including the attached workplan drawings (1) dated "Modified 9/17/19" This permit, issued on January 23, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause me permit to De nun anu vow.
1) Unless specifically altered herein, this Minor Modification authorizes the previously authorized
walkway materials change and the access pier above the previously authorized jetty adjacent to the
boat ramp, all as expressly and specifically set forth in the attached letter and workplan drawings.
Any additional development activities may require a modification of this permit.
(See attached sheet for additional conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
General
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
3) This Minor Modification shall be attached to the original Permit No. 115-18, which was issued on
10/5/18, and copies of both documents must be readily available on site when Division personnel inspect
the project for compliance.
4) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2018-01563.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 18-1108.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

CAMA Major Permit No. 115-18 was issued to T.J.'s Land Development LLC to redevelop
a former commercial fish and crab processing plant into a marina in Baker Canal at the head of
Battalina Creek a tributary to the Pungo River in Belhaven North Carolina. The permitted
development consisting of 13 defined boat slips, a boat ramp with jetty, a 21' x 84' travel lift slip
and pile supported railway, 32' x 195' gravel road for the travel lift leading to an existing concrete
pad, upland excavation to widen Baker Canal to a final dimension of 80' x 520' to a depth of -6'
at NWL, maintenance dredging within Battalina Creek 38' x 390' to a depth of -6', 520' of
bulkhead to stabilize the shoreline of Baker Canal, 6' x 372' wooden dock on the landward side
of the bulkhead, as well as a fuel and pump -out services.
The permit was modified on April 2, 2019 authorizing an additional 900 square feet of
upland excavation along the travel lift rail ways reducing a sharp angle on that part of the property
and the length of bulkhead by approximately 100 feet. On April 15 2019 the permit was modified
to allow the replacement of approximately 200' of existing bulkhead at the head of Baker Canal
near East Pantego Street.
On November 1, 2019 the Washington District received a request to modify Major Permit
#115-18 to change the construction material of the 6' x 372' walkway landward of the bulkhead
from open slat wood construction to concrete hog -slat and to add a 3' access pier to the top of the
56' jetty parallel to the permitted boat ramp. To date the in -water portion of the project are
complete and only upland development remains.
The proposed modifications fit the specific use standards set out in 15A NCAC07.0208
(b)(6)(A)(B)(G). A check for $100.00 for the modification has been deposited in the Division's
account. This office recommends that CAMA Major Permit No. 115-18 be modified to allow the
change in material for walkway landward of the bulkhead and the addition of the 3' pier atop the
boat ramp jetty.

would involve changing the wooden walkway to a concrete walkway, moving the boat ramp over
and a 3' walkway on top of the Jetty at the ramp on the right side. (See attached drawing). The
Property is located at 1785 East Pantego Street, Belhaven North Carolina in Beaufort County.
You are the adjacent riparian property owner to the aforementioned project, I am required to notify
you of this project in order to give you the opportunity to comment on the project. Please review
the attached permit application and drawing.

As we have previously discussed, DWR didn't receive either of these minor mod request electronically and therefore,
any requests with oversized maps have to go to Central office to be scanned. Which adds to our processing time
considerable.
As for my comments, neither of these project will require further written concurrence.

I have discussed with Shane and seen the plans. NCWRC has no comment regarding the change of walkway material
landward the bulkhead from a wooden walkway to a concrete hogslat walkway nor the addition of an access pier along
