Doug Brady SUBJECT: NORTH CAROLINA Environmental Quality April 21, 2022 (via email dbradvdev ,gmail.com) Moratorium Relief Request for CAMA Major Permit No. 21-16 transferred to Ridco Corp. Dear Mr. Brady: This letter is in response to the above referenced CAMA permit relief request received by the DCM Morehead City office by email on April 14, 2022. To review this request, we coordinated with the NC Division of Marine Fisheries. This moratorium relief request is to conduct dredging operations to begin on or around April 25, 2022, and to conclude no later than May 9, 2022. In consultation with the resource agencies authorization was given with the following conditions: 1. The relief request is granted to conclude no later than May 9, 2022. 2. Every effort should be made to start and finish the project as early as possible. 3. The NC DMF further noted that oyster relocation was requested and conditioned within the permit. The permittee is reminded of Condition No. 19, and all other permit conditions and stipulations of the active permit, unless altered herein, remain in force. 4. The applicant shall notify the Division by email upon completion of the project. Therefore, the one-time moratorium relief request is granted with the above conditions. Based on what was provided, I don't see any reason to deny the request. It's a small amount of material and will be dredged from the land, and it's not in a designated habitat area. I emailed Shane to get his input since he was the original commenter, but I haven't heard back from him yet. I would just encourage them to try to get the in -water work done as quickly as possible. I'd also note that if there will be any future maintenance dredging, a reminder to submit the relief before the moratorium starts could significantly shorten delays and issues with working during the moratorium (as you mentioned in one of your emails). If I hear back from Shane, I'll let you know asap. But I don't have any reason to object to the requested relief, and I'm amenable to it being granted. Thanks Gregg! The address is 100 ol-de Towne Yacht Club Rd. in Beaufort. DMF was the only agency to request the moratorium, but USACE does have notification requirements associated with dredging. Liz, please let me know if the information satisfies this or if additional information is needed. Jimmy, Shane was the fisheries specialist at the time and should have info available. It seems dredging did occur till March 31, 2022 and stopped due to the moratorium. 2. They are requesting relief from 4/25 to 5/9. This is due to re -mobilization delays. In this case dredging stopped due to the moratorium and would need to re -mobilize. I would add that to the relief request and try and narrow down the dates you need to actively dredge. That may require the dredger to provide you with some dates based on their experience. But in my experience, the longer into the moratorium the request is, the less likely the agencies will OK it. My 2020 reference was when the bulkhead work started. This is a large project with some dredging occurring in previous years. My only reason for asking for 45 days from issuance was to get the equipment mobilized and contractor at site. It certainly won't take 45 days to complete. How should I phrase that? Thanks so much.
