a. Give complete description:
This project contains a request for CAMA to allow the building of a shared pier and dock to be equally shared by three families
on adjacent lots along the cove joining the three properties. This request builds a pier and dock in two phases. Phase 1
builds a 72 foot pier and a 12xl6 deck and Phase 2 extends the pier to a total length of 420 ft to access deeper water.
THE WARREN FAMILY, 6500 CARMEL TRAIL
THE RAWLS FAMILY, 6418 PROVIDENCE POINT RD
THE CHAPMAN FAMILY. 6408 PROVIDENCE POINT RD
Building just one pier and dock will allow water access from each of the lots and respect the riparian rights of adjacent lots and
minimize intrusion into the estuary.
Phase 1 of the project builts a pier from 6418 Providence Point Rd 72 feet and a 12xl6 deck at the end plus a 16 foot pier with
steps on the water side for launching kayaks.( see sheet 1 drawing )
Phase 2 of the proposed project will add 320 feet of pier for a total of 420 feet and a 12 x 16 dock on the end along with a ramp
down to a fixed 4 x 20ft. and 4 x 12ft. kayak platform. Since we will not be allowed a floating dock, we are also asking to be
allowed to place kayak lift or small watercraft lift and small boat davits on the edge of the dock for raising and lowering a small
12' aluminum boat with a 9.8 HP motor.( See attached photos) The boat would hang suspended on the side of the dock.
Mechanical stops will be added to each lift so no craft can contact the mud bottom. The stops will also prevent launching a
boat when the water level is too shallow.

Recommendations for State Permit — Warren, Chapman, Rawls, Scanlon 7/11/18
The total area of floating docks and platforms was calculated as follows:
Shoreline length = 433' x 8 ft2 = 2,000 ft2 (max allowable)
Chapman Access Pier = 55' x 5' = 275 ft2 (not calculated due to access)
Proposed Warren Access Pier = 35' x 5' = 175 ft2 (not calculated due to access)
Proposed Main Access Pier/Rawls = 410' x 5' = 2,050 ft2 (not calculated due to access)
Proposed joint platform = 12' x 16' = 120 ft2 (6' not included for access)
Proposed "L-head" platform and step down = 16' x 20' = 320 ft2
Total = 440 ft2
It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H
.0208(b)(6), including the eight square foot rule and the '/< width rule. All portions of the
proposed facility that are greater than 6' in width would be located entirely over open water.
The facility would not encroach into the 15' adjacent riparian corridor setback area of the
property to the south, but would encroach into the riparian corridor of 6504 Carmel Trail. The
owner of 6504 Carmel Trail, Charles Scanlon, is a joint applicant for this proposal. The
proposed new docking facility would accommodate three (3) vessels at this location in water
depths ranging from 0' to -1' at NLW. This area of Howe Creek is considered SA-ORW by
DWR and Primary Nursery Area by DMF. Given the shallow water depths, this proposal MAY
BE INCONSISTENT with the minimum water depths established by 07H .1200. However, this
office will support the comments and recommendations of the resource agencies. The
proposed structures would be located entirely over open water, would incorporate 2,907 ft2 of
Estuarine Water and Public Trust Areas, and shade approximately 2,392 ft2 of Coastal
Wetlands. This office has no objection to the proposed work, provided it is consistent with all
other state and federal permitting requirements.

I did not intend to include a condition requiring stops. The Corps authorization will reference the DCM authorization and
approved plans, whichever plans are ultimately approved by DCM. However -please note that the updated plans (9-5-
2018) have a note that the davit will include stops. I received word back from FWS that they have no objection to the
project as proposed. Haven't received anything from NMFS yet.

Hey Chad,
I CC'd Liz on this as well since I was planning on contacting you both with an update. The redesign allowed the slips to
be located next to a slough and depth is approximately 12" of water. DMF has agreed to the redesign with physical
stops on the lifts (davit lift, PWC and Kayak), which the applicant has agreed to. DCM is concerned that the stops may be
overkill due to the size of the davit lift boat and the remaining slips are a PWC and kayak. So please advise if you both
will be conditioning the stops as part of the authorization.
Thanks,
Gregg

N P SECTION MHD
A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has
reviewed the CAMA Major Permit application for proposed actions that impact fish and fish
habitats. The applicant is proposing to build a shared, private docking facility. The facility will
consist of three access piers that meet in a fixed platform measuring 12' by 16'. The fixed platform
will lead to a 325' access pier that terminates with a fixed "L-head" 8' by 16' platform. Attached to
the "L-head" the applicant is proposing a fixed kayak deck, access steps, and a PWC lift in depths
ranging from -1' to -8". Prior to the terminus of the facility, the applicant is proposing a davit lift
and slip in the deepest water depths of -1' NLW. The facility is located in Howe Creek which is
classified as SA -Outstanding Resource Waters (ORW) by the NC Division of Water Resources, and
designated as a primary nursery area (PNA) by the North Carolina Division of Marine Fisheries.
PNAs are estuarine waters where initial post -larval development occurs. Species within
this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Species
inhabit PNAs because they afford food, protection, and proper environmental conditions
during vulnerable periods of their life history, thus protection of these areas are
imperative. Formalized slips in shallow water can allow vessels to repeatedly contact the
bottom, resulting in; aquatic vegetation or shellfish bed loss, anoxia in the sediment which
can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. In
addition, vessels moving to and from these shallow water docks can cause propeller
disturbance impacts to the PNA.
In addition to the productive soft bottom habitat, a large intertidal oyster bed is located
adjacent to the terminus of the facility, just past the quarter -width line. Shell bottom is an
extremely productive self -building three-dimensional habitat that can be impacted long
term through dredging and filling, pollution and other contaminants. This vital estuarine
habitat is very limited in North Carolina, and restoration and conservation of shellfish
habitat is at the forefront. Configuring the facility to place navigation away from the oyster
resource will avoid impacts.

The configuration of the proposed water -dependent structures should be located in the
deepest waters. The davit lift and the PWC lift, respectively, should be located along the
northeast corner of the "L-head" platform in -12" of water. This location is also in the
closest proximity to the access channel north of the intertidal oyster bed. The current
proposal has a kayak lift and access steps in the areas of deepest water, however, those
structures do not require the deepest waters to avoid impacts to PNA soft bottom. Lastly,
to minimize impacts to shallow, soft bottom PNA habitat, any lift structure or davit should
be equipped with stops or mechanism to ensure that the bottom of the lift or boat bottom
must maintain 18" above the substrate bottom.

Biologist's,with the North, Carolina Wildlife Resources Commission (NC.WRC) reviewed the pefmit
application with regard to impacts on fish and wildlife resources. The project, sit'e is located at 6418
Providence Point, adjacent to Howe Cree near Wilmington, NC. Our comments are provided in
accordance with provisions of the Coastal Area Management Act (G.S. 113A-100'through 113A-128), as
amended, Sections 40Land 404 of the Clean Water Act, as.amended, and the Fish and Wildlife
Coordinatiou'Act'(48 $tat. 401, as amended; 16 U:S.C. 661 etseq.).
The applicants propose to;construct a

southeastern edge would be a PWC li

;sifted SA-ORW by the Environmental Management
Nursery Area (PNA) by theNC.Division of.Marine Fisheries.
The waters of Howe Creek near the proposed project are a designated,PNA. PNAs are defined as those
areas.inhabited by the embryonic, larval or juvenile life stages of marine or estuarine frsh'or crustacean
species due to favorable physical, chemical or biological' factors. As a designated PNA, the creek provides
an important rearing area for this variety of:estuarine fishes and invertebrates that need relatively
undisturbed Habitats. The NCWRC does not genemllysupport boating activity and slips located within
insufficient water depths, due to a continued.source of chrouic sediment disruption and elevated turbidity
associated with hull scraping; prop scour, and chronic bottom disturbance. These disturbances.disrupt

habitat, negatively affect feeding efforts, and clog respiratory systems. The davit lift is located in the
most -shallow area of the docking facility. This slip, as well as ingress and egress to the slip, would likely
cause bottom disturbance. Therefore, we recommend the applicants consider removal of the davit or
relocation to either the kayak or P WC area that exhibit greater water depths and are closer to deeper water
within Howe Creek. We do recognize and appreciate the efforts the applicants demonstrated in the
reduction of impacts to aquatic resources with the proposal of a shared docking facility.

9. PROJECT DESCRIPTION:
The project site is located at 6408 Providence Point Road, 6418 Providence Point Road, and 6500
Carmel Trail, adjacent to Howe Creek, in New Hanover County. To locate the properties from Market
Street (NC Highway 17), turn right onto Middle Sound Loop Road and continue southeast through the
traffic circle approximately 0.5 miles until you come to Providence Point Road and make a right. The
properties of interest are at the terminus of Providence Point Road, where Carmel Trail intersects.
Together, the properties are approximately 2.1 acres total and average approximately 17' above normal
high water (NHW). The properties are currently developed with single family homes on three separate
parcels and together have approximately 433' of shoreline. The upland vegetation consists of landscaped
yards with a mix of native hardwoods, pine trees, and shrubs. There is currently a shared 2-slip docking
facility extending in a southeasterly direction from Mr. Scanlon's property at 6504 Carmel into Howe
Creek. This facility is shared between the Scanlon's and the Lupo's who own 6508 Carmel Trail. Through
a review of aerial photography, the facility appears to have been constructed sometime between 1993
and 1998, but no permitting history could be located. The adjacent property to the south is developed
with a single family home and private docking facility. Coastal Wetlands measuring approximately 280'
in width running the length of the shoreline in the project area and consist primarily of Smooth Cordgrass
(Spartina a/temif/ora) and Black Needlerush (Juncus roemerianus). There are several areas that are void
of wetland vegetation (open water), within the larger vegetated area that can be observed using aerial
photography. There was no SAV observed in the project area, but there is an oyster bed just waterward
of the proposed facility as shown on the drawings (See Sheets 1 and 3 of 5).
The City of Wilmington/New Hanover County 2006 Land Use Plan classifies adjacent waters as
Conservation, and the adjacent high ground portion of the project area as Resource Protection. The
waters of the Howe Creek are classed SA-ORW by the Division of Water Resources. The area is
designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are
CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to construct a new shared, private docking facility. Due to the orientation of the
shoreline (cove) and the established riparian corridors (See Sheet 1 of 5), the applicants propose to
construct a shared facility to gain water access further out into Howe Creek. Mr. Scanlon is listed as a
joint applicant, because the shared facility would be located in a portion of the riparian corridor for 6504
Carmel Trail of which he is the owner. The application states that three (3) access piers each measuring
5' in width would be constructed from the property of Rawls, Chapman, and Warren respectively and
meet at a fixed platform measuring approximately 12' by 16'. This platform would be located over an area
currently void of wetland vegetation. The access pier from the Chapman property would measure
approximately 55' in length, the access pier from the Rawls property would measure approximately 70'
in length, and the access pier from the Warren property would measure approximately 35' in length. The
applicant also proposes two sets of access steps, one set extending from the northern side of the fixed
pier, and one set extending from the southern side of the fixed pier. These access steps would be located
just waterward of the fixed, joint platform. From this joint platform, a fixed pier measuring approximately
325' in length (for a total length of approximately 410' from the Rawls property) by 5' in width would be
constructed in an easterly direction into Howe Creek (See Sheet 3 of 5). At the terminus of the fixed pier
would be a fixed "L-head" platform measurinby 16'. Approximately 15' landward of the terminus, on
the north side of the pier, would be a ramp leading to a lower level fixed step-down platform that would
run the northern and eastern length of the fixed 1-head" platform and m asure approxim
(the total area of the fixed "L-head" including the step-down would belby 20'). Apr AW
landward of the fixed platform would be a davit lift measuring approximately 4' by 6'. Water depths in the

area of the davit lift would measure 0' at NLW. On the northern edge of the fixed step-down platform
would be a kayak lift measuring approximately 3' by 4'. On the southeastern edge of the fixed step-down
would be a PWC lift measuring approximately 3' by 4' (See Sheets 4 and 5 of 5). Water depths in the
area of the PWC lift and kayak lift range from -0.67' to -1' at NLW. The applicant also proposes a set of
access steps from the northeastern edge of the fixed step-down. The application states that the proposed
facility would accommodate up to three (3) vessels in water depths ranging from 0' to -1' at NLW. The
application states that the typical boat length would be 12' and would consist of kayaks, a PWC, and a
skiff (See MP-4 and narrative/photos of lifts). The facility would extend approximately 60' into a water
body measuring approximately 350' in width, which would meet the quarter width distance. The proposed
configuration would encroach into the riparian corridor of 6504 Carmel Trail (Scanlon), and the property
owner is a joint applicant. The proposed configuration would not encroach into the adjacent 15-foot
Riparian Corridor Setback Area requirement for the property to the south at 6404 Providence Point Road
(Kronengold).
10. ANTICIPATED IMPACTS:
The proposed shared docking facility would incorporate approximately 2,907 ftz of Estuarine Water and
Public Trust Areas, and shade approximately 2,392 ftz of Coastal Wetlands. The proposed configuration
would encroach into the riparian corridor of 6504 Carmel Trail (Scanlon), and the property owner is a joint
applicant. The proposed configuration would not encroach into the adjacent 15-foot riparian corridor
setback area for the property to the south at 6404 Providence Point Road (Kronengold). The proposed
structures would extend approximately 60' into a waterbody measuring approximately 350' in width, which
would conform with the 1/4 width distance rule. With the proposed configuration the structures would
allow the facility to accommodate up to three (3) vessels in water depths of ranging from 0' to -1' at NLW.
Minor increases in turbidity should be expected during construction.

6418 PROVIDENCE POINT RD
PIER AND DOCK PROJECT
Overview
This project contains a request for CAMA to allow the building of a shared pier and dock
to be equally shared by three families on adjacent lots along the cove joining the three
properties. This request builds a pier 420 ft. total length to access deeper water.
THE WARREN FAMILY, 6500 CARMEL TRAIL
THE RAWLS FAMILY, 6418 PROVIDENCE POINT RD
THE CHAPMAN FAMILY, 6408 PROVIDENCE POINT RD
Building just one pier and dock will allow water access from each of the lots and respect
the riparian rights of adjacent lots and minimize intrusion into the estuary that we
recognize as a primary nursery area.
We plan to build this in two phases.
Phase 1 of the project built a pier from 6418 Providence Point Rd 72 feet and a 12x16
deck at the end plus a 16 foot pier with steps on the water side for launching kayaks. We
will also add a 55foot and 35foot pier linking the adjacent properties to the 12x16 deck.
(see sheet 1 drawing )
Phase 2 of the proposed project will add 320 feet of pier for a total of 420 feet and a 12
x 16 dock on the end along with a ramp down to a fixed 4 x ;tuft. and 4 x 12ft. kayak
platform. Since we will not be allowed a floating dock, we are also asking to be allowed
to place kayak lift, PWC lift, and small boat davits on the edge of the dock for raising and
lowering of kayaks, PWCs, and a small 12' aluminum boat with a 9.8 HP motor. (See
attached photos) The boat would hang suspended on the side of the dock.
Mr. Scanlon is a co -applicant and has approved this docking facility within his riparian
corridor. (RECEIVED RECEIVED

6500 Carmel Trail
Wilmington, NC 28411-9794
Dear Mr. Warren:
The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for William
Rawls, William Chapman, and Charles Scanlon, for State approval for development of the subject properties located
at 6408 Providence Point Road, 6418 Providence Point Road, and 6500 Carmel Trail, adjacent to Howe Creek, in
Wilmington, New Hanover County. It was received as complete on July 10, 2018 and appears to be adequate for
processing at this time. The projected deadline for making a decision is September 23, 2018. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not been notified
of a final action by the initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 10, 2018, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy my field report and/or comments from reviewing agencies.
