Hi All,
I have updated the adjacent property owner notifications and plan to have my drawings complete by tomorrow
(Thursday) or Friday at the latest. Attached are the Signed forms from Mr. Chad Paul, III for the Bald Head Island
Limited, LLC owned marshland; Mr. M.Kent Mitchell for the east adjacent lot 15 Windward Court, and the Green Card
from Mr. Robert Zaytoun for west adjacent lot 13 Windward Court, Bald Head Island, NC 28461. Mr. Zaytoun told Dr.
Waddell that he had no issue with the application. (His bulkhead replacement will probably be soon.) I do not know if
he sent a response letter to Tara, but I sent out his notification on March 21, 2018. Much more than 10 days has
passed.
The delays have all been mine. I have been non-stop busy in my supposed retirement. Dr. Waddell is really getting
concerned about replacing it before the active part of hurricane season. The damage is getting more severe. The
attached picture shows the current state of the timber wall and buttresses, and show s the riprap that precludes this
from being a simple general permit. Moving the riprap would undoubtedly allow blow-out of the bulkhead.

Recommendations for State Permit — William Waddell Bulkhead Repair/Replacement
The replacement bulkhead and associated rip rap would continue to provide stabilization for the upland
area adjacent to Bald Head Creek. It is staffs recommendation that the proposal appears to be consistent
with the use standards set forth in NCAC 07H .0208(b)(7)(D), due to an identifiable erosion problem
onsite and the presence of existing rip rap. The proposed structure would be located below NHW.
This office has no objection to the proposed work provided that it is consistent with all other state and
federal permitting requirements. Any permit issued should include standard conditions for bulkheads
including a condition requiring the alignment to be staked by a DCM representative prior to construction.

The applicant is proposing to replace an existing bulkhead, add a walkway and place rip
rap below Normal High Water (NHW) along 87 linear feet of shoreline adjacent to Bald
Head Creek in the Village of Bald Head Island in Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are ES, EW and
PTA. Waters at the site are classified as SA; HQW and is open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Bald Head Island Land Use Plan
and offer the following comments.
The general area of the project is classified as Residential and Resource Protection.
In general, Bald Head Island allows development which is consistent with the State's
minimum use standards. The Village of Bald Head Island Land Use Plan contains some
policies, which exceed the State's minimum use standards. However, none of these
policies appear to be applicable to this proposal.
This project is consistent with the Village of Bald Head Island Land Use Plan.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Waddell,
You have our approval, in accordance with the attached conditions and those listed below, to
impact approximately 0.02 acres of open waters to replace an existing bulkhead and construct rip
rap stabilization as described in your application received by the N.C. Division of Water Resources
(DWR) on June 27, 2018. After reviewing your application, we have decided that the impacts are
covered by General Water Quality Certification Number 4144 (GC4144).
In addition, you should obtain or otherwise comply with any other required federal, state or local
permits before you go ahead with your project including (but not limited to) Erosion and Sediment
Control, Non -discharge, and stormwater regulations. Also, this approval to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application shall expire upon
expiration of the 404 Permit. This Certification can also be found on line at:

This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and
is thereby responsible for complying with all conditions. If total fills for this project (now or in
the future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may
be required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.
The Additional Conditions of the Certification are:
This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If
you change your project, you must notify the Division and you may be required to submit

a new application package with the appropriate fee. If the property is sold, the new owner
must be given a copy of this approval letter and General Certification and is responsible
for complying with all conditions. Any new owner must notify the Division and request
the Certification be issued in their name (I 5A NCAC 02H .0501 and .0502).
2. Any final construction plans for this project must include or reference the application and
plans approved by the Division under this authorization letter and certification. The
applicant will also be required to evaluate all acquired permits to assure that they are
consistent and all relative impacts are accounted for and shown on the construction plans.
[15A NCAC 02H .0502 (b) and 15A NCAC 02H .0506 (4)] The applicant shall require his
contractors (and/or agents) to comply with all of the terms of this Certification, and shall
provide each of its contractors (and/or agents) a copy of this Certification.
3. Turbidity Standard
The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded
as described in 15 A NCAC 2B .0220. Appropriate sediment and erosion control practices
must be used to meet this standard. Turbidity curtains shall be used as appropriate. Please
notify this Office if any turbidity issues arise at 910.796.7215
4. This General Certification shall expire on the same day as the expiration date of the
corresponding General Permit. The conditions in effect on the date of issuance of the
Certification for a specific project shall remain in effect for the life of the project, regardless
of the expiration of this Certification.
5. The permittee shall require its contractors and/or agents to comply with the terms of this
permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project a
copy of this certification. A copy of this certification including all conditions shall be
available at the project site during the construction and maintenance of this project. [15A
NCAC 02H .0507 (c) and 15A NCAC 02H .0506 (b)(2) and (c)(2)]
6. Continuing Compliance:
The applicant/permittee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements
of State and Federal law. If the Division determines that such standards or laws are not
being met, including failure to sustain a designated or achieved use, or that State or Federal
law is being violated, or that fluther conditions are necessary to assure compliance, than
the Division may reevaluate and modify this General Water Quality Certification. [15A

7. All mechanized equipment operated near surface waters or wetlands will be regularly
inspected and maintained to prevent contamination of waters and wetlands from fuels,
lubricants, hydraulic fluids or other potential toxic chemicals. In the event of a
hydrocarbon or chemical spill, the permittee/contractor shall immediately contact the
Division of Water Quality, between the hours of 8 am to 5 pm at the Wilmington Regional
Office at 910.796.7215 and after hours and on weekends call (800) 858-0368. Management
of such spills shall comply with provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act. [15A NCAC 02H .0506 (b)(3) and (c)(3), 15A NCAC
02B .0200 (3)(f), and GS 143 Article 21A].
8. Fueling, lubrication and general equipment maintenance should not take place within 50
feet of a waterbody or wetlands to prevent contamination by fuel and oils. [15A NCAC
02H .0506 (b)(3) and (c)(3) and 15A NCAC 02B .0200 (3)(f)].
9. This certification grants permission to the director, an authorized representative of the
Director, or DEQ staff, upon the presentation of proper credentials, to enter the property
during normal business hours 15A NCAC 02H.0502(e).
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certification or
applicable Buffer Rules, and any subsequent modifications, the applicant and/or
authorized agent is required to return a completed certificate of completion form to the
NCDEQ DWR 401 and Buffers Unit North Carolina Division of Water Resources, 1617
Mail Service Center, Raleigh, NC, 27699 within ten days of project completion. The
certification of completion is available at:

Violations of any condition herein set forth may result in revocation of this Certification
and may result in criminal and/or civil penalties. The authorization to proceed with your
proposed impacts or to conduct impacts to waters as depicted in your application and as
authorized by this Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by
filing a written petition for an administrative hearing to the Office of Administrative Hearings
(hereby known as OAH). A petition form may be obtained from the OAH at
htt�://www.ncoah.com/ or by calling the OAH Clerk's Office at (919) 431-3000 for
information. Within sixty (60) calendar days of receipt of this notice, a petition must be filed
with the OAH. A petition is considered filed when the original and one (1) copy along with any
applicable OAH filing fee is received in the OAH during normal office hours (Monday through
Friday between 8:00 am and 5:00 pm, excluding official state holidays). The petition may be

9. PROJECT DESCRIPTION:
The project site is located at 14 Windward Court on Bald Head Island. From the ferry terminal, travel south to the
intersection of Marina Wynd and N. Bald Head Wynd and turn left on Keelson Row. Travel Approximately 0.26
miles and turn right onto Windward Court. The subject property will be located on the left at the end of Windward
Court. The property is bordered by residential lots to the north and west and east and by Bald Head Creek to the
south.
Bald Head Island is part of an island group known as Smith Island, located at the confluence of the Cape Fear
River and Atlantic Ocean between Fort Fisher and Oak Island/Caswell Beach in Brunswick County. The island is
accessed by private boat or a private ferry service from Southport. The project area is located within Bald Head
Creek in the northwestern part of the island and encompasses approximately 97 linear ft. of shoreline. Adjacent
vegetation that exists in the creek consists primarily of Smooth Cord Grass (Spartina alterniora). Water depths
within the project area range from -0 ft. to -4.5 ft at Normal Low Water (NLW). The project area is located within
the Estuarine Shoreline, Estuarine Water and Public Trust Areas of Environmental Concern (AECs).
The property consists of a 3200 sq. ft. tract which is elevated approximately 7 ft. above NHW. The vegetated
portion of the tract consists primarily of upland vegetation and ornamental grasses. The entire shoreline has been
stabilized with a bulkhead and associated rip rap that meets NHW. The upland area above the existing bulkhead is
occupied by a single-family residence and associated crofter.
The Village of Bald Head Island Land Use Plan classifies adjacent waters as Conservation, and the adjacent high
ground portion of the project area as Low Density Residential. The waters of Bald Head Creek are classified as
SA/HQW by the North Carolina Division of Water Resources. The waters are not designated as a Primary Nursery
Area (PNA) by the N.C. Division of Marine Fisheries. They are OPEN to the harvesting of shellfish.
PROPOSED PROJECT:
The applicant proposes to replace an existing bulkhead, add a walkway and place rip rap below Normal High
Water (NHW) along 87 linear ft. of shoreline adjacent to Bald Head Creek. According to the applicant the existing
timber bulkheads is failing and existing rip rap is currently supporting the wall. The application states that the
eastern section of bulkhead, measuring 55 linear ft., would be replaced 5 ft. waterward of the existing wall due to
constraints with the existing rock. Additional rip rap would be placed waterward of this section of bulkhead
extending 5 additional ft. towards Bald Head Creek for a total of 10 ft. of impact below NHW. The applicant has
also proposed a walkway landward of the eastern bulkhead measuring 55 ft. long by 5 ft. wide. The south
bulkhead extends 32 ft. and would be replaced with a new wall 2 ft. waterward of the existing footprint.
Additional rip rap would also be placed waterward of this section of bulkhead extending an additional 5 ft.
waterward for a total of 7 ft. of impact below NHW (see Sheets C 1 and C3). The application states that all work
would be done from the waterward side of the wall to ensure that the site remains stable (see Narrative).
10. ANTICIPATED IMPACTS
The proposed bulkhead replacement and rip rap placement and would result in the filling of 859 sq. ft. of open
water. The proposed walkway along the eastern bulkhead, the backfill of the bulkhead and installation of the
associated tieback system would result in approximately 1,940 square feet of high ground disturbance.

The Bald Head Creek bulkhead at Dr. Bill Waddell's residence, 14 Windward Court, Bald Head Island
is in need of repair/replacement due to age and continued destabilizing effects of recent shoreline
erosion. See drawing Cl, seal dated 11-24-14. Portions of the eastern timber bulkhead are especially
in need of replacement, as there are cracked piles, separated buttresses and bulging sloppy vee sheet
pile. The bulkhead itself is approaching thirty years of age, but more importantly the creek bed erosion
has reduced the load capacity of his wall.
While situations like this have generally been permitted as a CAMA Repair Exemption or a CAMA
General Permit, safety concerns of the Contractor have raised this to a level of CAMA Major Permit.
The existing riprap does not allow us to construct a new bulkhead within 2 feet waterward of the
existing sheet pile, and removing the support provided by the existing riprap to meet the 2' offset
would likely cause the existing wall to collapse. We need the greater latitude of the 4 ft average offset
allowed by a Major Permit to safely accomplish rebuilding the wall for shoreline stabilization, by
adding barge based piles driven outside the toe of the existing riprap, and then working landward with
walers and sheet pile. From the photos on drawing Cl, you can see that the yard is not easily
accessible to use land based heavy machinery, and the soil overburden of such equipment would also
likely cause the existing wall to blow out.
The project scope is for repair/replacement of the entire 55 foot of the east bulkhead and 32 ft of the
south bulkhead, as well as riprap for the entire 87'+/- of length. The bulkhead detail(s) are similar to
the bulkhead repairs/replacement done in 2010 next door at 15 & 16 Windward Court, owned by Mr.
M. Kent Mitchell. Mr. Mitcell has waived the 15' riparian access, and has suggested the wood
walkway that I am showing as a design option. As the walkway will add to project expense, we will
limit it to along the east bulkhead. My typical bulkhead detail indicates a three waler design, but
depending on the depth to mudline at time of construction, it may need to be a 4 waler design. While
the drawing indicates sloppy vee sheeting, this is a cost dependent project, so we would like the option
of using vinyl or frp sheet pile, with the appropriate changes in structural details, if either of those look
like they will be less expensive. I have also noted that optional tiebacks can be added after the new
buttresses are in place, hand dug, and meeting the building code minimum distance back of 2 x the
distance from grade to point of mudline/riprap support.
As supporting evidence of the creek erosion, Bald Head Island Limited, LLC has received CAMA
Repair Exemption in 2010, 2012 and 2014 for repairs/sistering of its nearby Tent Site Creek Dock
piles, where as much as 8' of scouring has occurred, and some piles have even jAWg,ftee from their

Hi All,
I have updated the adjacent property owner notifications and plan to have my drawings complete by tomorrow
(Thursday) or Friday at the latest. Attached are the Signed forms from Mr. Chad Paul, III for the Bald Head Island
Limited, LLC owned marshland; Mr. M.Kent Mitchell for the east adjacent lot 15 Windward Court, and the Green Card
from Mr. Robert Zaytoun for west adjacent lot 13 Windward Court, Bald Head Island, NC 28461. Mr. Zaytoun told Dr.
Waddell that he had no issue with the application. (His bulkhead replacement will probably be soon.) I do not know if
he sent a response letter to Tara, but I sent out his notification on March 21, 2018. Much more than 10 days has
passed.
The delays have all been mine. I have been non-stop busy in my supposed retirement. Dr. Waddell is really getting
concerned about replacing it before the active part of hurricane season. The damage is getting more severe. The
attached picture shows the current state of the timber wall and buttresses, and show s the riprap that precludes this
from being a simple general permit. Moving the riprap would undoubtedly allow blow-out of the bulkhead.

Dear Property Owner:
Dr. Bill Waddell of Lot 14, Harbour Village (14 Windward Ct), Bald Head Island has retained me as
authorized agent in applying for a CAMA Bulkhead Repair/Reconstruction Permit, including
additional rip -rap at his property next to yours. I am including with this letter a CAMA Adjacent
Property Owner Notification Form.
His eastern timber bulkhead is especially in need of repair (to the Mitchell side of his property). The
bulkhead itself is approximately thirty years of age, but more importantly there has been extensive
creek bed erosion recently along the eastern side, which has reduced the load capacity of his wall.
There are several broken support piles and buttresses.
In discussions with one of the local contractors, there is apprehension about removing the existing
riprap, which might cause immediate and/or catastrophic failure of certain wall segments. As such, we
cannot do the repair under a CAMA Repair Exemption, as that requires the new wall to be replaced
within 2' of the old bulkhead. We are thus applying for a CAMA Major Permit which allows an
average bulkhead placement of 4'. The contractor feels that will allow him to more safely accomplish
the repairstbulkhead replacement.
Note that the new bulkhead sections will be similar to the replacement done at Mr. Kent Mitchell's
property/house at HV15&16 in 2010. The CAMA Major Permit allows permitting of Dr. Waddell's
entire bulkhead rather than a Repair Exemption which only allows replacement of 50%, or a bulkhead
general permit that has a 4 month expiration date.
I have included the Division of Coastal Management Notification/Waiver Form. If you could so
kindly fill it out and return to Ms. Tara MacPherson, CAMA Field Agent, at the North Carolina
Division of Coastal Management, 127 Cardinal Drive Extension, Wilmington, NC 28405, it would be

The Division of Coastal Management hereby acknowledges receipt of your application, on behalf of Mr.
William Waddell, for State approval to replace a bulkhead and associated rip rap within Bald Head Creek located at
14 Windward Court in Bald Head Island, Brunswick County. It was received as complete on June 11, 2018 and
appears to be adequate for processing at this time. The projected deadline for making a decision is August 25, 2018.
An additional 75-day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an
additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 11, 2018, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and shall
include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of
your proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the
road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you
wish to receive a copy of my field report and/or comments from reviewing agencies.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted on June 11, 2018 for development permits in Areas
of Environmental Concern on Bald Head Island, in Brunswick County, as designated under the CAMA:
The Bald Head Island Conservancy proposed to create four new oyster sills within Bald Head
Creek, adjacent to N. Bald Head W md; and William Waddell proposed to replace an existing bulkhead,
add a walkway and riprap at 14 Windward Ct., adjacent to Bald Head Creek. Copies of these applications
can be examined or copied at the office of Tara MacPherson, N.C. Dept. of Environmental Quality,
Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7425) during
normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to July 14, 2018 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice

extending waterward of the bulkhead, which precludes
obtaining Repair Exemption or Bulkhead General
Permit. Removing riprap could cause catastrophic
failure. New Bulkhead proposed at toe of riprap.
Note: Buttresses to remain in place during
construction of the replacement bulkhead, and can
be left permanently in place under bulkhead cap
walkway. Or once backfilled, old sloppy Yee sheet
pile and piles/buttresses can be removed.

Existing east wall has cracked piles,
separated buttresses and bulging
sloppy —Yee sheeting. Removing existing
riprop to do a traditional bulkhead repair
would be unsafe.
Safe structural replacement for the east
wall is to set new timber piles just
waterward of existing riprap, then walers
landward and sheeting landward of that.
South bulkhead does not have broken
piles, thus can have a tighter repair.
