This permit, issued on June 14, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions'and notes set forth below. Replacement of Non -Conforming Structures 1) This permit authorizes only the replacement of the two existing floating docks, which are part of the non -conforming docking facility, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Permit No. 58-18 Page 2 of 2 No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. non -conforming docking facility shall not be enlarged beyond existing dimensions. non -conforming docking facility shall not change in use, and continue to be utilized as a private, dng facility. General Should the lot to the west be sold prior to the initiation or commencement of the authorized non- conforming components replacement, the permittee shall obtain a written agreement from the.new owner(s) waiving the 15 foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the components. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. _ This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 197800056 (Action ID SAW-2018-00789) issued 4/27/18. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-0550. _ Future development of the perniittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. _ An application processing fee of $250 was received by DCM for this project. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a 'contractor,it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. It appears that the project is CONSISTENT with most of the use standards set forth in NCAC 07H .0208(b)(6). The project exceeds the allowable square footage of platform space by 152 ftz based on the 8-square foot rule NCAC 07H .0208(b)(6)(B). However, the applicant does not propose to expand the original dimensions of the float beyond its current footprint, it will serve the same use, and will comply with the rules to the maximum extent possible which is CONSISTENT with 15A NCAC 07J.0211 Non- conforming Development. The proposed structures would be located entirely over open water. The facility would encroach into the 15' riparian corridor setback area to the south, for which a waiver has been obtained. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued subject to the standard conditions for private docking facilities. Channel Drive, in Wrightsville Beach, New Hanover County, North Carolina Coordinates are: 34.2103 N,-77.7978 W. On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. Your work is authorized provided it is accomplished in strict accordance with your submitted plans, the enclosed general conditions, and the following special conditions. The expiration date of your DA permit is December 31, 2021. 1. All work authorized by this permit must be performed in strict compliance with the submitted plans and the revised plans received on 17 April, 2018, which are a part of this Permit. Please read the enclosed permit to prevent an unintentional violation of Federal law. PROJECT SUMMARY: The applicant proposes to replace the floating dock at an existing private docking facility along the edge of Banks Channel. Channel Drive, adjacent to Banks Channel in the Town of Wrightsville Beach, New Hanover County. To locate the project site from the WiRO take US Hwy 74/76 to Wrightsville Beach. Travel across the drawbridge and keep right on Causeway Drive. Tom left on N. Channel Drive, just before the Causeway Bridge leading to the barrier island. Travel 260' and the property of interest is located on the right side of the road. The project site is approximately 0.09 acres in size, on which the applicant currently maintains a single- family residence. The high ground is vegetated primarily with maintained lawn grass and ornamental landscaping. The project site has approximately 55' of shoreline frontage along Banks Channel, which is stabilized by a bulkhead, and Normal High Water (NHW) is approximately 40' waterward of the bulkhead. Immediately waterward of the bulkhead is an area of high marsh consisting primarily of Saltmeadow Cordgrass (Spartina patens) measuring approximately 20' in width. The shoreline transitions to low marsh consisting primarily of Smooth Cordgrass (Spartina alterniora) measuring approximately 30' in width. At the property, the applicant also maintains a private docking facility, which consists of a fixed pier (6' x 156') that extends in an easterly direction into Banks Channel. At the terminus, there is a fixed "L-head" covered platform (20' x 20'), which connects (via ramp) to a "U-shaped" floating dock. The section of floating dock that the ramp lands on measures approximately 20' by 6' and is oriented perpendicular to the shore. At the southern terminus of that section of floating dock is another section that runs parallel to the shore and measures approximately 12' by 6'. At the southern terminus of that floating dock is another section that measures approximately 20' by 6' and also runs perpendicular to the shore. On the northern edge of the "U-shaped" float is an existing 13' by 14' boat lift. The properties to the north and south are developed with single family homes and private docking facilities. According to the application package, existing water depths surrounding the existing docking facility are approximately -5.0' at normal low water (NLW). The applicant received an exemption to replace the deck boards on the existing fixed pier and platform on 4/12/17. No other permit history was located for this facility, but from a review of aerial photography it appears the facility was constructed prior to 1998. The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace the floating dock at an existing private docking facility along the edge of Banks Channel. The configuration of the existing docking facility currently provides dockage for up to four (4) vessels. The application states the existing pier, platform, and boat lift would remain in place with no modifications or expansions; however, the "U-shaped" floating dock, consisting of two sections measuring approximately 20' by 6' and the connecting section measuring approximately 12' by 6' would be replaced in the existing footprint. The 20' by 6' sections would be oriented perpendicular to the shore and the connecting section would be parallel and located closest to Banks Channel. The facility would continue to provide dockage for up to four (4) vessels. The application states that existing water depths in the vicinity of the proposed docking facility are -5.0' at NLW. In total, the existing facility extends approximately 125' into a waterbody measuring approximately 825' in width. The proposed additions would not be any more waterward than the existing facility.
