths varying between 3.8 feet and 4.8 feet.

John and Stephanie Zannis are the owners of the property located at 5001 Trent Woods Drive in New
Bern, North Carolina. The property covers a total area of 86,753 sf,1.99 acres and is located on the
Trent River. The Trent River at this location has a surface water classification of SB, Sw, NSW and a
Stream Index of 27-101(31). The property exists at an average elevation of approximately 14' above
normal water level. Neuse Riparian Buffer areas and CAMA Areas of Environmental Concern (AEC) exist
on the property as delineated on the site plan.
The property was previously developed and utilized for single-family residential purposes. The
residential dwelling once located on the property has been demolished. A pier and boathouse
presently exists on the property. The facilities are in a dilapidated condition. It is the desire of the
owner to replace the existing pier and boathouse with new construction. It is proposed that the new
boathouse structure be built within the same footprint of the existing structure. The dock areas will be
enlarged slightly to provide uniform deck widths. A boat lift is also proposed to be constructed.
The existing facility will be demolished from a barge and the existing dock system. The new boathouse
and dock will be constructed from a barge, walk boards and the proposed new dock facility. Equipment
to be utilized on the project includes a barge, pile driver and customary hand tools.
All construction other than the approach dock extending from the land will occur over the open waters
of the Trent River. Measures will be implemented during demolition and construction such as trash
screens and the use of tarpaulins to ensure that no debris is discarded into the Trent River. No dredging
is proposed to occur.

The elevation of the high ground of the parcel is about 14' above the normal water level (nwl). V
Vegetation on the parcel mainly consists of mature trees and shrubs. There are no Coastal Wetlands
within the project area. The 2-acre parcel has approximately 195' of continuous shoreline along the 'Y
Trent River. Immediate offshore water depths adjacent to the parcel range from —l' to —10' normal *A-4,ce4 4

The applicant proposes to and expand the existing docking facility, and a existing
non -conforming dwelling that is within the Trent River, in Trent Woods. The proposed development
would take place 5001 Trent Woods Drive, Craven County. This proposal is for private residential

A 5' wide and 18' long pier access is proposed at the south side of the parcel to wharf out into the
Trent River. A 5' wide and 19.5' long platform is proposed at the eastern terminus of the proposed
pier access. Connecting to that, is a 7' wide and 20.7' long platform that leads to a 5' wide and 20'
long proposed finger pier. The proposed finger pier will support a 13' by 15' boat lift on its eastern
side to. Connecting to the southwestern terminus of the proposed pier access, a 5' wide by 35' long
platform is proposed. A 12' by 20' wet slip is proposed at its south side terminus. A total of two boat
slips are being proposed at this docking facility.
In between the proposed platforms and finger pier, the applicant is proposing to rebuild and replace an
existing dwelling within the Trent River that was damaged during Hurricane Matthew. According to
the Craven County tax records, this existing dwelling was origin lly�onstructed circa 1975. The
proposed structure would remain in the same footprint as the exis44in 63) s uare foot dwelling. It
would retain its current private residential use.

impacts are not anticipated during the construction activities in the Trent River.
