X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 to T.J.'s Land Development, LLC., PO Box 125, Pantego, NC 27860 zing development in Beaufort County at confluence of Baker's Canal and Creek and at 27159 HWY 264 E., near Belhaven, as requested in the permittee's application dated attached workplan drawings (4), Sheets 2,5 dated 3/1/18 and Sheets 3A dated 6/1/18. Tlus`permit, issued on October 5, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation if these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Excavation In order to protect juvenile shrimp and finfish populations, no excavation or filling within open water shall be permitted between April 1 and September 30 of any year without the, prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies. No excavation shall take place outside of the areas indicated on the workplan drawings. Excavation shall not exceed 6 feet below the normal water level. In no case shall the depth of excavation exceed the depth of connecting waters. The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. ADDITIONAL CONDITIONS Permit No.115-18 Page 2 of 5 The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with NCAC 15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. New dredging in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Spoil Disposal All excavated materials shall be confined above normal water and landward of regularly or irregularly "flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. Maintenance Clause The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved, by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Shoreline Stabilization - Bulkhead The bulkhead, shall be constructed in accordance with the alignment depicted on the attached workplan drawings. No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved bulkhead alignment. The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of The bulkhead shall be constructed prior to any backfilling activities. The bulkhead shall be structurally fight so as to prevent seepage of backfill materials through the structure. I'� T..I.'s Development, LLC. ADDITIONAL CONDITIONS Permit No.115-18 Page 3 of 5 14) ' The fill material shall be clean and free of any pollutants except in trace quantities. Sedimentation and Erosion Control 15) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Marina 16) This permit authorizes only the docks, piers, dolphin clusters, mooring pilings, no wake sign, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 17) The authorized marina shall not exceed the quarter width of the water body as measured from the waterward edge of the authorized bulkhead along Baker's Canal. In the case of the travel lift basin area, the '`/< width is measured by extending a line matched with the authorized bulkhead along Baker's Canal and measuring perpendicular to the adjacent marsh/canal edge. No portion of the marina shall exceed a maximum of 21.75 $ from the waterward edge of the bulkhead along Baker's Canal or the match line extension, or as depicted in the attached workplan, whichever is less. 18) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina.shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 19) Prior to the occupancy of any new slips authorized under this permit, a marine pumpout sewage disposal facility shall be installed in an easily accessible location and maintained in operable condition for the life of the marina. 20) Prior to the occupancy of any slips authorized by this permit, the permittee shall meet on -site with a representative of the Division to ensure that the required pumpout facility is in place and operable. 21) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 22) This permit authorizes a maximum of 13 formalized boat slips. 23) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. ADDITIONAL CONDITIONS- - - Permit No.115-18 Page 4 of 5 The no wake signs shall conform with any and all appropriate regulations governing such structures, including but not limited to marking and lighting requirements of the N.C. Wildlife Resources "Commission and/or the U.S. Coast Guard. Boat Ramp at ramp shall either be poured at an upland location and pushed into place once hardened, or entirely within a watertight containment structure. Live concrete shall not be allowed to contact of the State or waters that will enter waters of the State. Placement of fill materials below normal water level shall be limited to the ramp structure. Excavation and ground disturbing activities, associated with the placement of the boat ramp, above and below the normal water line shall be limited to that absolutely necessary to establish adequate ramp slope and provide a ramp no greater in size than specified in the attached permit application and workplan drawings. Upland Development and Travel Lift Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the wash down, travel lift and road, walkway, and other associated infrastructure, all as expressly and specifically set forth in the `,attached permit application and workplan drawings. General 'The permittee shall implement all conditions of the DWR 401 Water Quality Certification. Any violation of Division of Water Resources water quality standards shall be considered a violation of this permit. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms ;and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the ,permitted activity without having it transferred to a third party. In order to ensure compliance with the conditions of this Permit, the permittee and his contractor shall schedule a pre -construction conference with the Division of Coastal Management prior to the initiation of any dredging or mobilization activities. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. s Development, LLC. Permit No.115-18 Page 5 of 5 ADDITIONAL CONDITIONS The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2018-01563). The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 18-1108. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-6481 prior to the commencement of any such activity forahis determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The applicant is proposing to redevelop the property from a fishhouse to serve as a boat yard with 13 wet slips, a travel lift and wash down pad for hauling larger vessels for maintenance and repair, as well as fueling facilities, marina store, and a marine pumpout. The planned structures include an upland boat basin, travel lift slip, travel lift road, retaining wall, bulkhead, slips, finger piers, and a boat ramp. The applicant is also proposing maintenance excavation activities in Battalina Creek +38' wide x+390' long to a final depth of 6' below NWL. The application also proposed to excavate an area of uplands adjacent to Bakers Canal 30' x±520' and deepen Bakers Canal to 6' below NWL. AECs involved include: Estuarine Waters, Public Trust Areas, Estuarine Shoreline, and Public Trust Shoreline. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Battalina Creek is classified as SC;HQW,NSW, and is a Primary Nursery Area. The creek is not open to shellfishing. No Submerged Aquatic Vegetation (SAV) was observed onsite. Once completed the project will increase boat traffic and the associated impacts. Basis for Determination: The p�oject'is subject to tNe Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land Use Map (FLUM) classifies the site as Towns and Community Centers (land), Conservation I (Public Trust and Estuarine Waters AEC, water protected by Tar -Pam Buffer, Coastal Wetlands), and Conservation II (100-year flood plain). The following LUP policies may be applicable to this request: 2.1 Conservation I 2.1.3 Only development and land/water use activities that are consistent with the use standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this classification. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 785 East Pantego Street adjacent manmade canals off Batallina Creek in Belhaven, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to redevelop the property to serve as a boat yard providing 13 wet slips, a travel lift, and wash down pad for hauling larger vessels for repair as well as a facility to provide marina services such as fueling, pump out, and marina store. To facilitate use of the facility, upland and canal / creek bottom will be excavated to a final water depth of -6' NWL. Batalina Creek is classified SC HWQ NSW by the Environmental Management Commission and is designated a primary nursery area (PNA) by the NC Division of Marine Fisheries (NCDMF). A NCDEQ scoping meeting was conducted in 2017 where the applicant presented his proposal to several state and federal agencies. Comments were given and changes to the proposal, including final water depths, have been incorporated into the permit application. The NCWRC appreciates the changes made to the proposal and does not believe the project will have significant adverse impacts to aquatic resources. The applicant proposes to redevelop a property adjacent to Baker Canal at the head of Batalina Creek off of the Pungo River. Batalina Creek is a designated Primary Nursery Area (PNA) by the Marine Fisheries Commission. The majority of the property has been used as parking and staging for crabbing operations and the property across the Baker Canal is existing boat yard that service sailboats and motorized vessels. The proposed development includes 13 wet slips, a travel -lift and wash down pad, fueling facility, pump -out, and marina store. The proposal includes widening Baker Canal to support angled slips and maximize dock space, rebuilding the bulkhead along the shoreline, reconstructed a boat ramp in that is in disrepair, and construction of a travel lift at the confluence of Baker Canal and Baker Creek. Upland developments include the wash -down pad, ship store, fuel and pump -out facilities. The proposal also includes maintenance dredging (bucket and barge) of Baker Canal to -6' @NWL as well as a 38' x 390' channel from Baker Canal into Bandina Creek also to -6' @NWL. A site visit in the spring 2018 showed existing water depths in the canal ranging from -6' in the center of the canal to -3' along portions of bulkhead; the depths observed in Batalina Creek in the project area ranged from -5' to -6' @NWL dropping off rapidly to -T or more towards the mouth of the Creek. Although there are no existing permits for a dredge footprint into Batalina Creek site condition including a spoil bank and squared off shoreline on the southern bank of the creek suggest dredging has occurred and the existing boat yard in currently servicing vessels up to 45' show a continued used of the area. Batalina creek is sheltered and has a very small drainage area/ source for sedimentation so it is not unlikely that the area would remain open for a long time. The depth survey showed only several areas where "humps" in the marked channel would cause concern for boats with drafts in excess of 5 feet. Baker Canal although connected to the PNA water is an entire man made cut into high ground bulkheaded for nearly its entire length. As site condition bear dredging has occurred within the project boundaries of Batalina Creek and there is a documented continuous use of the area evidenced by the existing boat maintenance yard and marked channel DCM fisheries will not consider this new dredging in a PNA and have no objections to the project as proposed. A moratorium on dredging from April 1 to September 30 is recommended as a condition of the permit to limit the impact of high turbidity levels expected during the dredging to larval and juvenile shellfish in the designated PNA. TJ Land Development Battalina Creek Baker Canal Baker Creek Beaufort County Project Setting The 7.62-acre project site is located at 785 Pantego Street in the Town of Belhaven adjacent a canal system off Battalina Creek in Beaufort County, North Carolina. The canal system is at the head of the western fork of Battalina Creek. Fill generated from the excavation of this canal system was likely used to fill the adjacent high marsh. The remaining unaffected high marsh on the western side of the project site is vegetated with black needle rush Ancus roemerianus), giant cordgrass S artina cvnosuroidesl salt grass Distchlis s icata and salt meadow hay S artina atens . The project site was formerly developed as a wholesale/retail fishhouse and crab processing business. All but one of the buildings has been demolished leaving the concrete slabs and adjacent gravel parking and driveways. There is an older mobile home in a grassed area on the west side of the project site adjacent Pantego street. The shoreline along Baker Creek from it's confluence with Battalina Creek upstream to the terminus of Baker Creek at Pantego Street is stabilized with a bulkhead. A portion of the bulkhead next to the demolished buildings has been replaced with a vinyl bulkhead. The remaining bullhead along Baker Creek is a deteriorating wooden bulkhead. There is an existing boat ramp at the head of Baker Creek adjacent Pantego street between the project site and Axson Smith property. The bulkhead height along Baker Creek ranges from 2.5' to 3.0' above the normal water level NWL). The shoreline along Baker Canal is not stabilized with a bulkhead and the bank has a lower elevation ranging from 1.5' to 3' above the NWL. The shorelines along Baker Canal and Baker Creek have served as a harbor of refuge for commercial fishing vessels that, for the most part, participate in the blue crab pot fishery. There is a road/area of compacted gravel that is used to access boats moored to the bulkhead along Baker Creek. This area of compacted soil and gravel was recently leveled with sand. Across Baker Creek and adjacent to the project site are two separate tracts: one owned by East End Holdings company and one tract owned by Axson Smith. The East End Holding company property is an open grassed tract of uplands with shoreline along Battatlina Creek, Bakers Creek and another canal (Boat Harbor Canal) between the aforementioned property and Axson Smith. This property is utilized as a staging area and harbor of refuge for commercial fishing vessels. The Axson Smith property is a commercial boat yard offering towing, boat storage and haulout services for maintenance and repair for larger sailing and motor vessels. There is a channel marked by day markers from the confluence of Battalina Creek and the Pungo River to the canal system. Water depths in the channel near the mouth of Battalina Creek are 7' below the NWL or greater and shallow to 5.0' to 6' below the NWL at the mouth of Baker Canal and Baker Creek. Water depths in Baker Creek are deeper than Baker Canal, most likely due to larger deeper draft vessels accessing the Axson Smith boatyard. Water depths in Baker Canal range from 3.0' to 4.5' below the NWL. Battalina Creek is designated as SC NSW by the Environmental Management Commission and designated as a Primary Nursery Area by the Division of Marine Fisheries and is closed to shellfishing. The applicant proposes to undertake maintenance excavation activities in Battalina Creek ±38' wide x f390' long to a final depth of 6.0' below the NWL. The applicant proposes to excavate an area of uplands adjacent Baker canal 30' x ±520' and deepen Bakers Canal to 6.0' below the NWL. The canal widening is to support 13 fixed slips angled/orientated downstream from the bank accessed by 7 — 3'wide x 30' long finger piers. The slips range in width from 14' to 20' and are ±40' long. A 6' wide x 372' long wooden dock at ground level is proposed on the landward side of the proposed bulkhead adjacent the 13 slips. At the upland point created by the confluence of Baker Canal and Baker Creek, a 21' wide x 84' long travel lift slip is proposed. The lift will travel on a pile supported rail on either side of the travel slip. A 32' wide x 195' long gravel road will be constructed from the travel lift slip to the existing concrete slab that used to support the previously existing fishhouse. The older wooden bulkhead on Baker Creek from the proposed travel lift slip to the newer vinyl bulkhead upstream will be excavated along with an area of canal bank 10' wide x ±240' long. This area of bank will then be stabilized with a new vinyl bulkhead. Maintenance excavation of Baker Creek adjacent the new bulkhead will be undertaken to a final depth of minus 6' below the NWL. The existing boat ramp at the head of Baker Creek adjacent Pantego street is to be replaced and enlarged to 20' wide x 35' long. A retaining wall is proposed along the upland/Coastal Wetland marsh interface on the western side of the property. A "French Drain" system is to be incorporated in the retaining wall with weep holes through the retaining wall discharging into the marsh. The "French Drain" will consist of an area of washed rock and a 4inch perforated pipe covered with a `sock" adjacent/landward of the wall. Anticipated Impacts The proposed project will result in the excavation/disturbance of 14,845 ft2 of Battalina Creek bottom, 12,900 ft2 of Baker Canal bottom and 13,460 ft2 of Baker Creek bottom. The bank excavation of Baker Creek and Baker Canal will disturb 5,361 ftZ and 18,634 ftZ respectively. Spoil deposition from all excavation activities will fill of 35,442 ft2 uplands. The backfilling of the proposed retaining wall and bulkhead will disturb 25,240 ft2 of uplands. The boat ramp will fill 700 ft2 of Baker Creek bottom. Once complete the project will increase boat traffic and the associated impacts. Overall Proposed development described in your narrative cover letter, written application and shown on your plats must be consistent such as slip numbers, number of finger piers, boat lifts, tie pilings, amount of cubic yardage from excavation activities, etc. It is important that you include the location of the existing normal water level (NWL) especially when you are undertaking highground excavation to widen a waterbody or enclose a basin or part of a canal behind a bulkhead. These areas should be identified with unique hatch patterns and listed in the legend. The written application DCM Form MP-4 states that there will be 20 —15' x 30' boat lifts which are not shown anywhere on the plan view. The application package contains many plats including some that are hand drawn and are redundant as well as inconsistent between the hand drawing and the drawings produced by your surveyor. The plat work should be of sufficient size that they remain legible. A system of numeric identifiers such as "Sheet Number 1" should be used that systematically identifies each plat such that they can be easily identified later in the CAMA/Dredge and Fill permit.
