This permit, issued on November 21, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docicin¢ Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the authority of the Secretary of DEQ qualified persons within twenty (20) days of the issuing date. Chairman of the Coastal Resources Commission. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Carol & John Rider Permit No. 128-18 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. 6) The authorized covered gazebos shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 7) The roofs of the covered gazebos shall not be designed for second story use. 8) This permit authorizes a maximum of ten (10) formalized boat slips. 9) The authorized structures and associated activity shall not cause an unacceptable interference with navigation, and shall not exceed the footprint as depicted in the attached workplan drawings. 10) Any portion of the permitted access pier and docking facilities built over coastal wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 11) The 10' long bridge, as depicted on attached workplan drawings 24 of 4, shall be elevated a minimum of six (6) feet above normal high water as measured from the bottom of the decking. 12) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee auidelines.odf Easement 13) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. RECEIVED DEC 0 4 2018 Carol & John Rider ADDITIONAL CONDITIONS Upland Development Permit No.128-18 Page 3 of 3 14) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the driveway and parking, all as expressly and specifically set forth in the attached permit application and workplan drawings. General 15) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 16) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 17) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 18) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: The permittee is encouraged to implement measures to ensure that users of the authorized docking facility do not utilize the adjacent boat ramp facility for parking or similar access. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Regional General Permit 198000291 (Action ID No. SAW-2018-01673), which was issued on 10/10/18. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018- 1164. NOTE: An application processing fee of $400 was received by DCM for this project. This fee alsc satisfied the Section 401 application processing fee requirements of the Division of Water Resources. I have had conversations with LMG before about this issue (Steve M. on the Southport waterfront issue). They can either 1)remove the slips 2) relocate the slips into deeper water (at least 18"), or 3) propose dredging. I'm aware that the upland plans will change but I need to see that it is actually possible to put a 10-spot parking area on the property. If you don't want to be the middle man, I don't mind talking to Greg. You can give him my new number or tell him that he can email me directly about the fisheries concerns. To address the parking comment, as discussed, the Town of Carolina Beach will require a 1:1 parking/slip ratio prior to issuing a local building permit for the structure. Since the property is for sale no parking or upland development is shown since it will likely change depending on the future buyer's planned use. To address the slips in -1 MLW depths, while there is a -1' MLW contour near the access dock, the lifts will be located in depths greater than -1' MLW and the sterns and engines will be near the -3' MLW contour. The project location is not PNA and there is sufficient depths to operate the lifts. Dredging is not warranted in this location and the applicant would prefer to not add it to the application. Currently the way the lot is situated it has insufficient access for any type of facility beyond a single-family residence. 3. No contact with the Town a. The town would require parking based on the proposed number of slips and the type of boat storage. b. In this case 10 wet boat storage locations would require 10 parking spaces. 5. Coordinates in Decimal Degrees are: 34.0569 N-77.8904 W. Currently, there is no development on the 0.74 acre lot, however there is an existing bulkhead along the coastal wetland boundary. It is unknown if the site was investigated for additional wetlands landward of the bulkhead: The site is located directly south of the Annie Drive NC WRC boatramp, and north of the Waterfronte Villas marina in Carolina Beach. The applicant proposes to construct a fixed access pier that measures approximately 509' x 6', approximately 105' waterward from the origin of the pier, there would be a 10' span that is elevated 6' above MHW to accommodate a navigable slough that extends northward from the open water along the pier span. Approximately 180' waterward from the origin of the pier, there would be a 14' x 16' covered gazebo over open water. The pier would terminate in a 'T-head' platform measuring approximately 100' by 6', running parallel to the shoreline. Where the pier intersects the'T-head', there would be two 16' x 6' platforms, on the northern and southern sides of the pier, to serve as 'golf cart turnarounds'. The northern end of the'T-head' would include a 16' x 16' covered gazebo extending landward over open water. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. 5. The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. 6. The applicant is proposing to construct a new 10-slip docking facility. The facility will consist of a fixed pier spanning coastal wetlands and open water measuring 509' x 6'. This pier will be elevated 6' above mean high water (MHW) in areas where navigable sloughs exist. 180' waterward from the origin of the pier there would be a 14' x 16' covered platform. The fixed pier would terminate in a T- head' platform oriented perpendicular to the shoreline measuring 100' x 6'. Adjacent to the terminus of the pier on both sides would be identical 16' x 6' platforms as golf cart turn arounds. Extending from the T-head would be a series of fixed finger piers and at the southern end a 52' x 6' floating platform. The facility has proposed 6 boadifts ranging from -1' at mean low water (MLW) to -9'. The project is in the Carolina Beach Yacht Basin in between the NCWRC public boat ramp and the Waterfront Villas community and docking facility. The waters of the project are classified as SB by the NC Division of Water Resources and are closed to the harvest of shellfish. Within the project footprint, several habitat types are present Both intertidal and subtidal shell habitat is present. Shell bottom is an extremely productive self -building three- dimensional habitat that can be impacted long term through dredging and filling, pollution and other contaminants. This vital estuarine habitat is very limited in North Carolina, and restoration and conservation of shellfish habitat is at the forefront. The area also contains areas of soft bottom habitat which is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. The project also spans over areas of coastal wetlands. Coastal wetlands are considered among the most productive ecosystems in the world. The proposed project has the potential to adversely impact fishery resources and habitat in several ways. Permitted slips in shallow water can allow vessels to repeatedly contact the bottom. While there is currently no submerged aquatic vegetation or oyster reef present in the docking area, propellers continuously disturbing the sediment can kill benthic invertebrates and reduce shallow bottom habitat during low tide. Locating formalized slips and boatlifts in -1' MLW would result in continuous impacts to the underlying habitat. The size and scale of this project also poses concerns with associated upland development. The applicant has not provided any plans on upland development to accommodate parking to access the docking facility. The private facility would need to allow sufficient parking to provide access to the number of formalized slips. Without private parking, there is concern that the neighboring public boat ramp parking lot would be utilized for parking. Based on the above discussion, the DMF recommends denial of the permit application for this project as proposed because it Is likely to have significant adverse impacts on marine and estuarine fisheries resources, and navigation at the project site based on the information included in the application. PROJECT DESCRIPTION The project site is located at 1614 Island Marina Drive, adjacent to the Snow's Cut segment of the Atlantic Intracoastal Waterway (AIWW) and the Carolina Beach Yacht Basin, in the town of Carolina Beach, in New Hanover County. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington towards Carolina Beach in a southerly direction on College Road (NC Hwy 421) for approximately 14 miles until you cross the Snow's Cut bridge and reach the stop light at Lewis Road and NC Hwy 421. Turn left onto Lewis Road and follow the road as it curves around to the left, and becomes Access Road, then proceed straight until you reach a stop sign, located at the intersection of Spencer Farlow Drive and Lewis Drive. Turn right onto Spencer Farlow Drive, and continue down the road to Island Marina Drive, immediately in front of the Waterfronte Villas community. Turn left onto Island Marina Drive, and proceed down approximately 350' northward to reach the parcel for the project site at 1614 Island Marina Drive. The project site is bounded by the Waterfronte Villas community immediately to the south, the Annie Drive NC WRC boat ramp immediately to the north, and the Carolina Beach Yacht Basin to the east. The parcel is approximately 0.74 acres, forming the shape of a triangle. The top line of the parcel, running from just south of the access road associated with the Wildlife boat ramp, runs approximately 420 feet to the northeast. The parcel then turns southeast and runs 140 feet down the short side of the triangle. From that point, the bottom of the parcel line runs west southwest 270 feet back to the originating point. On the property, there is approximately 328' of shoreline. Elevation at the site averages approximately 5'-8' above normal high water (NHW) on the high ground (western portion) and 0'-2' above normal high water (NHW) on the wetland portion (eastern portion). There is no development existing on the property except for a wooden bulkhead along the landward side of the coastal wetlands line. The bulkhead crosses the property in a southeasterly direction from near the northern edge of the parcel until it meets the southern property boundary. The high ground portion of the property has a canopy consisting of a mix of Live Oak (Quercus virginiana) and Laurel Oak (Quercus laurifolia) trees. The understory vegetation includes Greenbriar (Smilax auriculata) and Wax Myrtle (Myrica cerifera), and other native grasses. Transitional species are found along the ecotone between high ground and high elevation salt marsh including Seaside Golden Rod (Solidago sempervirens L.), Sea Oxeye (Borrichia frutescens), and Grounsel-bush (Baccharus halimifolia). The high elevation salt marsh on the property includes Black Needle Rush (Juncus roemarianus) and Salt Meadow Grass (Spartina patens). This mix continues until a lower elevation is reached, where a monoculture of Smooth Cordgrass (Spartina alterniflora) begins. The New Hanover County Land Use Plan classifies the area in the vicinity of the project area as developed. It is located in a VE Flood Zone. The waters in the project area (Carolina Beach Yacht Basin) are classified as SB by the N.C. Division of Water Resources. They are not designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries, and they are closed to the harvest of shellfish. PROPOSED PROJECT The applicant is proposing a new private docking facility (10 slips). The proposed docking facility extend would extend waterward from the eastern side of the parcel towards the Carolina Beach Yacht Basin. The proposed docking facility includes: a fixed pier that measures approximately 509' x 6'. Approximately 105' waterward from the origin of the pier, there would be a 10' span that is elevated 6' above MHW to accommodate a navigable slough that extends northward from the open water along the pier span. Approximately 180' waterward from the origin of the pier, there would be a 14' x 16' covered gazebo over open water. The pier would terminate in a 'T-head' platform measuring approximately 100' by 6', running parallel to the shoreline. Where the pier intersects the `T-head', there would be two 1614 Island Marina Drive, Carol and John Rider Page Three 16' x 6' platforms, on the northern and southern sides of the pier, to serve as 'golf cart turnarounds'. The northern end of the 'T-head' would include a 16' x 16' covered gazebo extending landward over open water. The 'T-head' would also include two 24' x 4' fixed finger piers and one 40' x 4' fixed finger pier extending waterward, perpendicular from the 'T-head'. The southern terminus of the 'T-head' would feature a 12' x 6' access pier extending waterward to a gangway, leading down to a 52' x 6' floating dock, extending perpendicular from the 'T-head'. A total of six 12.5' x 10' boatlifts would be included among the three fixed finger piers, being proposed on both the northern and southern edges of each fixed finger pier. The application states that existing water depths range from -1' MLW in the 'T-head' area to -9'MLW at the most waterward of the proposed features (eastern edge of 52' floating dock). 10. ANTICIPATED IMPACTS As proposed, this docking facility would result in the incorporation of approximately 5,680 ft2 of Public Trust Area and Estuarine Waters. The access pier and platform would shade roughly 2,490 ft2 of vegetated wetlands, and 3,194 ft2 of open water. As the facility is proposed, at its point of furthest extension the proposed structures would extend approximately 81' waterward in an area where the water body is approximately 390' wide, meeting compliance with the'% width rule. The facility would also be constructed approximately 20' landward of the existing Town of Carolina Beach pier head line and approximately 9' landward of the Federal AIWW channel setback. As proposed, the facility would not encroach into the adjacent 15' riparian corridor setback from properties on both the northern and southern borders. The proposed pier would be approximately 100' away from the NC WRC boat ramp to the north, and 50' away from the marina to the south. The application states that the facility would accommodate 10 vessels total. The proposed project would increase boat traffic in an area with heavy preexisting boat traffic, due to the Annie Drive NC WRC boat ramp immediately to the north, and the Waterfronte Villas marina immediately to the south. The proposed facility would incorporate an area of estuarine waters and coastal wetland at the northern terminus of the Carolina Beach Yacht Basin. While this area is not listed as Primary Nursery Area, it has value to juvenile finfish and shrimp populations. As one of the last remaining areas of coastal wetlands in the Carolina Beach Yacht Basin, the marsh ecosystem provides habitat for shrimp, mullet, menhaden, herring, and serves as a baitfish supply for many fishermen/women operating in the area. The site is popular for cast netting, and is valuable to fishermen for its proximity to the boat ramp and accessibility. The proposed constructed features may incorporate the area in a way that makes it less accessible for the public. With shallow water depths (-1' MLW) reported by the applicant in the area that would be utilized for the four northernmost slips, this limited depth creates potential for propwash and kicking affecting the benthic ecological community and fishery. There appear to be no SAV present in the project area. Minor increases in turbidity should be expected during project construction. One 509' long by 6' wide fixed pier, extending from the uplands eastward to a 100' long by 6' wide dock, is proposed to provide water access to the lot. The pier will have two covered gazebos (one with a 16' x 16' roofline and the other with 16' x 14' roofline) and two 16' x 6' golf cart turn -around platforms. In reviewing your application, we have discovered that additional information is needed to complete the review process. Accordingly, I am requesting that you submit the following additional information to this office: 1) Based on the dimensions provided for two covered gazebos, two golf cart platforms, a fixed dock (100% 3 fixed finger piers and 1 floating dock, the total square footage of proposed platform space comes to 2,540 ft2. This is higher than the allowed maximum of 2,000 ft2 per 15A NCAC 07H.0208 (b) (6) (B), which states: "The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet." Please update the proposal to reduce square footage by at least 540 ft2 to reach consistency with the rules. 2) This office is requesting an overlay image for this project, with the site drawing overlayed on an aerial image. Please depict the eastern edge of the property parcel on all drawings submitted. 3) There are some minor discrepancies on the MP-4. Based on the drawings and narrative submitted, a fixed access pier (507') is connecting to another fixed platform (100'). Please update the DCM Mp-4 questions 1 c, 1 e, 1d, to reflect: 1 access pier, 8 fixed platforms (2 gazebos, 2 golf cart turnarounds, 100' x 8' dock, 3 fixed finger piers) and one floating platform. 4) Were water depths taken at low tide or were they estimated based on a survey?
